Where Does the DNC Go From Here?

Stop trying to make Andrew Yang happen, Andrew Yang.  Andrew Yang is not going to happen!

In the wake of the disastrous debate last night, there’s talk of “swapping out” Biden for another candidate, and this lowly writer thinks that was a part of the plan all along.  Here is a very uncomfortable single solitary minute of the debate:

But there are some significant hurdles if that’s the path that the DNC wants to take.  I’ll give you the rundown of all of the options they have if that’s the call, but it’s not likely that it will be.  The DNC of late has really adored doing the unlikely, in a bad way.

There are four paths that the DNC could take in order to choose a different delegate, but the most likely is that someone convinces him to step aside.  That’s the only path that seems likely.  The delegates for Biden have already been assigned, so pulling them without Biden voluntarily stepping aside will be a nightmare.

These are the four paths to a new candidate that the DNC has currently, although this may change as they continue to bend the rules to suit their needs.

Voluntary Withdrawal

This is the most likely way that the DNC will get Joe Biden off the ticket. 

If Joe Biden were to voluntarily withdraw from the race, the DNC would need to convene to select a new candidate. This could involve consultations with party leaders, superdelegates, and possibly even a special convention.  It’s not outside the realm of possibility that Barrack Obama, George Soros, Clinton, or another of the left’s self-proclaimed “kingmakers” steps in to influence Joe Biden to step aside.  

In fact, we should carefully watch the movement and communication of those individuals with Biden, and we can bet that GOP reps will be watching the White House visitor logs like hawks.

All of that said, in a Fox News alert as I’m writing this, Jill Biden is pushing that Biden continues running 🤯 and that Newsome and Whitmer are both being considered, a snub to the token Biden VP.  We’ll stay tuned to Kass’ twitter account to see if this fundraiser is cancelled!

Delegate Reassignment

If Joe Biden drops out, their pledged delegates would be released and could support a different candidate at the convention. The DNC’s rules allow for some flexibility in how delegates are reassigned if the original candidate is no longer in the race.  Of course, this still relies on Joe Biden dropping out, because since those delegates have been assigned already, they have a duty to support Biden if he wishes to run, and involuntary reassignment of those delegates would face significant pressure.  It’s just not that easy to reassign delegates, and some states demand that their delegates support who won the state’s primary.

Special DNC Authority

The DNC has the authority to make changes to the candidate slate if there are extraordinary circumstances, such as health issues or other significant events that prevent the current candidate from continuing.  We have watched as the DNC misuses this for at least three years, Obama was famous for it.  Ignoring budgetary rules for “emergencies” was been seen under Joe Biden repeatedly has become the status quo.  Ignoring rules altogether has been a rallying cry from the GOP in the last 3 years as John Thune points out below. Joe Biden also doesn’t even have respect for the highest court in the land, so I’ll never trust the DNC in general to respect or follow the rules.

It would also not surprise me if the DNC were to claim health issues, and that may actually be their best bet.  It’s obvious that Joe Biden is unfit.  And at the end of the day, there’s no recourse for walking back all of the myriad times that democrats yelled from the rooftops that Joe Biden was entirely fit for the office of the President.  Democrats, I think, will not care that they are now shown to be perjurers and liars on Capitol Hill, and will probably virtue signal til the cows come home.  

Of course this still carries the same requirements as above with regards to delegate assignment, but would help them overcome some regulatory hurdles. 

Special Convention

In some cases, the DNC might call a special convention or meeting to formally select a new candidate. This would involve input from delegates, superdelegates, and other party officials at the convention.  This doesn’t seem far off, either, since the convention is August 16th, they have time to flex.  I think this was in large part why they didn’t figure out a reason to drop out altogether once Trump said he would participate.  They knew that they were still ahead of the convention.  This would bring it’s own problems, though. This would still rely on special circumstances like the candidates health, since the states have already certified their candidates.

According to an offhand comment Jason Chaffetz on Fox News’ Outnumbered, “a lot of states, a candidate has to DIE in order to be removed involuntarily”. 

There are also practical considerations, such as logistics, travel, etc, but with two whole months lead time, most of those should be workable.  The The biggest roadblock really is the fact that we still have delegates who are assigned and it will NOT be an easy move to remove him without his consent. 

At the end of the day, the current DNC rules read: “Delegates elected to the national convention pledged to a presidential candidate shall in all good conscience reflect the sentiments of those who elected them.” So if Joe Biden doesn’t step down, there’s not a realistic path (for a DNC who respects the process) to nominate a new candidate.

I fully expect that Joe Biden will be dropping out, but voluntarily, and at the request of one of the many people who placed him in his current office.  Let’s stick around and see what happens!
