And that can be through land use codes or zoning regulations, forest fees, conservation easements, etc., etc. And remember, if something is a good idea, you should not have to use force to implement it. On the show, we focus on the issues and not the personalities. And we want to look at these issues with reason, try to get the emotion out of it. And so that’s why we do focus on the issues. And we’ll talk about the people that are pushing those issues, but stay out of the personality stuff that happens so often. With us as human beings, it does happen. And it could be an intricate and difficult problem. And I chose this because this situation with Tina Peters that is languishing in prison in Pueblo, she was denied bond for her appeal. There are those that want to keep her in prison. And in that county clerk’s letter, it was because they were concerned of what she might say. So it seems like that’s a real First Amendment question. But it’s a real conundrum right now. And Trump has pardoned her, and polis won’t let her out. And so we’re going to really focus on this issue today with Marlee Hornick. She’s written a very important letter. earlier in December to the Department of Justice. And we’ll go through that regarding the pardon. And then in the second hour, we’ll talk with John Case and Peter Tickton, who are Tina Peter’s attorneys. And so stay tuned. It’s going to be super interesting. But it really is a conundrum. That’s C-O-N-U-N-D-R-U-M. And your challenge is to use that in a sentence today. Our quote of the day, I went to, and many of you may be familiar with it, it’s called Desiderata. And I came across it when I was young. In fact, some people gave me a plaque of this, which I gave to my father. And he had… in his office and in his, even when he was in the nursing home, had it in his room he passed on a couple of years ago. And the origin of it is somewhat questionable. Initially, my understanding, it was found, got it right here in, let’s see, it was in Old St. Paul’s Church in Baltimore, dated 1692. Then, apparently, there was a guy that did the copyright on it, and so he received credit for writing it. So I don’t know for sure which it is, but it is very important. And again, my father had this on his wall for many, many years. And it’s a little bit long, but I thought it would be good for the beginning of the year. And it says this, it says, go placidly amid the noise and haste and remember what peace there may be in silence. As far as possible without surrender, be on good terms with all persons. Speak your truth quietly and clearly and listen to others, even to the dull and ignorant. They too have their story. avoid loud and aggressive persons they are vexations to the spirit if you compare yourself with others you may become vain or bitter for always there will be greater and lesser persons than yourself enjoy your achievements as well as your plans and keep interested in your own career however humble it is a real possession in the changing fortunes of time exercise caution in your business affairs for the world is full of trickery but let this not blind you to what virtue there is many persons strive for high ideals and everywhere life is full of heroism be yourself especially do not feign affection neither be cynical about love for in the face of all aridity and disenchantment it is as perennial as the grass take kindly the counsel of the years gracefully surrendering the things of youth Nurture strength of spirit to shield you in sudden misfortune, but do not distress yourself with imaginings. Many fears are born of fatigue and loneliness. Let me go back, but do not distress yourself with dark imaginings. Many fears are born of fatigue and loneliness. Beyond a wholesome discipline, be gentle with yourself. You are a child of the universe, no less than the trees and the stars, and you have a right to be here. And whether or not it is clear to you, no doubt the universe is unfolding as it should. Therefore, be at peace with God, whatever you conceive him to be, and whatever your labors and aspirations in the noisy confusion of life keep peace in your soul. With all its sham, drudgery, and broken dreams, it is still a beautiful world. Be cheerful and strive to be happy. And that is Desiderata. We’ve got a little bit of time for some headlines. So the first one that I thought was super important is this is from the Associated Press. It says the Trump administration orders a Colorado coal fired power generator to stay open. And it says this time they’re ordering the owners of a Colorado electricity generating unit to keep it running beyond its Wednesday retirement date. Compliance will cost Tri-State Generation and Transmission Association and the other owners of the Craig Station power plant in northwestern Colorado. It says the plant owners will need to fix a broken valve that put the power plant’s 446-megawatt Unit 1 out of operation on December 19th. Tristate said in a statement. The order from Energy Secretary Chris Wright follows recent Department of Energy moves to keep coal-fired power stations open in Indiana, Washington State, and Michigan, despite efforts by their owners to close them. It’s part of President Donald Trump’s push to revive the U.S. coal industry at a time when many utilities are shifting to cheaper, less polluting energy sources, such as natural gas, And it says renewables. Again, this is Associated Press, but renewables are not cheaper, and they’re not necessarily less polluting either, because we’ve not taken into account what it costs to attempt to recycle, which I guess you cannot recycle, solar panels and wind turbines. So anyway, it says the administration, meanwhile, has blocked… as block renewable energy, including some wind power. And so this is, again, you can take a look at that Associated Press article, and you can see just kind of under the surface how they continue to push wind and solar when we’re learning that there’s so much land that’s required for it. You know, we talk about this all the time. And we’re not… We are not opposed to wind and solar here, but we want to have honest conversations about it. And that’s why the documentary on climate conversation is so important. It’s the project of Walt Johnson. You can watch that for free at aclimatconversation.com. Next thing, I find this somewhat distressing, and that is that color representative Neguse and Hurd and Senators Bennett and Hickenlooper, and this is from Congressman Joe Neguse, website, mobilized bipartisan, bicameral coalition to protect NCAR. And we talked about this the other day as well. And NCAR is the National Center for Atmospheric Research in Boulder. And it says in a letter to congressional appropriations, 76 lawmakers from across both chambers requested statutory language be included in the fiscal year 2026 funding bill to prevent its dismantling ensure that in car can maintain maintain its core capabilities and continually says delving into the earth system science now in car has been one of the um organizations that has really pushed the climate alarmist uh narrative out there and it’s very disappointing that um colorado representative republican heard from basically kind of the western slope area has put his name on this and so we need to continue to call this out when this occurs. And so that is of great concern. And then there’s two other headlines that have been very distressing. This is from the Center Square. It says, Chicago school board raises the tax levy on families at a breaking point. And this is taxing people out of their homes. and it says that board president sean harden said the special board meeting was held during the school district’s winter break to consider an amendment of the 3.8 tax levy approved last august to 4.78 percent that is absolutely significant and then over in Boston, this is from WBUR, Mayor Wu, Boston residents’ property taxes are to increase 13% in January. And, again, these taxes, these increase in taxes, it will tax people out of their properties. She is just doing great work regarding our elections. And she’s heading up a new organization. It’s Real America Vote. And Marlee Hornick, welcome to the show. Thanks, Kim.

It’s great to be with you again. Great to be with you as well. And tell us a little bit about Real America Vote.
SPEAKER 07 :
Well, RealAmerica.Vote is picking up the reins where my former organization kind of didn’t want to pursue litigation anymore. We believe that the The incredible election facts that have been gathered around the country need to be litigated. They need to be brought into court. And we have to do this on what’s called an originalist basis, which means we can’t argue about it the way it’s been argued about for the last decade, because I think everyone understands and realizes we haven’t made that much progress with those arguments. We have to go back to the framers and the founders arguments. We have to use James Madison and Alexander Hamilton’s ideas about Republican government. and their ideas about representation and how to create a just government so that you can have, as you always say, and I love it, freedom versus force. You have a culture, a society that is faithful to its own laws because the laws are just. So that’s the originalist way that realamerica.vote is specifically working on elections now, including a major lawsuit we have right now in New York State against tish james and the new york state board of elections where we actually claim and they don’t really they haven’t been able to counter it effectively we claim that they have abandoned the composition clause of the united states constitution they have abandoned article one section two the third sentence they have no intention of complying with it and yet they must and um It’s pretty exciting because they have no counter. Their motion to dismiss couldn’t address this issue. They couldn’t say, we actually haven’t abandoned it. They couldn’t say anything.
SPEAKER 05 :
Okay, well, and you live in New York, so this is really important. Of course, we see Letitia James in the headlines quite often. But let’s move over here to Colorado, because you wrote a very important letter on December 12th to the Department of Justice regarding Tina Peters. And President Trump has pardoned her. However, Jared Polis and company and people on both sides of the aisle have said that this is a state issue, and she was convicted of a state crime, and so a federal pardon doesn’t matter. So walk us through this, Marlee Hornick.
SPEAKER 07 :
Sure. Well, it’s pretty simple. The state is claiming that she is exclusively a state officer. that she is hired by the state of Colorado and she works for the state of Colorado and specifically Mesa County during the time of her tenure. She was elected, I believe, in Colorado. You guys actually get to elect election officers, which is pretty handy in New York. They just get appointed. So they’re claiming basically that they have exclusive jurisdiction over her actions and her alleged crimes. But again, going back to the framers’ arguments, that’s simply not true. There is standing federal law and Supreme Court precedent that election officers, this is a quote, are officers of Congress when there is a congressional or other federal election on the ballot. And this is only logical if you think about it. And if you go back to the ratification debates, you can see the problem, right? The states were basically independent nations, and they couldn’t have foreseen the way that we think of our country now as really one nation. They really just wanted to create a stronger union, a stronger kind of umbrella catchpoint that would better substantiate their rights, better secure their rights against foreign adversaries. and other kinds of problems they could face, domestic insurrection. They wanted to have a better agreement about, almost like in their mind, not ours, and in their mind, a treaty. So the problem they had was that they were going to have to elect people to state government and they were going to have to elect people to federal government. And the federal government didn’t want the states to run the elections. The new people headed out that way. And the state didn’t want the federal government to run the elections. So they ended up with this compromise where the authority is delegated to the states, but it is not given over to the states. And this is where everybody gets confused about federalism. When there is a federal election, and Madison talked about this, if the state is completely in charge of that election, they can easily subvert the federal government. And then you don’t have your new union. You don’t have… the stronger government and the better protection on rights that you sought to create. That’s a kind of treason. And so they built this system where the people who certify federal elections are state officers, but they’re also officers of Congress. They’re just as accountable to federal law, and they’re just as accountable to federal authority and enforcement. So this is the issue for Tina. When they say the federal government has no jurisdiction, they’re just wrong. They’re just wrong. And Tina was following federal law. Her attempts and her success, she succeeded at securing those records against illegal destruction under federal law by Jenna Griswold. She was following federal law. So this is a very challenging area of law. This is not like a magic wand. But what the state is claiming is simply false.
SPEAKER 05 :
So I think ultimately this is going to go through the courts, obviously, if Polis does not release her. But this could take some real time, Marley. So what’s your thoughts about that? And would this go all the way to the Supreme Court? What do you think about all that?
SPEAKER 07 :
It’s a real dilemma. And the reason that I sent this letter to Ed Martin, kind of laying this out and citing original jurisdiction, citing the cases, citing the case law, citing the Federalist Papers, and citing all of these anchors that show that the case was incorrectly litigated. The reason I sent it to Ed Martin is because he is on or he heads up the Weaponization Committee of the Department of Justice. And so it is possible for him to, instead of just trying to litigate Tina’s issue, which is needs to continue to be done. And I know her attorneys are doing a great job. And in fact, their, their emotion, they filed after my letter had been sent to Ed Martin reflected the new case law and the new argument about, um, officer of Congress. So I was very pleased that it was valuable to them as well. Um, they’re going to keep litigating it. But Ed Martin can start to go after these people. And I know everyone across America is going, you know, the people who understand how the government has been abusing citizens, they’re going, how come this hasn’t happened yet? How come this hasn’t happened anywhere yet? And I get it. But this is another opportunity where it could happen because they are wrong to And now if they’re not going to accept and admit that they may be wrong, and, for example, put Tina on, let’s say, house arrest, right? So the issue hasn’t been settled yet, but she’s not suffering. They’re not abusing her and tormenting her. If they’re unwilling to take any steps, then I think Ed Martin should start going after them. I really do. And that’s why I sent him the letter. Because we can’t just allow these things to take forever. This is a woman’s life.
SPEAKER 05 :
Well, so my understanding is that, and you refer to it as alleged crimes, that what she was convicted of… She’s appealing that. And she’s, you know, it’s nonviolent crimes, and she’s not a flight risk. And it’s astonishing to me that they would not let her post bond while she was appealing the case. And my understanding is that the facility that she is in is a maximum security facility because in Colorado we do not have a minimum security facilities for women. and that the conditions are rather harsh. And so we, and I’d sent the information over to you before Christmas, I’d had her attorney on, and I was just really troubled about it. And I thought, well, what could we do? And so I thought, well, let’s appeal to compassion, the humanitarian component of this to Governor Polis. And we put together a petition. to ask him to release her by Christmas Eve, which he’s not done. And, of course, he and Trump now are kind of in a back and forth, which I’m not sure that that would help from the humanitarian argument right now. But we did it quickly, and 4,201 people signed that petition. I delivered it to Polis’ office on the 22nd of December. But she’s still languishing in this… this prison. She’s 70 years old. She’s had cancer many years ago. There’s concerns that perhaps that might be reoccurring. Her mother’s 97. It really seems to me, just from a humanitarian standpoint, that Polis should let her out. But that just has not happened yet, Marlee.
SPEAKER 07 :
I know. It’s terrible. And it’s obvious that This is not a circumstance where you’re going to find a humanitarian cell in any of the adversaries of election validity. They they’re out there. Jenna Griswold put up a video viciously, you know, referring to Peters again as an election denier and a dangerous person. And all this all the rhetoric that they have thrown at this issue for five years now. And it hasn’t changed the fact that they cheated. And it hasn’t changed the fact that nobody can reconcile these books. I mean, that’s why I fought so hard on the lawsuit we had in Colorado in 2024, because the outcome of that lawsuit is proving that Griswold and her staff cannot reconcile their elections. The books are a disaster, and that is a crime. Obviously, we were in civil court, but, you know, They’re not allowed to do that, but they want to keep doing it. And this is, you know, Kim, I know you said, hey, this lawsuit over in New York is a different issue. It’s in New York for New Yorkers. This is like the nexus of the war for our country that is going on right now. I mean, it really is. And this issue of whether or not election officials are prepared subject to chief election official tyranny and exclusively allowed to do whatever they want in their states, this is causing a lot of serious trouble for our country. And everywhere we can fight it, we just have to. So I agree. It is an absolute travesty that Tina is being held under these conditions. And you cannot appeal to compassion because these people are are this is a huge CYA and they don’t care. They’re they’re beyond compassion. They’re they’re in a state of either, you know, terror or they’re in a state of like delirious control. And I don’t know which one it is. And frankly, I don’t care. It’s got to be stopped.
SPEAKER 05 :
Well, that is, we must have free, fair, honest, and transparent elections, or otherwise we don’t have our republic. And so we’re going to continue the discussion with Marlee Hornick at realamerica.vote. And these are important discussions. They happen because of our sponsors. Yeah, it’s right there on the front page, and it’s also on the litigation page. And it’s kind of an interesting history lesson for folks that have never really thought about this issue of dual elections.
SPEAKER 05 :
Well, and it makes sense to me, as you are explaining this, how the states at our founding and trying to figure out the federal government, and clearly state elections affect what happens at the federal level, because if you have a state that doesn’t have free, fair, honest, and transparent elections, it’s going to affect who’s elected to the House of Representatives and to the Senate. And that’s why this is so important that we got to get this right. And we got to get it right before the 2026 midterms. And you’ve got your ear to the ground on this. What do you think is going to happen here, Marlee Hornick?
SPEAKER 07 :
Well, I think there’s going to be emergency action by the president. And I know of several efforts that are working really hard to make sure that action is effective. I think that the executive order that was attempted early in this Trump administration was certainly a nice idea, but it was doomed to fail in court. It really didn’t go, again, to the anchors of our system. I call it going back to the rock. Why? Why is the system set up the way it is? And how was it really supposed to function? Because we’re not on our rock, as you say. And absolutely, a false elector, a false representative from Colorado or multiple false representatives from Colorado affects New York, just like New York’s false elections and potentially false representatives affect Colorado. You can’t separate us anymore. when we are talking about our national government. So I do believe that there’s going to be executive action, and I’m working very hard on my end. My focus right now, 100%, is supporting that process with originalist research and ideas for how to make that action defensible in court or in front of Congress. Basically, if you use an executive order… then it ends up in front of the Supreme Court. And if you use an emergency authorization, it can be overruled by a joint resolution of United States Congress. So you have to have arguments that can survive a two-thirds majority. Either way, whether it’s the court or whether it’s Congress, you have to make the arguments philosophically aligned with the purpose of elections. You can’t just kind of go out there and say, well, you know, every other country has I.D. So we have to have I.D. or say, you know, this, that, because there’s there’s an there’s an argument. I’ll tell you, the other side, the adversaries, the people who want to keep doing things like putting Tina Peters in prison to defend their electoral outcomes have ideas. lots and lots of arguments prepared. You have to know what they are and be ready to counter them. So I think that’s going to happen. I really do. I have a really good feeling. And we’re getting, you know, I know we’re getting really positive reception in D.C. I know other really smart folks are also. And so I think this country is going to get this fixed. I really do.
SPEAKER 05 :
So what can we be doing here in Colorado? What would be your advice to us here in Colorado right now, Marlee Hornick?
SPEAKER 07 :
Well, I think everywhere what we need to keep doing is keep like like you’re doing. We need to keep talking about the reality. We need to keep reframing the reality away from the false narrative that paints people who question elections as crooks. And we need to be focusing on these efforts that are going to be coming out. These, you know, the president’s efforts, litigation efforts. And we just need to keep at it. We can’t get discouraged. As soon as we get discouraged and kind of lay down our words, lay down our truth, lay down our facts, we will just get bulldozed right over. And we won’t have this country anymore. We really won’t. And that’s sad to say. And it might sound extreme, but, you know, the way people are behaving who are just doggedly determined to maintain control of our country Treasury, let’s just face it, this all comes down to money and power, as always. You know, they don’t care about liberty. They’re having a great time.
SPEAKER 05 :
Well, and this is off subject, and if this isn’t in your wheelhouse, that’s fine. But what we’re seeing with, because you talk about the Treasury, and when we’re looking at Minnesota and the amount of fraud, apparently, by people that many probably have immigrated from Somalia, Somalia. We are spending ourselves into oblivion through all of this government money that’s out there. We’ve got to get that stopped. But what’s your thoughts on that? Do you have a comment?
SPEAKER 07 :
Yeah. I think about this a lot, Kim, as I’m sure you do. We have multiple layers of problems right in that one instance. And I’m sure, as the president has said, this is going on in other states as well, and perhaps worse in some other states. The issue is twofold, but fundamentally, all this money is getting appropriated through Congress. And this is why I would say it’s not obvious to me, and it may not be obvious to others, whether it’s better to use an emergency executive power about elections through Congress or through the Supreme Court, because they don’t seem to want to stop. There’s a lot of money flowing through those coffers, whether it’s in Minnesota, whether it’s in Colorado or New York or any other state. And Unfortunately, you know, greed is a vice and it’s not a new vice. So to me personally, Kim, looking at this issue, it just makes me work harder regarding the 2026 midterm. Now, I do want to talk quickly about one in reference to that one project that RealAmerica.vote is very, very focused on right now. So we had funded some research projects. into whether or not voters whose votes are counted are actually real people. It’s very difficult to kind of run this citizenship issue to ground without federal databases, but it is possible to use private tools. So private databases, private identity verification tools that are used by, you know, banks for fraud prevention. Actually, you know, LexisNexis and the Federal Reserve have published multiple papers about this issue of synthetic identity fraud. Fake people, like constructed identities out of different pieces of other real identities kind of glommed together, like taking a shattered mirror and kind of gluing it together. And then you pass it through a system and the system allows it in. And then in the financial world, They end up, you know, they get a credit card and then a year later they have credibility and then they start spending on the credit card and there’s nobody there to pay the bill. There’s no person. So the same issue, and we measured it in voting systems, exists. We were finding somewhere between like a 2% and I would say as high as about just under 7% rate of votes counted. for Congress people, for federal elections, by fake identities. We could not find them looking up in these fraud prevention tools. And we looked and looked and looked. We scoured the tools. We scoured multiple tools for these people. So anyway, long story short, what we’re doing now, those were small samples. I brought those samples to the FBI. I brought those samples to U.S. attorneys. And they thought the idea was very compelling, but the samples were too small. it wasn’t enough for us to make these really strong arguments that need to be made. So that’s what realamerica.vote is totally focused on. We’re going to be running at least a quarter of a million voters from various jurisdictions in the country to show the very high prevalence of this problem. And so, you know, if people want to be a part of that, you can go to realamerica.vote. We can, you know, have a conversation if somebody wants to be a part of supporting that work. Unfortunately, the private tools are expensive, but I always say liberty is worth it. How much longer are you going to wait? So that’s, you know, that’s what we’re going to be working on to make sure that the president has the evidence he needs and the courts have evidence that they just can’t turn their eyes away from. Fake people voting at, you know, 4 percent, 6 percent in elections. And we ran that on Jefferson County. I mean, it was crazy what we found, right, in Jefferson County, Colorado.
SPEAKER 05 :
Right. And you know what? I’ve got that in the other room. But I think it was around 9%. I’ll go during the break. I will run and get that so that we’ve got that. We’re talking with Marlee Hornig. And she had sent a letter to the Department of Justice December 12th regarding the situation with Tina Peters, former Mesa County Clerk and Recorder. who is languishing in a Colorado prison upon her appeal of her case. And, Marlee, people can go find this at realamerica.vote, and it is very well… documented regarding Hamilton, Madison. It’s a pretty remarkable letter that you have, Marley, but this is so important because our country really is on the line. We’re going to be celebrating our 250th birthday this year and 250 years ago at this time there was a lot going on at the founding of our country and one of the things regarding Tina Peters is that she was convicted of what I would consider process crimes and of course the processes that were put in place would make it very difficult for county clerks to be able to ascertain i think their elections and there was this thing that jenna griswold did called the trusted build and in fact i was up at a meeting in larimer county sitting next to the larimer county clerk and recorder and she explained yes there’s going to be a trusted build on the computer system i thought huh that that’s really interesting and uh Tina, my understanding, what she did is she took a before and after, the before the trust to build and the after, and there were discrepancies. And so instead of throwing her into prison, it seems like we would want to check out those discrepancies, Marlee Hornig.
SPEAKER 07 :
Well, that’s what you would do if what you were interested in was fair and honest elections. You also wouldn’t, if that was your priority, you wouldn’t wipe all of the election records before federal law allowed you to do so within the 22-month record retention period, which is the trusted build was a complete wipe of the entire system, all of the election records. So it’s very reckless and irresponsible actions. No… You know, one of the ways that I talk about this system, because it’s difficult sometimes for people to wrap their heads around the complexity of the way our elections work. But fundamentally, all of these digital and electronic systems are like a digital border of our country, right? If any of those records have been penetrated, if any of those systems have been penetrated or can be penetrated, It is equivalent to leaving the border open of the physical border because it goes straight to Congress. Right. If you can get into any of these electronic systems and alter things, you can alter Congress. You can alter the law. You can alter the appropriation of trillions of dollars of funds. and you can direct it where you want to based on those actions, it’s very dangerous. So when they decided that it was okay to wipe those records against federal law, you know, that’s a huge problem. Tina did absolutely the right thing. I would say the only place where she did place herself in some jeopardy is that, and I understand the problem. I mean, first of all, these are rediscovered arguments that a clerk elected to the position in Mesa County is answerable to the Department of Justice. Right. That is not something people generally understood when this took place. And so, you know, she brought in people to help her achieve this goal when she probably should have called the FBI. But who knows what may have happened if she had called the FBI, right? Like, through the vote, called the FBI. And they ended up in federal prison, too. This is not… Obviously… Sorry. Obviously, we’re dealing with a third rail here, as we call it in New York. This is the nuclear rail. So… Coming back around, you know, fundamentally, she should not be in jail. As you say, she did the right thing. She did what was required under federal law. She may not have realized it. She may have just felt like this was wrong and didn’t want to participate. And that’s why we all love her so much.
SPEAKER 05 :
Well, let’s take we have just a few minutes left and let’s talk a little bit about what’s happening in New York with Mondani. Mondani was sworn in as mayor of New York and he was elected via ranked choice voting. And that really that looks we had that question on the ballot out here in Colorado and we had millions of dollars that were put in by voters. billionaires to try to get Colorado to vote for it. Thankfully, it was defeated, but it’ll be back. But just quickly talk about ranked choice voting.
SPEAKER 07 :
Well, I think the reason that people are spending so much money on it is because they feel like it’s easier to rig. And I want to be clear, Mamdani was not elected directly by ranked choice voting. The Democratic primary was ranked choice He won the Democratic primary in a ranked choice election. He won the general election straight up, supposedly, although we’re getting ready to audit those records, of course. But, you know, frankly, he also, if you ask me, and this is part of the reason why we just can’t quit on this issue, I think he won that election because good people won’t run for office anymore because they know the system is rigged. And so literally you have an election where you have, you know, a communist like Islamist supporter at a bare minimum. You have a failed New York governor whose last administration was loaded with scandals, including the murder of tens of thousands of elders when they were sent back to their nursing homes with COVID known COVID patients. He was the other guy, the good guy, supposedly. And then you got Curtis Lewa, who has been walking around in a red beret for 40 years, patrolling the subways on his own. So it’s like, where are the good candidates? Where are the serious people? We may audit that election and find problems in it. But the first problem is, where are the good people running for office? Where was the candidate worth saving in that race? And so I don’t know if you saw this. There was a story from the Gateway Pundit last week about a woman who is the only primary Republican candidate right now in the state of North Carolina for a state Senate seat. And she’s completely covered. And, you know, it’s a hijab or I don’t know what what her dress is called, but she’s basically wearing a black sheet. This is who is the only candidate for a Republican primary in North Carolina in one of their districts. The issue of people running for office is a big deal. And so we have to fix the election so that good people who really do care and want to do things well and want to take those responsibilities, take those reins. and run New York City or Denver or any other city responsibly. They have to know that they can get through this system and get out the other side, and maybe there’s a chance for them to win. It’s fair and square, right? If they do a good job, they could.
SPEAKER 05 :
So this is, 250 years ago, it was an ideological battle. And it is an ideological battle here, as I think we are in the third founding of our country. Regarding that Jefferson County 2024 phantom voter report, it’s by Unite for Freedom, and that percentage was 9%. That is pretty significant. And you can find that at Unite for Freedom. Marlee Hornick, we’ve got one more minute left.

And so it’s a real conundrum on what is happening right now regarding our elections. And as you know, we’re working diligently to shed light on that. We’ve got the two lawsuits out there regarding our elections here in Colorado. So we’ve got a lot of work to do. We’ll just put it that way. I went to, for our quote of the day, it’s called Desiderata. And there is some question about its origin. There are those that… say that it was founded in an old St. Paul church, I think it is, Baltimore in 1692. And then there’s a guy that copyrighted it, and he’s credited with writing it. I don’t know for sure, but I do know that my father, a very Christian man, had this on his wall in his office when I was a kid, and then on his wall even when he was in the nursing home. And I thought it was appropriate for this 2nd of January in 2026. It’s called Desert Errata. It says this. Avoid loud and aggressive persons. They are vexations to the spirit. If you compare yourself with others, you may become vain or bitter. For always there will be greater and lesser persons than yourself. Enjoy your achievements as well as your plans and keep interested in your own career, however humble. It is a real possession in the changing fortunes of time. Exercise caution in your business affairs, for the world is full of trickery. But let this not blind you to what virtue there is. As Marlee was mentioning earlier, That elected office, there’s a lot of power in that because there’s a lot of purse strings. And as we are looking, it’s what happened in Minnesota with all of the fraud regarding programs to feed children. daycare, we realize that government has gotten out of its proper role. And taxes and fees and government-induced inflation is making it more and more difficult for families. And so here you have the federal government apparently giving out Grants are giving money to help with daycare. And let’s get this turned around here where we are keeping more money in our pockets. We can choose which charities to give to because once you get government money involved in all of this, it opens up the opportunity for fraud. And this is money that is being taken out of the pockets of hardworking Americans. And it is going into all these different programs and these grants. And it’s across the board, government grants, incentives, tax credits. This is government putting its finger on the scale. And in America, each of us is supposed to be treated equally under the law. And so that’s why our American founding, our Bill of Rights is so important. And we have Teddy Collins on the line with us. You know him. Happy New Year to you as well. And as of January 1, I saw a headline that there’s some new rules regarding sales of firearms at gun shows. And so is there other stuff that people need to be aware of regarding the Second Amendment?
SPEAKER 08 :
Well, really, as of now, just that one. That’s one that went into effect, Jan.

And that’s just tighter restrictions on gun shows. We call it the gun show death bill, because that’s what it’s intended to do, is it’s intended to kill gun shows here in the state of Colorado. Of course, we do have 003 going into effect in August of this year, which will make it where you have to have a license to… purchase any semi-automatic firearm that has a detachable magazine that is gas operated. So that’s upcoming as well. And of course, there’s rumors of new bills they’re going to try to introduce here very shortly for this legislative session that we’re about to enter on January 14th, unfortunately.
SPEAKER 05 :
And so you are going to be very busy watching this down at the statehouse, yes?
SPEAKER 08 :
Of course, yes. State House and State Senate will be there. We’re going to be fighting back every single bit of the way to try to make sure that these bills don’t pass. But it’s going to take more than just us. We’re going to need other people. We’re going to need some of your listeners to show up and testify and to make their voices heard, to slow down this process and try to kill these bills.
SPEAKER 05 :
Okay. And so January 14th, I look at that. It’s so nice to get through the holidays. And now January 14th, you’re looking at it from the Second Amendment standpoint. We over at the Colorado Union of Taxpayers will be looking at legislation regarding how it affects the taxpayer, which is all of us. Tabor, Colorado’s Taxpayers Bill of Rights, property rights, and then parental choice and education. So we’ve got a lot of work to do because there were well over 700 bills and resolutions that were proposed last year. And, Teddy, I really do feel that much of this legislation is tip of the spear stuff where the radical activists find a, the radical activists, many times billionaires, for example, in the firearms arena, Bloomberg spends a lot of money. They write legislation. They find a legislator here in Colorado to run the bill and Because, you know, over 700 bills, there’s no way that these legislators are writing these bills. And so we’re seeing special interests, I think, use Colorado many times as a test case for legislation, and then they try to push it out across the country.
SPEAKER 08 :
100%. That’s what we’re seeing. I mean, not long after 003 was introduced here in Colorado and it looked like it was going to pass, New Mexico introduced almost an identical bill. Colorado is a testing ground for these things. People out of state are always saying, you know, why does Colorado and why do the laws in Colorado matter to me? Well, it matters because those laws are going to be coming to a state near you soon. It’s very important that we’re on the front lines here. It’s very important that we fight back and we don’t give an inch. We’ve got to protect our constitutional rights here before they take them away from us.

Thank you. It’s a pleasure to be here.

So, John, as you know, you’re located here in Colorado. And you and I had talked after I had had you on about three weeks ago. And we talked about Tina Peters and the fact that she’s languishing in a maximum security prison here in Colorado. My heart was just so troubled. And I thought, well, she’s been pardoned by President Trump. Governor Polis is not honoring that pardon. And we talked with Marlee Hornick about this a little bit in our number one. But my heart was just so heavy. I thought, well, let’s try Christmastime humanitarian. We put together a petition over four thousand two hundred and one. sign that petition from all over the country and the District of Columbia, all 50 states, and I delivered that petition to Governor Polis’ office on the 22nd, asking from a humanitarian standpoint to release her. That didn’t happen, John Case.
SPEAKER 11 :
No, it didn’t. It was so kind and wonderful of you to circulate that petition, get the signatures, and have the courage to walk into Governor Polis’ office and present it. But… As you know, he commuted the sentence of a man who killed four people. He commuted 90% of that sentence. But for a gold star mother, he wouldn’t commute a single day. She had never had a prior conviction. It was the convictions that were had were nonviolent. Nobody was injured. There was no property damage. So it’s hard to see why the government wants to see Tina Peters locked up, except she’s a political scalp.
SPEAKER 05 :
So Peter Tickton, thank you, John Case. Peter Tickton, you were brought in later regarding this case. So tell us a bit how you became involved in representing Tina Peters.
SPEAKER 09 :
Well, I’m not sure exactly how that materialized at the beginning, but when I was asked if I would come into the case, I was, of course, honored to be able to do that, and I didn’t know the attorneys that were already in the case. I knew Stephanie Lambert, but I didn’t know John Case, and I didn’t know the other two, Bob Sincar and Patrick McSweeney. But through the process of working with all four of the lawyers, it turns out that these are exceptional lawyers. It’s kind of like a dream team. And, you know, both of my experience, though, has been with Stephanie Lambert and with John Case. And I told John the other day, I said, you know, my only regret is that I didn’t meet you 40 years ago. Because, you know, because he’s just a powerhouse. I mean, his thinking is so clear. Sorry to talk about you in the third person, John. I know you’re here. But facts are facts. And that’s all I’m saying. So anyway, so I was brought in and then and I think it added something to the team. And then some of my ideas came about. But most of the really clever things that we’ve been doing were in play when I came in. And it’s just that I was able to add a little bit to the way it was getting done.
SPEAKER 05 :
Okay, so John Case, first of all, my understanding is during her trial that there was key evidence that was not allowed by you as the defense. Is that correct?
SPEAKER 11 :
That is correct, Kim. Tina’s defense was that she was executing a public duty. There’s a federal law, 52 U.S. Code 19, 20701 that requires all county clerks to preserve election records, and that includes the digital election records that are stored on the hard drives of the county computer system. So that law requires, required Tina to preserve those records. She learned that the Secretary of State was going to wipe those records from the system as part of a software upgrade. The Secretary of State calls that software upgrade a trusted build, but they should really call it the wipe. Because before they install new software, they wipe everything off the system. They erase the software that was used in the prior election, and they erase all of the election records that were generated during the election. So Tina learned that her obligation to preserve records would be violated by this wipe that was going to be performed by the Secretary of State. So in order to perform her federal duty, she engaged a qualified cyber consultant who had security clearances from federal agencies, who had done work for federal agencies, but he would work only on one condition, and that is that his identity be kept secret because he was being hunted by the cartels for work that he had done on a major FBI case. So Tina agreed to protect his identity, and what she was convicted of was introducing this gentleman… Conan Hayes by the name Gerald Wood. Gerald Wood was a local computer consultant in Grand Junction who volunteered to get a county key card and then have it transferred to Conan Hayes. So Conan Hayes went into the room wearing Jerry Wood’s key card. And that All of the convictions stem from that identity misunderstanding. So there was no harm to the computers, and there was no injury to any person. All the records were preserved. Conan Hayes made a forensic image of the voting system before the wipe so that all the county records were preserved. And he made a second image after the wipe so that the two images could be compared. And when they were compared, experts concluded that the wipe erased all of the records of the 2020 election, which was the goal, by the way, of the Secretary of State and Dominion voting systems was to erase the records of the 2020 election.
SPEAKER 05 :
So Peter Ticton, this is clearly a problem, but she was convicted of what I consider process crimes, and the process that was put in place made it difficult for her to really do her job. But what everyday people out there that don’t really know the intricate details of this case here, and I guess this was the catalyst that I invited John Case on three weeks ago, was this letter. from the Colorado County Clerks Association, and the executive director is Matt Crane, that they basically had sent a letter to Jared Polis requesting that Tina be kept in prison. And I was just astonished when I saw that letter, Peter Tickton.
SPEAKER 09 :
Right, yes. By the way, John, you see what I’m saying about John, how concise and how succinct, what a job he did. He laid everything out beautifully chronologically. But if I could just sum up from where John left off, where now what this really means is that the person who was attempting to save the evidence, the person who was attempting to basically preserve the truth is in prison. And the one that went to 62 different counties, you know, Jenna Griswold, she is the one who’s violated the federal law. She is the true criminal. And she is the one pushing to make sure that in the first place that Tina Peters got prosecuted for these claims. And, and, uh, And they’re still pushing to make sure that Tina Peters remains in prison. But it’s backwards. The criminals are running the government. And the one who is attempting to say that the emperor has no clothes, the one who is preserving the truth, is now behind bars. That’s what’s really wrong here. But to get to what you just said, why? Why did they need to prosecute Tina Peters? Peters. They needed to prosecute her because they needed to make the point, not just to every other clerk in Colorado, but to every clerk in the country, that if you want to preserve evidence that shows that Dominion machines are being used to basically manipulate the outcome of the elections, if you want to preserve that, you’re going to be like Tina Peters. So don’t you dare. You’re going to be in prison, too. And no matter how innocent you are, No matter how much good you’re trying to do, no matter how much you’re trying to follow the federal criminal guidelines here, it doesn’t make any difference. You’re going to go to prison like Tina Peters did. That’s why Tina Peters is still in prison, not because the governor thinks that she’s really guilty and for whatever kind of reasons he may say. This is why President Trump is so exasperated by this little pipsqueak of a governor that you’ve got, who thinks that he can say no to the president of the United States.

Okay, well, we’re going to continue the discussion. We’re talking with two of Tina Peter’s attorneys, John Case and Peter Tickton, and she is still languishing in a maximum security facility in Pueblo. My understanding is the conditions are harsh. As many of you know, Mesa County Clerk and Recorder, former Mesa County Clerk and Recorder Tina Peters is languishing in a Colorado prison. and she’s been denied bond while she’s trying to work through the appeal. Peter Ticton, I find this, and we’re talking with John Case and Peter Ticton, two of her attorneys, I find this astonishing to me that she was denied bond on this as they’re working through the appeal. Where are you in that process for her appeal right now?
SPEAKER 09 :
Well, we’re going to have oral argument on January 14th. And in the meantime, the Colorado Court of Appeals has been very good in terms of the fact that they they realize that there is a pardon out there and they need to determine from their point of view whether or not the pardon should be in effect or not for the state of Colorado. Because they’re kind of in a position where they can either go ahead with the appeal or not go ahead with the appeal, depending on which way they see it. In other words, we’ve got a pardon. And there is a controversy as to whether or not it applies just for the state or whether it I mean, just for federal offenses or for state offenses. And We’ve got some pretty good arguments and pretty good discussion as to why it does apply to even state offenses, especially in this case. So if the Court of Appeals accepts our argument, then they’re going to have to say that they don’t have jurisdiction to go ahead with the appeal in order that Peter Peters be released. If they go forward with the argument and they accept the arguments of the state, which are going to be basically provided on January 5th, once that occurs, I guess that’s Friday. What am I saying? The 5th is on Monday. And then we have the until Thursday night to be able to respond to that. But if they do agree with the state that it doesn’t apply to these state offenses, then they’re going to go ahead with the oral argument on the 14th. And that, too, to John and to May, is really important. That’s really key because we know that the conviction needs to be overturned. And, I mean, we have very high confidence that that’s what’s going to happen. So we didn’t want this delayed and put off. And I thank the justices or the judges of the Court of Appeals, the Colorado Court of Appeals, which is a state court of appeals system, for not causing any delay, wanting to get this thing done, and keeping their date for oral argument. So they did give us a very tight briefing schedule for this new issue so that they can keep that date. And as I said, I’m grateful to that. The big point is that we’re going to be able to then, if they find that the state crimes can’t be pardoned by the president, that they should come to that conclusion. We’re going to be able to jump right from Colorado to the Supreme Court of the United States and hope that they’ll take our case. We think that they should because it’s an important issue as to whether or not the president can pardon state offenses.
SPEAKER 05 :
Well, now, Peter, she’s been convicted of a state crime. However, it surely seems like there would be federal jurisdiction over this because the election records that she was preserving affects federal elections as well. And I’m just a regular person, but gosh, that sure seems to me like the federal jurisdiction would come into play. But again, I’m just a regular person, Peter.
SPEAKER 09 :
We’re all regular people. Some of us know a little bit more about law, but we’re all regular people. Yes, it seems to me that way, too, because of the nature of exactly what’s going on here. you know, this is exactly why the president needs to have Biden power so that you can’t have a captured state. And I’m sorry to say that. I mean, you’re there in Colorado. It’s it’s it’s your state. And I’m an outsider. And I’m saying your state is captured and it may not be palatable and people might not appreciate hearing that. But when your election system is is corrupted and the outcome that very few people are in control of causing is being caused by those people, then that’s why I call it a captured state. And in that circumstance, a president needs to be able to use pardon power to be able to help correct this kind of a situation when it goes so far afield.
SPEAKER 05 :
So, John Case, I consider this conviction a process crime that she was accused of. And processes have been in place. So, for example, I served for four years on city council. And I saw how processes could be put in place that could make it difficult to… I have this to do the right thing sometimes. And that’s technically that’s what happened because I find it kind of crazy that a duly elected county clerk would not have total access to those voting machines. and that, in essence, she had to figure out a way to get to those tabulating machines. She had to figure out a way to get to it so that she could do the before and after of the, I have it in air quotes, trusted build. Is that correct? Am I looking at that somewhat correctly?
SPEAKER 11 :
Yes, you are, Kim. So Tina Peters, as the elected county clerk, had these rights. She was custodian of the voting system she was responsible for maintaining it she had control of the premises it was tina peters who decided who could enter the room and the whole dispute in this case arose because the secretary of state sent an email an email not a not an order from the secretary of state not a rule but an email saying the only people who can be present at the wipe are two people from the county plus the clerk, plus the vendors and the Secretary of State, plus Dominion, plus the Secretary of State. So only those people can attend, and this is for, this is because of our, the Secretary of State COVID policy. So what Tina did by bringing the consultant, Hayes, into the room was not in accordance with the COVID policy of the Secretary of State. But it wasn’t a legal violation. She had control of who could enter the room. And there was a specific rule of the Secretary of State that allowed Tina to bring anyone into the room as long as she supervised that person. And that’s exactly what she did. Prior to that wipe taking place, Tina Peters asked the Mesa County IT Department to supply qualified computer technicians to observe the wipe, and the county IT department refused. And after they refused is when Dr. Doug Frank said to Tina at a meeting that was attended by everyone in her office, so it wasn’t you know, any secret. He said, if you want a consultant, I can get you the best in the country. And so Tina took him up on that offer, and that’s how she got in touch with Mr. Hayes, who then demanded that if he was going to observe this wipe process, that his identity be concealed. And that’s why it was concealed. But that didn’t violate any process rules of the Secretary of State or any state law. So if you make a misrepresentation to somebody, a sort of a white lie kind of a thing, and you have a higher purpose, that’s what the law allows. Her purpose was to preserve the records and to have a qualified observer see what happened during the wipe. Tina was not a computer expert. She needed somebody who was qualified to observe the wipe, and she got him. So because she was doing that as part of her duties as elected county clerk to preserve records and to investigate any destruction of those records, her actions were protected by the supremacy clause of the U.S. Constitution, which is Another major federal constitutional issue. If a person obeys federal law and performs their duty under that federal law, they cannot be prosecuted in state court. There’s dozens of cases that say that. So we feel that’s going to be a prevailing argument in the Colorado Court of Appeals. And we’re confident that the Court of Appeals is going to be objective and and is going to do the right thing in this case because in an earlier appeal, Tina won in the Court of Appeals. The DA up there got her convicted of contempt of court because the whole case was made up by the DA’s office. So Tina was attending a hearing for a co-defendant, Belinda Nicely, and While the hearing was going on, all of a sudden the DA said to the judge, Your Honor, I need to call to your attention that Tina Peters appears to be recording on her iPad. So the judge said, Ms. Peters, are you recording? And she said no. So the next day, the district attorney got a warrant to seize Tina Tina Peters iPad. They seized it. They kept it for 15 months. They charged her with contempt of court because they said she had not only recorded in court, but then had lied to the judge. That was the basis of the contempt. They never examined the iPad to see if there was actually a recording on it. So at the trial of the contempt citation, which, by the way, was not to a jury, but to a judge, The defense lawyer asked the judge, hey, would you have the investigator for the DA’s office? I’d like you to order him to bring that iPad into court so that you can see, Your Honor, if there’s a recording on the iPad. The judge said, no, I won’t do that. Then he found Tina guilty of contempt. Then, after several months, they gave Tina the iPad back. They gave it to her lawyer. They had it examined by experts. There was no recording on that iPad. So the whole case was made up. And the Court of Appeals reversed that contempt conviction. It was dismissed. That contempt conviction was used as a sentencing enhancer at Tina’s sentencing hearing. The judge called her a liar because of that contempt conviction. And he used that as a reason to give her nine years in prison. So we have confidence that the Court of Appeals is going to do the right thing because they did the right thing in the contempt case.

And Peter, one of the narrative coming from… Actually, people on both sides of the aisle and also from Governor Jared Polis is that Tina was convicted by a jury of her peers and that there was a I think the D.A. was Republican. And so they’re trying to make this look bipartisan. And again, to everyday people that are just maybe kind of just taking a look at the case. that makes it look like, I think it tries to make it look like she had a really fair trial. What’s your response to that narrative out there?
SPEAKER 09 :
Well, yes, the people who watched the trial that didn’t know what they were watching or the people that heard about it are being misled to think that this was a fair trial. My understanding of the trial is I wasn’t at the trial itself. John Case was one of the trial lawyers. I think every claim that he defended was actually adjudicated in our favor by the jury. But in any event, you don’t have a fair trial if you’re not allowed to present your defense. And she was not allowed to use her defenses. For instance, the supremacy defense is so important. In other words, when we talk about supremacy, it’s a word most people don’t use from day to day, so maybe it’s not being understood. What we’re talking about is there’s two governments in the United States. Wherever you are, you’re under the laws of the state of Colorado, and you’re also under the laws of the federal government. And if the federal government, the law is that you need to preserve all of the evidence regarding the trial for 22 months. And there’s a state law that says you don’t need to or that you’re not supposed to bring somebody into a room that you’re otherwise allowed to bring somebody into. But this is kind of contrived later. If that’s the case. The Supremacy Clause means that the laws of the United States are supreme over the laws of the state. So if there’s a conflict and a person doesn’t know which way to go, they need to follow the federal law. And that’s what Tina Peters did. She preserved the evidence. But very importantly, we’re talking about a man that came into the room and didn’t use his right name. Most people don’t know that you’re allowed to use any name you want. You know, there was nobody named Mark Twain. That was Samuel Clemens, and he wrote under the name of Mark Twain. As long as you’re not using a name that’s not yours for a fraudulent purpose, there’s nothing illegal about using a false name. In this case, this man was being, you know, he had busted a cartel, and there were people that were gunning for him. So for the protection of his life, He was using a pseudonym. And there was nothing wrong with that, nothing morally wrong with it, nothing ethically wrong with it, and certainly nothing criminally wrong with it. And yet he got it. Oh, yeah, we gave him a fair trial as to whether or not he was guilty of having this person come in and use a false name. Problem is, is the way this Judge Barrett, this Matt Barrett, you know, he was hell-bent. to make sure that there was a conviction. And his rulings were such that that’s the way it occurred. That’s the way it went. That’s why we’re so confident that we’re going to be able to get this thing reversed, because, you know, we don’t have kangaroos in nature in the United States. But this was a kangaroo court. This was this was this was a disgrace. what occurred for Tina Peters.
SPEAKER 05 :
Peter, you may not know a bunch of the stuff that’s happening in crazy Colorado, but John Case, I know that you do. And while we’re talking about this conviction was basically because somebody used a different name. John, as you know here in Colorado with this legislature and this governor regarding our children in school, if they say that they want to have a different name because they are identifying with a different gender, then there’s laws that are being put in place that are saying that teachers and parents have to affirm that name that’s not really their name. I know that’s a little off subject, but yet I’m thinking, this is crazy. She’s in prison for nine years for somebody using a different name, but yet over here in Colorado, we’ve got state law that’s saying to parents and teachers, if you don’t use the name,
SPEAKER 11 :
different name which is not the real name of the child then you know you might the child might be taken away variety of things i just find that a little crazy john case uh that that that is a great point kim i think i’m going to use that when i talk to the court of appeals on january 14th uh yeah it’s so true um There was no harm to the equipment. There was no harm to any person. There was no adverse consequence of what Tina Peters did. And yet she got nine years because she defied the Secretary of State and preserved the records that the Secretary and Dominion voting systems wanted destroyed. Okay, and so there’s going to be a lot of things, Peter Tickton, happening within the next two weeks then on all of this, yes? Whoops, did we lose Peter?

We might have lost Peter, but yes. Oh, there he is. OK. Yeah. Yeah.
SPEAKER 09 :
Yeah. Well, we got the oral argument coming up on the 14th. And John Case is the one that’s going to be leading that argument or doing the argument, you know, because only one lawyer can do that. And and because he’s the best man to do it. And so. And so that’s pretty well what we’re going to be doing then. And we will be preparing for that in advance. At the same time, we have the briefs going in regarding the pardon issue. And at the same time as all of that, we still don’t know whether any other action is going to be taken by the president of the United States. But we do know that he’s very much involved in and at least watching what’s going on in this case, he’s very concerned about it. He knows, you know, he knows what happened here. He knows how wrong it was and how, you know, this weaponization by the state government against the person to be able to basically scare people away from doing the right thing in the future. I mean, think about it. Sixty-two counties Jenna Griswold was responsible for wiping out. And when John says wipe, let me just make it a little bit more clear. This program, the Trusted Build, which is what they call, you know, when you are updating a program where you’re not destroying any data like you do in your cell phone. Periodically, they’re upgrading your apps. They’re upgrading different programs. as well as your computer. I’m sure nobody’s on the original Word program, because it’s always updated. And when it’s upgraded, they don’t destroy all the data that you’ve got. Your documents are still good. But this was one that was designed to not only wipe it out, but then also overwrite on top of the wiped out hard drive, the new program so that what was originally in it can never be seen again. And in 62 counties, Jenna Griswold is guilty of causing this trusted bill to be installed to make sure that the evidence of the election fraud was concealed. And this conspiracy by Jenna Griswold continues to this day. And I am expecting that this is going to be dealt with in a way that Jenna Griswold is not going to be happy.
