Force can obviously be a weapon. You know, I think I’m going to add this in here. because it’s a given, but we should say this. Crime, policy, unpredictable and excessive taxation, fear, coercion, government-induced inflation, the agenda of the World Economic Forum that by 2030 we will own nothing and be happy about it, which is that agenda is being pushed by the globalist elites, the United Nations, but we’re seeing that in public policy as well at the Colorado State Legislature and this governor, but also at the county. and the local level as well. And it can be zoning, it can be national monument designations, it can be a variety of things. Remember, if something’s a good idea, you should not have to force people to do it. On the show, we focus on the issues, not the personalities. We’ll talk about the people involved in the issues, but we really are working very hard to stay out of all of the personal attacks that happen in life, that happens in politics as well. Our word of the day is foment, and it’s spelled F-O-M-E-N-T, and it’s a transitive verb. It could be to arouse or incite trouble, for example, to treat the skin for fomentation, or number three, to apply a warm lotion to or to bathe with a cloth or sponge wet with warm water or medicated lotion. liquid I actually normally use number one on a pretty regular basis these days and that is to arouse or incite trouble not sure if you saw this headline but this is fomenting quite a bit of response from everyday people and this is reported by the Daily Mail that a Florida City Council meeting erupts over developers’ plans to bulldoze a World War II veterans memorial. This is unbelievable. And it says, residents of this coastal Florida city are furious over plans to erase a decades-old park honoring World War II veterans to make way for a sprawling new government campus. Memorial Park is a cherished 17-acre public haven in the affluent suburb of Boca Raton that served as a community cornerstone for decades. The multi-recreational facility was dedicated to World War II veterans back in the late 1940s and has stood as a physical reminder of the city’s origins and its wartime legacy since. However, real estate tycoon David Martin’s development firm Terra and Frisbee Group officially won the bid to tear it all down, clearing the way for a 2.5 billion, 1.5 million square foot mega project. The move has sparked outrage with dozens of residents in Save Boca t-shirts rallying against the project at a fiery city council meeting on Tuesday, where they demanded a public vote on the plans. And this Joe Mahas fumed, I’m confused. Either you guys are completely incompetent, hopelessly tone deaf or truly think we’re the stupid ones. How did we get here? He said, it’s our land and you could seem to care less. We’re seeing this play out. As I mentioned, the World Economic Forum. is focused on more and more government taking more and more control of our land, of our lives, and we can see it right there in Boca Raton. The next thing that I wanted to report is we always look at these headlines in Chicago, particularly over Memorial Day and Labor Day. So this is from Five Chicago, Channel 5 Chicago, at least 54 people were shot, seven fatally, during Labor Day weekend in Chicago. Now, with many of the headlines, this would constitute a mass shooting. But somehow the media and the PBIs don’t seem to care as much. And it says violence prevention groups call for more support from the community as President Donald Trump threatened to deploy National Guard to address the violence. Despite the president’s insistence, Mayor Brandon Johnson has released data showing crime is down year over year. Well, tell that to the 54 people that were shot. It says in one recent incident, a call for a large disturbance near South Cottage Grove Avenue and East 35th Street in Bronzeville ended with at least five people shot early on Monday morning. And a 17-year-old boy was among the victims. Where is the outrage on this? But then the next headline that took my breath away, and that was the top, this is, let’s see, this is from KDVR TV here in Denver. It says, here are the 10 cities with the highest crime rates. And this was just recently published. And Memphis, Tennessee is number one. Detroit is number two. Baltimore, three. Kansas City, Missouri, four. Milwaukee, five. Albuquerque, New Mexico, six. Houston, Texas, seven. Nashville, Tennessee, eight. Denver, Colorado, nine. And Washington, D.C., ten. This is a breakdown in what our elected representatives are supposed to be doing. And that is, first and foremost, is that crime is an assault upon property rights because it takes other people’s stuff, it takes other people’s opportunities. And the Denver vibe is clearly gone. I was out of town at a family reunion this weekend, and people that used to love to come to Denver said, I don’t go to Denver anymore. And this is because of public policy. The radical activists have taken over our state at the legislative level, as well as the governor’s mansion. But we also see this in local government as well. We’ve got a breakdown in our society here in Denver, and that is because of these public policies. And people say that we are voting these people in. We need to assure that, yes, that is the case, because we have, as you know, two lawsuits that have been filed, one through Unite for Freedom, that whole group, and And that is that Colorado is based on proof. Colorado is not meeting the minimum standards as set forth by Congress for our elections. It’s a civil rights issue. The other lawsuit is through the Wisconsin Center for Election Justice and gone through and and looked at specific ballots and a very targeted focus. Fourteen thousand five hundred people voted in the 2022 election. that should not have received ballots, and that is also based on fact. And so the fact that Donald Trump said that he is going to issue an executive order ending mail-in voting, I know that many of us say, can he really do that? But there were lots of things that were done regarding our elections during COVID-19. During the Joe Biden, when he was put into the White House in 2020. And so this is from the center square. And that is today, says President Donald Trump said he’ll be signing an executive order ending mail-in voting and requiring voter ID. Now, we’ve got, first of all, here in Colorado, we’ve got really lax voter ID. Someone can actually show a public service bill, and that can be used as voter ID. Also, I think a check. We have very lax voter ID here, but also here in Colorado, we issue driver’s licenses to people that are here illegally. So even though he says there must be voter ID, we’ve got this other thing percolating over here, which is a problem. But anyway, this article goes on to say voter ID must be part of every single vote. No exceptions. Trump posted on Truth Social Saturday night. I will be doing an executive order to that end. Also, no mail in voting except for those that are very ill and the faraway military use paper ballots only. This is going to be very interesting. Colorado was one of the very first states to institute mail-in voting, and that’s as the state curiously seems to move farther and farther to the radical activist left. So that’s going to be super interesting. Next thing, our quote of the day. I wanted to get to that. And this is from John Jay. And he was an American statesman, diplomat, signatory of the Treaty of Paris and a founding father of the United States. He served from 1789 to 1795 as the first Chief Justice of the United States. And he was the second governor of New York. He directed U.S. foreign policy for much of the 1780s and was an important leader in the Federalist Party. after the ratification of our Constitution. And he said this, he said, no power on earth has a right to take our property from us without our consent. But we are voting away much of our property with higher and higher taxes. And that is why we need to understand what is happening in our legislature and all these different issues on the ballot. And that is why I’d highly recommend that you join us at the Colorado Union of Taxpayers. We took positions on well over 200 pieces of legislation. And it’s by design that I think that there are those that want to make public policy so confusing that it is difficult for people to understand what’s going on. I was talking with a friend of mine yesterday, and she said CUT, the Colorado Union of Taxpayers, is your shortcut to understanding what’s going on. And we will be getting our ratings report out within the next, hopefully about the next 10 days, regarding this last legislative session. And we did take positions on the, I think, everything but one of the pieces of legislation at the special session. And anyway, when you see these folks out there, say thank you to them. Well, thank you, Kim. It’s good to be with you and talk about a whole lot of different things. There’s so many things on the plate right now.
SPEAKER 19 :
There really are. And I would highly recommend that people check out your Lundberg report at KevinLundberg.com, which is published every Saturday. And I wanted to begin with the special session. And I think you pretty well nailed it. You said it was a dumpster fire. And the headlines are different than what… actually happened. I found it interesting that there were headlines that Colorado governor slashed spending. It’s all very political from what I can see. Kevin Lemberg.
SPEAKER 05 :
Oh, my, my, my. Yes, yes. And the reason I characterize it as a dumpster pile is Actually, I ran across an interesting little video that somebody sent out that said, this is the Colorado General Assembly’s special session, and the picture was literally a dumpster on fire floating down a flooded river. It was like total disaster, you know, total disaster. So let’s dig down to the details a little bit here. Ostensibly, the governor called this special session to address two things. One was an overarching somewhere between $800 to $1.something billion shortfall for the current budget. That means they don’t have that much money to fulfill what they decided to spend last spring when they passed the budget. The other was to address a bill that was passed in 2024 dealing with artificial intelligence systems in Colorado. And it’s totally dysfunctional. And it’s so much so that… that the governor knew we needed to fix it. Well, let’s start with that. They didn’t fix it. They couldn’t come to a solution which would be very simple, too, and that is just put off the effective date of this particular law for a couple of years to allow the dust to settle, if you will. But they couldn’t even come up with that much. So they didn’t fix that. Now, when it comes to the budget, I want to say a couple of things. One is they were claiming this shortfall because… They were assuming certain revenue coming in. And I think this is I never saw this directly, but but I’m pretty sure a big part of the problem was when the Trump tax cuts that were temporary were extended and made permanent. And I’ll put that in quotes because Congress can change that permanence any time. But nonetheless, they were due to expire next year. in 2026. And I think they had factored in some of their revenue according to that expiration of those temporary tax cuts. And when they were made permanent, that suddenly said, guess what? It’s It’s real. These tax cuts are this way. And the bill that was passed in Congress, H.R. 1, you know, big, beautiful bill. Put some additional tax cuts in place. And so this was their big solution. They. Because Colorado income tax is theoretically based on what your taxable income is at the federal level. But they undid all of the things that actually lowered our taxes for Colorado. So you have to put those back into your taxable amount. And so that’s one thing they did is they essentially raised our taxes for without approval from the people because the policy has been we follow the federal income tax, but they said, oh, no, no, no, we can’t do that when they lower taxes. We’re not going to allow that to occur. Well, I call that a tax increase. Then they piled on new taxes in rather nefarious forms, like they eliminated the vendor fee, which, by the way, in Polis’s first year in office, he bragged that the vendor fee being increased represented a tax decrease for small businesses. Well, why isn’t the tax increase when they take the vendor fee away entirely?
SPEAKER 19 :
Well, and let’s explain that just a little bit. And first of all, money is either this tax money is either if Colorado is saying that they are not receiving this revenue, that revenue is going somewhere. Well, it’s going back to the people, right? Right. With the tax decrease. The other thing is, and I’ve always thought this was so interesting, that our businesses out there, They basically, in a way, they work for the government, but they don’t get a pension. And that is, is they go out, they take risks, they build their business, they have a product that is sold that sales tax is collected on. They have to collect it. The vendor fee was, in a way, a credit to offset their work in collecting that and remitting it.
SPEAKER 05 :
Yeah, the state essentially is hiring the retail businesses to be the tax collector for the state. And that’s what the vendor fee is all about, to handle all this paperwork as the tax collector, essentially. And yeah, they eliminated it entirely. They took it out. And that amounted to, back in 2020… Or 21, I should say. Yeah, 2021. No, no, no, no, no, no. I’ll take this back to 2019 when Polis first became governor. As I say, at the end of his first year, he bragged about doing three things. One, establishing, and this was a letter he sent out to his supporters in like December of 21. He’d been governor for almost a year. And he said, here are the three major things I’ve done. One was to establish full-day kindergarten, which was another big, weird, expensive thing. And then the other was tied to the vendor fee bill that was passed that year, which increased the vendor rate back up to almost what it was set at originally. They had taken it away, the Democrats, about 10 years previous. Anyway, it increased it. for small businesses from 3% to 4.5%. And then it removed the larger businesses from being able to claim all of it. And it was about 70, as I recall, $77 million was the amount of money that we were dealing with. So it was a significant amount of money. Well, anyway, they just wiped it all out. Didn’t claim it was a tax impact at all, a violation of TABOR. Oh, and then here’s another gimmick that they threw in, and that is to sell future tax credits to businesses at a 25% discount. So they’re generating fast cash. You know, this kind of sounds like a loan shark deal to me. They’re generating fast cash by selling tax credits for next year if you give them the money this year, and you can discount it up to 25%. Who would ever trust them that they wouldn’t change that in the future? I don’t believe it. Yeah, well… Who cares? You know, I mean, a lot of businesses are in the back pocket of the government, frankly, and they’re the ones that they specifically name insurance companies and then C-type corporations, which are regular corporations. And they figure they’re going to get $100 million out of this, but it’s going to cost them about $125 million out of next year’s budget. So… You just can’t make this up. Here’s the bottom line. They didn’t cut anything. They did not cut anything in the budget in the general session. They simply raised taxes. And they raised about a, if you figure the most conservative amount of shortfall is a little under $800 million. So let’s say $750 just to be roughly. They raised taxes by about $250 million on the people of Colorado. They left the other $500 million, or you could say much more than that, on the table, punting it to the governor, who then came out with this brilliant idea of cutting about $250 million off of a quarter of a billion dollars off of state expenses by freezing hiring and a few gimmicks like that. which I think are legitimate. You know, okay, he saved it a little bit. But he still left another $250 million that they’re probably going to take out of, get this, the unclaimed property fund, which is not their money. The state of Colorado is a trustee for this money that belongs to the people that hasn’t been claimed. But they regularly raid that. I’ll tell you, if you did this as a trustee, as a fiduciary for a private trust, you would go to prison. But the legislature, they can just take it whenever they want to. And in this case, they are digging into that one. And then they’re going to dig into basically the rainy day fund that they’ve established called the statutory reserve fund. And so it’s all gimmicks. It’s all smoke and mirrors. And it didn’t fix the problem. It didn’t slow down spending one bit. As a matter of fact, they spent an additional $4.4 million to underwrite Planned Parenthood. to keep Planned Parenthood’s abortion mills going. The state, in this desperate situation, and why is that? It’s because Trump said, I’m sorry, federal dollars are not going to pay for abortions. And so he cut off the funding for Planned Parenthood. And the state had to rush in and pour that money back in because they are just so intent on keeping that abortion mill going.

Yeah, it is really unbelievable. We’re going to continue the discussion with former State Senator Kevin Lundberg regarding the special session and other issues that are facing us here in Colorado. And we were discussing the dumpster fire, also known as the special session. that the legislature convened just recently and finished up. And, Kevin, I mentioned regarding Donald Trump, and he is going to issue apparently an executive order saying that he’s going to get rid of mail-in ballots and also requiring valid ID. But here in Colorado, we have some very odd – things that can actually be a valid ID. One of those is a copy, and I’m reading this right from the Secretary of State’s website, copy of a current within the last 60 days of a utility bill, bank statement, government check, paycheck, or other government document that shows the name and address of the elector. And it could be also a valid student ID or Or it could be a copy, I’ve got to get to this, of a, well, I guess it said a government check, and then a valid Medicare or Medicaid card issued by the Center for Medicare and Medicaid Services. It’s gotten very muddy here in Colorado because I think that people that are here illegally could access some of these forms of ID. What do you think?
SPEAKER 05 :
Oh, yeah. Well, and actually, I haven’t checked out the Secretary of State’s website, but I do know what the law said when they passed these bills that authorized this very weak system, that it also goes on to say, and if you don’t have those things, then just give us the last four digits of your Social Security number. And if you don’t have that… then just give us a statement that I am a U.S. citizen or I do live at this address. Really? Yeah. Now, let’s go a little a step further because they also put in place automatic voter registration, which means you don’t have to lift a finger. The way that that law reads is that Any government agency in the state is supposed to give the name and address of anybody who they’ve identified as living in Colorado, who interfaced with them, and they have their address and their age to verify that they’re 18 or older. And then the Secretary of State is supposed to automatically register them to vote, send them a postcard that says you’re registered to vote. And if you can think of any reason why you shouldn’t be registered to vote, please tell us. But if that postcard gets delivered to the address that they have, in other words, it’s not returned, then the next thing that happens, and they don’t hear back from that person, the next thing that happens is a ballot is sent to that address. Uh, and, and so, yeah, it’s, it’s uglier and more loose than anybody. Now I’ll give this one caveat. I don’t think every government agency has been cooperating, but most do. And the only agency, according to the law that was passed, putting automatic voter registration in place, um, the Department of Revenue is supposed to take the additional step of verifying that this person is a U.S. citizen. But no other department is required to do that, and the Secretary of State is not required to do that. So let’s say somebody signs up for Medicaid, of which, you know, like somewhere 20 to 30 percent or more of the population in Colorado is in fact on Medicaid, the population, I’m not saying citizens, I’m just saying people. Okay. So you sign up and then they’re supposed to send all this data to the secretary of state who then automatically votes, registers them to vote. Um, and yeah, Trump’s, um, executive order is, is a very bold step on his part and very necessary because we have an emergency emergency situation where the voter registration rolls and furthermore in Colorado with automatic, um, mail in ballot for anybody on their roles. Um, we don’t know citizens are voting or not. And to require positive ID in order to retain a ballot makes perfect sense. Now, Trump can only order this for federal elections, but that means any time that a member of Congress or the president is on the ballot, that that ballot has to have that qualification. It’ll be very fascinating to see if this holds, because this is going to go through strict court scrutiny, I’m sure. But I hope the courts recognize that we have an emergency problem that needs to be cured, and I believe that this executive order has every bit of credibility. And needs to be followed here in Colorado. And I think the president needs to enforce it. You know, we talk about the deficit for the state budget. Well, wait till federal funds just stop coming entirely because they haven’t done any of this stuff.
SPEAKER 19 :
So, Kevin, our quote of the day was from John Jay. And he said, no power on earth has a right to take our property from us without our consent. And one of the ways to take our property from us is with taxes or fees. And that’s why Tabor, Colorado’s Taxpayers Bill of Rights, is so important because it basically constrained government rights. Ideally. Now, the ink was not even dry when there were those that were on both sides of the aisle. We’re trying to figure out ways around taper. And they’ve been successful in a lot of different ways. And just an FYI, I am going to have Douglas Bruce as our featured guest on Friday. And he is the author. Excellent. of of Tabor. And he’s concerned about a couple of the issues that will be on this particular ballot. But so if in fact we are voting for tax increases, in essence, that is giving government the permission to to take our property via taxes. And of course, Tabor has those constraints. But let’s just think about this, that if in fact the elections are that there are people that should not be voting, they’re here illegally, or if there’s phantom voters because of all of these mail-in ballots, that that affects an election that takes our property, then… That is antithetical to the American idea. The other problem is, is then it also affects elections. So with Unite for Freedom, they did a voter study of the Orange County of 2024 election and found that 20% and what they did was basically a biopsy. They went in and very scientifically did a study on random ballots and found that 20% of the votes in Orange County, California for the 2024 election were either illegal, phantom, or voted by people that should not have received elections. So I asked them, how about let’s do one for Jefferson County? And we raised the funds for that and did a prevalent study for the 2024 election. And you just mentioned social security numbers as the last four of your social security number as a uh… proof to be able to vote they found that six point one percent of the those in this study did not have social security numbers now i ask the question i said i didn’t think that you could have social security numbers on your ballots and they said that is true but what they used is private investigators and different programs that banks and corporations used to verify uh… well their customers and to try to prevent fraud. So it’s a very, I think, noteworthy way that they did that. And so the fact that there’d be 6.1% of the voters that they could not identify them by Social Security numbers is very curious, Kevin.
SPEAKER 05 :
Well, yeah, and I strongly doubt that the Social Security The last four digits are used to verify that that person’s Social Security number really is that number. I don’t know as a fact, but to me, it’s another one of those false assurances. And it’s well known that a lot of people who are in this country illegally end up getting a job by using somebody else’s Social Security number. So, you know, maybe they validate, yeah, there’s a Social Security number out with those last four digits. So apparently this person is there, but that’s such a, you know, it’s just a shallow assurance, really. They cook this up in such a way that you can’t have any confidence that they’re validating anybody as being a citizen. And in today’s environment where we have Such a huge influx of people who we know are here illegally and should not be voting. We should have sure defense against that. And we have none. We have just these, you know, systems that just paper over the problem with, oh, yeah, here’s how we fix it. Well, it doesn’t fix it.
SPEAKER 19 :
Well, and we have to ask two things, and one is why. And number two, people need to understand that not only are we many times voting away our property in these higher and higher tax increases, and I think government has plenty of money. I think it’s time that we say no to these tax increases and that we start to keep more money in our individuals’ pockets. But this also affects congressional seats. And as we know that at this particular point in time, Republicans hold a razor thin majority in Congress. And and if, in fact, you had 20 percent of the voters that were basically invalid in Orange County, California, that starts to change congressional seats significantly. And so what Trump is at least shedding light on to have this conversation is so important. And I congratulate him on that. Kevin, let’s go to break. We have petitions. We have started to distribute them. We are collecting signatures. We have hundreds of people who have stepped up across the state to say, yeah, give me some of those petitions so I can go out and gather signatures for them. We are just getting ramped up and rolling. And actually, I wanted your listeners to know that we’re going to have a special, we’ll call it a launch event this Friday. down in the Centennial area. This is all last-minute, you know, because we’re just hustling every direction to get this stuff rolling because we’ve got, you know, now a limited time to collect. Really, we need a couple hundred thousand signatures on each one of these three initiatives in order to guarantee that we’ll get on the ballot. But we’re hitting it hard, and as I say, this Friday – From 6 to 8, we’ll have a special time where people can come and sign a petition. They can pick up some petitions to distribute. They can see the interest and the excitement that’s around. They can meet the people that are organizing this whole effort. It’s just amazing. Incredible. And Kim, you’ve been a real important part of this. Really appreciate your focusing in on these issues that need to be put before the people of Colorado. The legislatures we’ve already discussed, they’re just out to lunch. They’re just in a dumpster fire. And fortunately in Colorado, we the people have the right to make law independent of the legislature. It’s a long, difficult process, but we can do it. And concerning all this transgender nonsense that’s happening to our kids, we need to do it now. So I can’t give you the location because we’ve got to confirm that, and we’ll do that later today. You know, over the holiday weekend, we couldn’t get the right okays from the right people to actually publish it. But it’s going to be on our website. Shortly, just exactly where, but this Friday in this centennial area, pretty close to I-25, is what we’re targeting for. From 6 to 8, we’re going to have a big gathering of people that are interested in getting behind this effort. So, Kevin, bring your friends.

So important. So a couple of things. Time. Well, tell us the three ballot initiatives. We got about four minutes, the ballot initiatives and then the time frame for getting these petitions done.
SPEAKER 05 :
OK, the way I’d like to characterize it is three words. Protect, prohibit and punish. There are three major issues. One is to protect women in women’s sports. And that’s by not allowing men to be participating, even if they claim they’re a woman. If you’re a biological man, you don’t belong in a women’s sports program, period, in Colorado. And the prohibit is prohibit child mutilating surgeries for sex changes or attempted. You don’t change somebody’s sex. All you do is just mutilate the child for their life. And so we’re saying, no, we’re not going to do that in Colorado. Most states have already done this through their legislature. But here in Colorado, they’re clueless down there at the Capitol. So we’ve got to show them the way. And then the final one is punish. Punish anybody who’s involved in sex trafficking of minors. And that means if you’re a buyer or a seller, you go to prison and you don’t come out. So those are the three initiatives that we’re trying to put on the ballot. And we think we’ve got every prospect of being successful and really changing the conversation in Colorado. A lot of hand-wringing on a part of us conservatives where we just can’t get anything done. Well, guess what? Here’s an opportunity to make a positive change and to make it happen now, not 10 years from now, here in the state of Colorado.
SPEAKER 19 :
Well, it has to happen now because if we wait 10 years, that’s another 10 years of children that are being mutilated, sex trafficked, all this. The time is now. It’s not tomorrow. It’s now. So the petitions are printed. They’re out. What’s the time frame? You need to try to get 200,000 signatures on each of these petitions. How long do we have?
SPEAKER 05 :
Technically, you have 180 days to get it back to the secretary of state. But that clock started ticking when we got the final approval about 10 days ago. So we’re you know, the clock is already ticking. We’re really targeting between now and Thanksgiving for the big push. And that gives us a little space because we’ve got, you know, about the end of January or so is when we’ve got to get everything back in and bundled up and shipped off. But what with Thanksgiving and Christmas, the reality is between now and Thanksgiving is the big push. And we think we’ve got the critical mass to do this, but that’s assuming that people really step up and make it happen. Because if you’re going to sit back and say, oh, I’m glad somebody’s doing this, well, if you don’t, It just might not happen. So please, protectkidscolorado.org. Go there. You can sign up. You can find out more later today about this special event on Friday, which I am anxiously awaiting to give you all the details. But anybody on my newsletter mailing list, I’m going to send that out just as soon as we get that information buttoned up.

And what we’re seeing is these radical activist policies being pushed by the Democrat Party. And I always think it’s important that we note that this Democrat Party is not the Democrat Party of JFK or your grandpa or your grandma. Democrat Party is fomenting unrest and division. And that is both those things are opposite to the American idea of being united and order. And so your challenge is to use the word foment, F-O-M-E-N-T in a sentence today. And then I went to one of our founding fathers. We’re in September, Constitution Week in Grand Lake. It’s right around the corner. We’ll talk with Mark Auville a little bit later in the show about that. But one of our founders, John Jay, he was born in 1745 and died in 1829. He said this. He said, “‘No power on earth has a right to take our property from us without our consent.'” Now, we talk about TABOR, Colorado’s Taxpayers’ Bill of Rights, on a regular basis and would really encourage you to join the Colorado Union of Taxpayers, CUT, also known as CUT. They are your shortcut to know what is happening out there. Thank you, Patty McKernan, for that little soundbite. But if, in fact, in these elections we are voting for higher and higher taxes and But if, in fact, as we were talking with Kevin Lundberg, that there are things in our elections, particularly here in Colorado, that we’re concerned about, we should make sure that these elections are totally buttoned up, that we totally know that they are free, fair, honest, and transparent. And if that’s not the case, and we are, I have this in air quotes, approving higher and higher elections, taxes, approving again, in air quotes, getting rid of Tabor in Arapahoe County, Jefferson County, which they apparently voted last election cycle. We have to really ask the question, when John Jay says no power on earth has a right to take our property from us without consent, but if we have questions about our elections and we are voting for PBIs, politicians, bureaucrats, and interested parties to take more of our money from us, But we still have questions about the elections. That’s why these lawsuits that you all stepped forward to get funded are so important. And so stay tuned. We’re at a very exciting time in our country. Colorado is at the tip of the spear. And that’s why it’s so important that we have all of these different discussions. The show, as I mentioned, on a regular basis happens. We’re an independent voice on an independent station. We don’t have anybody. from corporate saying what we can and cannot say or which guests we can and cannot have on the show, which is kind of unique in America. And John, I can’t believe it’s September. And that means it’s back to school. Kids are going off to college, to school. And are there any back to school tips that people should be aware of? Absolutely.
SPEAKER 03 :
Yeah, two weeks ago, a mile from my house, there’s an elementary school. So I started to see the chaos and all that that brings with it when everyone’s going back to school. A lot of folks, a lot of kids this morning, it’s their first day. Basic, basic stuff, common sense. I tell folks, you know, expect the unexpected when you’re around a school and little kids. Things will happen, and you’ve got to just stay totally alert. And the key, really, when you’re driving, Anywhere close to a school is just to obey the speed limits and slow down. Slow down and stay alert, the two keys. I’ve been doing what I’m doing for a long time, and I’ve seen lots of situations. Kids dart out between cars. They cross where there’s not a cross guard or a crosswalk. And so, again, it really boils down to two things. Expect the unexpected. and slow down. Stay alert, slow down. Those are the big ones.
SPEAKER 19 :
Well, and I know that parents teach their children at the street corner to stop, look both ways, look for cars. But I saw an example just recently where there was a lane of traffic and a father and and one of the little girls was in one car and the mother and another little girl was in another car and when that little girl saw her father she was so excited she ran across the lane of traffic everybody’s saying stop stop stop but she didn’t listen and you just think about oh my gosh what could happen and that is why not only in school zones but we should always try to be alert and And I know we all get busy. We may get in the car and look at our phone before we get started. We’re thinking about things. And you say it on a consistent basis to focus, focus, focus.
SPEAKER 03 :
Yep, eliminate those distractions. And for a lot of us, I mean, we have a set time. We’ve gotten used to it over the summer. We leave to get to work on time. Well, that’s going to get altered. It’s going to get thrown back a little bit with the volume of school hours Traffic, buses, cars, dropping off kids. And so the other recommendation would be, and this is one I take for myself. It kind of snuck up on me, but leave five, ten minutes earlier so you’re not tempted to do something because you’re in a hurry because you’re getting frustrated with all of the traffic around the school zone. Give yourself some extra time. And parents, always just continuously talk to your kids, remind them, cross, look both ways. You can’t say that stuff often enough.
SPEAKER 19 :
Right. And yeah, it is so important. And one other thing, I was on a walk, John, and these electric scooters, they’re cool. And we’ve got kids in our neighborhood that they love them. It’s almost like their first set of wheels. But I was coming up to an intersection, and there were three kids on motorized scooters, or electric scooters. And one went around and into a lane of traffic without stopping or looking. There was a stop sign there. And this young woman was coming along, and she stopped in time. And he just kept going. And she just stopped. She was kind of visibly shaking. And I looked at her, and I gave her a thumbs up, and she rolled down the window. She said… I could have hit him. The kid was obviously in the wrong. But even if that’s the case, it changes your life. And so the fact that I felt God was watching over that whole situation. But I think parents need to really have a conversation with their kids about these electric scooters.
SPEAKER 03 :
I would not let my kids, if they were that age, ride those electric scooters. I mean, I see it with adults all the time. Kids… Just don’t exercise the best judgment as a whole. Don’t have helmets on. Don’t obey the traffic laws. They’re a bane. I hate those things. They cause a lot of accidents. And I guess if you’re on the road and you see kids or anyone on one of those, just assume they’re going to do the wrong thing so that you are absolutely ready, and then slow down again. It’s going to help you react. It’s going to help the situation as a whole to be avoided.

And it’s appropriately titled, Bakery on Colorado’s Lookout Mountain, asking, oh, wait, wait, no, that’s not it. Here we go. This is what was at The Federalist, and that is that Colorado zoning tyrants go to war against a Christian-owned French bakery. So set this up for us, Helen.
SPEAKER 20 :
Sure. So this bakery, like you mentioned in your introduction, is run by three hardworking, passionate French immigrants. It’s a husband-wife team, Eric and Rachel Dauphine, along with Rachel’s sister, Ruth. And a funny background, Luce used to be a very well-known economist, but she decided to give up her well-paid job of being an economist, and she pursued baking at a renowned pastry school in France. So she’s the bakery chef of the shop. So these three hardworking French immigrants, they decided, They want to share their love for authentic French food and coffee with the Colorado community. So they rent a property in the Lookout Mountain community, only about less than half miles away from the Buffalo Bills property. tomb and a grave and a museum. So it’s a very good location. And they rent a commercial property there. And like all the hardworking immigrants, they sold their original home so they have the money to renovate the building. And because they don’t have anywhere else to live after they sold their home, they ordered two trailer coaches from Canada. And I mean… Kimmy, you and I have been there before. It’s probably the nicest looking trailer coach. This is not, I want you listeners to be aware, this is not anybody imagined a trailer. These are very nice trailer coaches. And the exterior of trailer coaches, they were painted just like the exterior of the bakery. So it’s very, you know, blending with both the property as well as the space. natural environment. Anyway, so the two trainer coaches serve as their part home, part home office, as well as a task kitchen for Ruth. And I also want to set up that it’s Long hours for running a bakery. Basically, Ruth had to get up, you know, open a bakery at one o’clock in the morning to basically start baking. So by the time you, you know, people like me show up at work at eight or nine o’clock, Ruth already has her. eight-hour day most likely and so having close access from their where they live to the bakery is very important so they park the two trailer coaches right behind the bakery but either very aesthetically pleasing way okay so and before they make this arrangement they ask for their landlords they ask for the realtors all of them promise them there’s no problem But then somebody filed a complaint, and the Zoning Department investigated and determined that because that particular property was zoned for commercial only, and they ordered the owners to remove it. have nowhere else to move. And also, if they’re not going to be able to live close to your bakery, they’re going to have to shut down a bakery because its arrangement doesn’t work for them.
SPEAKER 19 :
Well, and the other thing, Helen, as I was doing research on this, one of our listeners alerted me and I checked the Jefferson County website. Lookout Mountain Road is closed until 7 a.m. in the winter. Mm-hmm. So how on earth would someone be able to drive? Well, they can’t get there at 1 a.m. because Ruth needs to start baking beginning at 1 a.m. for that 7 o’clock open. And if she can’t get there, she can’t get there because they’re closing the road. So it seems like Jefferson County, there is a solution to this, and I think it is that Jefferson County could just have a variance for this property that, in fact, they could have these very good-looking trailer coaches on the property. And so I think that’s the solution. What do you think?
SPEAKER 20 :
Well, I agree, and the county’s issue is… And the doctors told me that they did not plan to live in the trailer coaches forever. And their plan is short term anyway. They want to just live in the trailer coaches for two years. And they want to just live in the trailer coaches for two years. And so make sure they get the bakery up and running and make money. And then they will be able to afford to buy a more permanent housing in a nearby community. And Kim, you and I are both small business owners. We know that people used to, I don’t want to sound old, but in the old days, in the good old days, right? People who run in a shop or run in a restaurant, they either live upstairs or live in the back because, you know, those businesses take long hours to operate and they work all the time. So they need to be, they need to have easy, very, very short commute, basically going downstairs or going to the front door, you know, just to keep the business. This is running for a long period of time. And so that has been an arrangement. So, yeah, it’s very puzzling why the counties will not budge on this, just grant them a temporary variance, allow them to operate this for two years to make this work. She put on the other side that this is a lovely, lovely place. They do offer authentic, you know, French food. And also, it’s a community hub. They have this community vibe in the place. And, you know, all the… hikers, as well as local communities love this addition to their community. And Jeffco couldn’t really use the tax dollars. Jeffco right now is facing a $30 million budget cut. So, yeah, it’s really, really puzzling why the county will insist to force this This group of hardworking French immigrants who are running a successful business, a beloved community center for the local community. And why does Jeffco want to shut them down, force them to move because a, you know, very restricted, very rigid enforcement of a zoning law?
SPEAKER 19 :
And, Helen, I drove around that community, and I thought that very close to this particular property, there is residential. So it is really a mixed, at least from what I could see by the naked eye, it really looks like a multi-use community regarding zoning. So the fact that Jefferson County wants to be so rigid on this, I just don’t quite understand. Right.
SPEAKER 20 :
Right. And I think, unfortunately, I can’t explain why the county insists on this, but I think, unfortunately, for the general business environment in Colorado, it has been worsening in Colorado. The business environment in Colorado has been worsening. Colorado last year ranked very poorly in terms of business climate. I mentioned in my article, Colorado ranked about three minus for business friendliness and the f for cost of living and the d plus for the cost of doing business and part of the contributing factor is this colorado’s very exclusionary zoning laws it drives up of you know housing costs and it’s punishing hard-working business like this and And this is just the general environment. We can all see with our naked eyes just to see the business environment in the state is going, you know, going down. And that’s not good for business. And that’s not good for Colorado. And, you know, one of the… The buffers set up a GoFundMe as well as a, you know, on Change.org and set up a petition. And they received overwhelming, you know, community support. And one of the comments really struck me. It was somebody who really loved the bakery. And he just said, you know, it’s regulations, which he refers to the zoning. He said, it’s regulations like this, why we cannot have nice things. And that authentic French bakery with authentic French food as well as coffee and cheese are nice things Coloradans deserve. And they’re provided by hardworking French immigrants who are pursuing American dreams. So why can’t our regulators, why can’t our politicians… zoning laws to make this happen, to make it happen for the community, to make it happen for hardworking Coloradans? Why can’t we have nice things?
SPEAKER 19 :
That is a good question. And people providing nice things, it’s capitalism where people provide a product, nice things, that other people want to trade their hard-earned dollars for. And then that’s a mutually beneficial beneficial relationship, which that is what capitalism is. And I know you know all about that, Helen Raleigh. We are going to go to break. And I think you said the key word, and that was flexibility on working with the DuFours and the Eiffel French Bakery. Helen Raleigh, and we need to be able to have some flexibility in our lives. And the zoning regulations can get very rigid. But what I’m also seeing is that many of these jurisdictions, municipalities and counties are changing regulations. Their zoning, which it’s it’s curious to me that they can change zoning and their comprehensive plans. People thought that that’s what it was going to be, but they’re changing those now. But they can’t give a little variance over here to this French bakery. It doesn’t match up to me, Helen.
SPEAKER 20 :
No, it seems like, you know, these regulations and how they enforce it is just totally not driven by the common sense. The owner shared with me some emails from the zoning department. It basically sounds like somebody who wrote it had never run a private business before or have no clue about the bakery business. So basically the officials told the doctor to say, oh, Why does the Ruth needs to show up at one o’clock to watch the bakery, right? She can just set something in the oven and basically, you know, she can set something in the oven and then, you know, go back her home, like commute, like everybody else. As if Ruth just showed up at 1 o’clock in the morning, you know, to watch, put the bread in the oven and then just sit there whistling, you know, waiting for the bread. This is waiting for the bread to be baked. This is, you know, this official apparently never owned a business or ran a restaurant before. There are so much things to do in the restaurant. Nobody’s just standing there doing nothing, watching the bread to get baked. you know, roasted and they are, you know, things need to be cleaned and dishes need to be washed. And there’s just so many things to do. And that’s something really struck, that email really struck me, just like the question from the community members about why can’t we have nice things? You know, I think we can’t have nice things because we keep electing, you know, officials, you know, who have no common sense, who never ran a business before, had no private industry experiences, and just sit in their offices 9 to 5 or maybe 10 to 3, whatever their hours are, and making up those rules is really difficult. you know, irrelevant or be indifferent to real-life struggles, real-life business struggles. Another statistic I want to mention is Colorado ranks the sixth most regulated state in the U.S., The sixth most regulated state in the U.S. And an impact study from last year shows for every 10% increase in regulations, that will cause the loss of 36,000 jobs and the closure of 9,000 businesses in the state. Those are some really scary numbers. Again, you know, I want to put back to the voters. Why are we keep electing officials, electing politicians who have never worked in private business before, have no business sense, and just keep putting out this propaganda Kind of, you know, ruinous regulations, really killing jobs, killing businesses and causing the business climate in the state to decline and causing Colorado’s, you know, losing opportunities to have nice things.
SPEAKER 19 :
Well, and it’s these regulations stand in the way of the American dream. The Dufours are naturalized citizens. They are from France and they love America. This isn’t very much fun for them right now, though, to have these regulators that are are so rigid and rigid. But yet they’re rigid. But yet over here there you see the changes in zoning laws that that are changing communities. And that’s a whole nother discussion. So many of our listeners sent an email to the electeds, the ones that are responsible to us, we the people. And first and foremost, we all received back the same cookie cutter email. This indicates to me no thought whatsoever. Some staff person responded with that email. And that is not what it’s supposed to be like. We’re supposed to have electeds that respond to us. But we all received back the same email. And the signature was Jefferson County Commissioners. wait a minute, I thought you each are supposed to be individually elected instead of a cookie cutter, carbon, you know, rubber stamp kinds of electeds. And we’re seeing more and more of this. So this little French bakery… is really, I think, pulling off the veil on what is happening in Colorado regarding small business electeds who defer to bureaucrats, and those bureaucrats are unelected and unaccountable. So this is about the French bakery, but it’s also about something bigger, Helen Raleigh.
SPEAKER 20 :
Yes, it’s about our individual freedom to pursue happiness. Right. And again, you have this hardworking immigrants start work. They’re working there at 1 a.m. when most of us is still sound sleeping and try to make their American dream come true and provide a. local community, you know, and not just local community. The visitors from all over the world came to, you know, come to visit the Buffalo Bill Graven Museum, and they stopped by there, and it’s such a nice surprise. You know, that’s why that bakery is called a happy place, a gem in the community. And instead of cherish them, just like you said, instead of cherish them, our, you know, unelected officials as well as elected officials basically are indifferent to They’re indifferent to their struggle. You know, despite all the community support, they’re indifferent to the community support. They’re indifferent from our desire to want the nice things. They’re indifferent for the business, small business struggle. And that is really, you’re right. This is not just about the French bakery. It’s about overall the Colorado’s business environment and the political environment. Do our politicians, do the ruling parties here, you know, the Democrats, do they really care? about what’s going on or or they just care about their own little ideology and everything else are you know are sacrificial to them and the fact that this is bakery despite thousands of emails thousands of supports you know from the communities you know you and i all joined you know to try to contact the county just asking for a temporary again i want to stress The Dolphins just want a temporary, a two-year variance exemption so they can live and make sure this place, this business can be successful. And the counties will not even give them a public hearing. So they will not even want to grant them the opportunity to directly hear them the case. They do not want to grant the community an opportunity to speak to the officials’ bureaucrats directly. They basically just denied all the requests halfway before they even go through the entire reviewing process. And that is really scary. That’s what we’re up against right now.

That is what we are up against. One of our listeners, Jenny, said bureaucrats typically don’t show up to work until 9, and so they can’t think outside the box. But many bureaucrats, when they show up at 9, they would love to have a delicious French croissant available. They don’t realize what goes into having that available. Well, and you guys, you and your team are working diligently. Constitution Week is right around the corner, and it looks like it’s going to be a very special week. So what’s the first thing you want people to know, Mark Auvil?

that this is our 14th annual celebration and education of the U.S. Constitution, that we could be one of only a few cities or towns in the nation celebrating the Constitution, doing a week-long celebration. So we’re really excited about it, and it’s really shaping up to be a great event this year.
SPEAKER 19 :
Well, and it begins on the 15th, and you kick it off with Rob Nadelson, right? And I think it’s a really interesting topic, ancient Rome and the Constitution. We have people that say that they talk about why did Rome fall? Is there correlations between then and now? And so this is going to be a really interesting presentation, I think.
SPEAKER 04 :
I agree. In fact… Rob Nadelson has spoken 12 of the 13 years at Grand Lake U.S. Constitution Week, so we’re really looking forward to his speech, which would be September 15th at 5 p.m. at the Grand Lake Center.
SPEAKER 19 :
And so you’ve got events every day, beginning on Monday. And then the final, in fact, I got a text message from someone that said, Jonathan Turley really is the keynote. This is amazing because he is a nationally known professor, expert on the Constitution, Georgetown professor. And that’s a great get.

We are so blessed and honored to be able to have Professor Jonathan Turley as our keynote, which will be Saturday, September the 20th at approximately 1 p.m. And I love his topic, and it’s based on the book that he had written, Free Speech in an Age of Rage. How important is that topic to have these days?

Well, it really is. And Mark, this whole thing doesn’t happen without you, your work, your volunteers. We actually have the Colorado chapter of the Sons of the American Revolution. They’re going to be doing the presentations, taking us back since it’s been 250 years since the Revolutionary War. They’re going to take us back to the colonial days and the Revolutionary War with demonstrations and loading and firing muskets. And just letting us know how the colonial days were back then.

Well, it’s going to be really fascinating. So how can people get more information about lodging? I would recommend that folks start to think about that now versus as you get closer to Constitution Week.
SPEAKER 04 :
Yeah, I would encourage them to try to book their lodging sooner than later. Things are filling up. They can go to the Grand Lake Chamber of Commerce to get information on lodging. And they can reach out to places like the Gateway Inn. I believe they still have some rooms available. But, yeah, book your accommodation sooner than later. It’s going to be a great week. It’s a beautiful time of the year up in Grand Lake. It’s going to be splendid. And we’re really looking forward to this year’s event.

Kim, it’s so important for us to get back to teaching civics in America. It seems that the school systems have gotten away from teaching our youth about civics, and it’s so important that we get grounded in our constitutional rights so this way we understand when politicians are running to run for a position, that we know how to vet them against the Constitution, that we understand what our inalienable rights are. They come from natural laws and not from government. So it’s really important that we as Americans understand are educated on these documents so that we can protect those rights going forward. We know how important that is these days.
SPEAKER 19 :
Well, and Mark, I do think that we are at the third founding of our country. We’re in this huge ideological battle.
