And again, the studio line is 303-477-5600. And as you know, we search for truth and clarity by looking at these issues through the lens of freedom versus force, force versus freedom. If something’s a good idea, you should not have to force people to do it. And it’s not compassionate and it’s not altruistic to take other people’s stuff, whether or not it’s their rights, their property, freedom, livelihood, opportunity, childhood, or lives. And force can be obviously a weapon, but it can be policy and unpredictable and excessive taxation. It can be fear, coercion, government-induced inflation, legislation, this agenda of the World Economic Forum and globalist elites. And what that agenda is, it’s really the agenda of what the focus is in communism, and that is that people will not own any property. and in communism, and we’re going through the Communist Manifesto with our young guns, Producer Joe and Producer Luke, and ultimately communism is about the abolition of private property, where everybody would be renting. So when you take a look and you see these industrial apartment buildings, That looks to me like moving people towards not owning anything. So, of course, the industrial landlord will be making money. People will not be able to create equity because they’re renting and taxes and fees are so high, it’s difficult to save up. for a down payment for a house. And so you can see how all of these things are connected. And that is because of the agenda of the World Economic Forum Globalist Leads. And then they are playing this out at the United Nations. We see it with federal bureaucracies, Colorado State Legislature, this governor, but we also see it at the county, local, school district, and special district levels. When you drive around your town and you see roads that have been put on road diets, which has put in bike lanes and then additional pylons and barriers, that is World Economic Forum trying to, in this case, Reduce your freedom of mobility. Of course, freedom of mobility means that then you could drive to your home in the suburbs. And so you have the mobility on your choices for jobs. And so this is how this is all connected. And remember, if something is a good idea, you should not have to use force to implement it. And this agenda of the World Economic Forum, it’s all force and coercion. Now, on the show, we focus on the issues. And we’ll talk about the people pushing those issues. But we work diligently to stay out of the name calling and the eighth grade girl fighting and all that stuff that happens in politics. And I did want to say thank you to our goal sponsors. It could be given to or marked by elaborate or ostentatious or audacious display or behavior. Number two, richly or brightly colored, resplendent. And number three, of relating to or having wavy lines and flame-like forms characteristic of 15th and 16th century French Gothic architecture. The definition is from the American Heritage Dictionary of the English Language, 5th edition. And I think I’m going to say, I’m going to this audacious display. The flamboyant attitude of those that are empowered down at the Colorado State Legislature regarding this legislation, which is antithetical to, much of it is antithetical to our U.S. Constitution, and it does not have the best interests of everyday people who they are supposed to be representing in This stuff is being pushed by, again, I’m talking about most of the legislation that’s passed because there is a trifecta. The Democrats have the House, the Senate, and the governor’s office. And it’s important to understand that the Democrat Party that is in power here in Colorado, which really is in power throughout the United States, is not the Democrat Party of your grandpa and your grandma or FJFK. These are radical activists that have agendas that are pushing this agenda of the World Economic Forum. And so with that, our quote of the day, though, moving over to that, is from Mark Twain. His given name was Samuel Langhorne Clemens. He was born in 1835, died in 1910, and he was an American writer, humorist, and essayist. He’s been praised as the greatest humorist the United States has produced, with William Faulkner calling him the father of American literature. His novels include The Adventures of Tom Sawyer and its sequel, Adventures of Huckleberry Finn. with the latter often called the Great American Novel. And he said this, he said, To be great, truly great, you have to be the kind of person who makes the others around you great. So again, to be great, truly great, you have to be the kind of person who makes the others around you great. And I think that… I can actually segue that into our next guest. 100 percent. And it was it was fantastic. What was really pretty neat about the whole thing is it was people of all parties. So it was Republicans, Democrats, everything in between. And put the politics aside and we’re all focused on repealing the zoning. And so you had a bunch of people that were passionate about one thing. And that doesn’t happen very often these days.
SPEAKER 04 :
Well, I do think that the big, broad middle of America agrees on many things, but the narrative out there keeps us so divided. So what’s going on now? What’s next? What should people be aware of? I know you’re involved in helping some campaigns. What’s next for all your projects?
SPEAKER 20 :
In Lakewood, we’re a few days from, I say a few days to a week, away from the second phase. And we’re not talking about that yet. We’re working out logistics on that. But if we can pull it off, it’ll be pretty awesome. And one thing that is going on in Lakewood, though, that folks need to know are the wildfire urban interface codes, the WUI codes. And the state implemented WUI codes. And There’s a WUI map that shows your fire risk. And Jefferson County created their own map that goes farther than the state map. And in one of their presentations in December, they said, you know, the incorporated part of Jefferson County can adopt their own map. Well, somebody at Lakewood chose to follow the Jefferson County map and not the state map. And they have put a large portion of Lakewood in a fire zone. and um what that means on the surface is that um you know any new construction automatically falls into that but for existing homes the the way this ordinance is written it’s it’s rather confusing for starters but it would appear that if something happens and you have to replace 25 of your roof let’s say for example a hail storm then you may need to come in compliance with the fire code. And that just doesn’t mean a new roof, but it also means you need to maintain your property to the fire code standards, which means You need to clear vegetation within five feet of your home. So think shrubs, small trees, things like that. And then your large trees have to be 10 feet from your home. And so not only will you need to come into compliance from a building code perspective, but also from a vegetation perspective. And those costs alone can add up rather quickly. So there is a community meeting at the Green Mountain Rec Center this Saturday at 1230. That is the focus because next Monday, city council will be meeting to either pass as is or amend it at that meeting and pass something in its place. So that’s super important if you live in Lakewood on the west side, which is all of Ward 4, parts of Ward 1, and parts of Ward 5. So that’s what that’s what’s going on lately.
SPEAKER 04 :
OK, well, it seems and we’ll have to have a longer conversation about this, but we certainly are concerned about fires. But I also there’s mismanagement. I think of our forest. There’s all kinds of reasons why we can have these fires. But these additional regulations are going to make housing difficult. individual housing more expensive, which makes things less affordable. So we’ll just connect that dot for right now. Let’s move over to radiant painting and lighting. As we are preparing, as people are starting to look at doing their exteriors, maybe they’ve delayed painting and they have, for example, some rotted boards or something like that. First of all, is that common? Does that happen a lot in your business?
SPEAKER 20 :
It actually does happen a lot. Very rarely do we have an exterior where at least one or two boards need to be replaced. Sometimes it’s six, seven, 10 different boards. And it comes down to a variety of factors. Sometimes it’s maintenance. So let’s say, for example, your second floor window trim has, for whatever reason, The paint is worn off. Maybe it was a hailstorm and you didn’t notice it. That’s common because it’s on the second floor. Right. And how often do you look up? And when there is no paint on wood, then it’s exposed to the elements. And if they over time after it gets wet and dries and wet and dry, then it starts rotting. And so that is common on the upper levels, but sometimes it does happen on the lower levels as well. Or maybe the lower boards of the house were buried under snow over the years, and the paint has worn off, and now you’ve got rotted, soddy boards. So when we go out to the estimates, we look at the rotted boards. Obviously, we don’t climb ladders to get to the second floor. But you can kind of tell sometimes if boards need to be replaced up on the second level, if they’re warped, if there’s a gap and it’s obvious that they’re rotten. And we figure that into the estimate. And then, of course, I’ll put a clause in there that if we come across any rotten boards, once we start, we’ll have a conversation with the homeowner before we replace it.

And we are going to talk a little bit about this late breaking bill, House Bill 261430. Ramey Johnson, welcome to the show. Thank you. Good morning, Kim. This is complicated, isn’t it, Ramey?

It is. House Bill 1430 is a 20-page bill that But actually, the history on it goes back to 1953 when the Colorado Highway Users Tax Fund was established at that point. And what that means is that when you buy a gallon of gas, that there is a tax on that gas to pay for the roads. Well, in 2013, the legislature changed it And they started taking about 10% of that money. And now it’s up to 15%, maybe more, to use for what they called EV infrastructure and also light rail, just things that were related to transit, not to the highways. Currently, Coloradoans pay… a little over $0.29 a gallon for gas. But that includes not only your HUTF funds, but also a road usage fee and also a bridge and tunnel impact fee.
SPEAKER 04 :
Right, and that’s the $0.29 tax per gallon, right?
SPEAKER 18 :
Correct. That’s all three of them. Currently, keep in mind that EVs do not buy gasoline. Their cars are heavier due to the batteries, and so they are using the roads actually without paying for their usage, if you really want to know the truth.
SPEAKER 04 :
Right.
SPEAKER 18 :
So in comes the Colorado contractors, and they put in an initiative. They’re getting… Folks are at grocery stores right now getting signatures for Initiative 175. And what this initiative will do, it will just, it’s saying it will take 2% of the state budget to road and repair and maintenance without raising taxes. And how they’re doing that is they’re going to say we want to use all of the HUTF money for maintenance and roads repair. Colorado is the 29th rated highest in the nation as far as our roads go. But all of us know that this has been going on for about 15 years. And the state legislature, if they really had been genuine, and they could have started looking at this a long time ago. So this initiative, 175, shifts all the HUTF to roads, and it’ll bring in about 6 million for the roads. So now they’re getting the petition signed. I believe they’re about 75% there. And in comes our state legislature with a house bill 1430. And what 1430 would do if initiative 175 passes on the ballot in November, then 1430 will become active. It won’t until then. actually is doing it’s disrespecting the will of the colorado voters for one thing but it will decrease your tabor refunds it means our votes are nullifying and it’s 20 pages of a lot of numbers basically just taking us back to the status quo um one of the things that i thought was interesting though It will increase your late registration fee from 25 to $100 a month. The egregious thing about this, Kim, is that this is really a very dangerous precedent that the state legislature is setting with this. In other words, any time if this, if they go through with this, with this 1430, and it looks like they would, anytime people at the ballot pass anything, the state legislature can go in and nullify it, which is really, it’s violating our democratic process. It’s just unbelievably egregious to me. But this bill kind of reflects the legislators that we have representing us right now. They are power hungry. They have all, session long and last year. They have increased regulations across the board. We are losing our freedoms under this legislature. And I can’t say enough sadness that I feel to see our state in the situation it is. They have done everything they can also to chip away at our Second Amendment rights with several bills on guns. I would hope, however, if they actually decide to implement this and if there’s enough signatures and it goes on the ballot and we get the money that we need for our road repair and actually use the HUTF money the way it was intended, I hope that there’d be a lawsuit, frankly. I spoke with Tony Milo yesterday. He is the CEO of the Colorado Contractors, and they are not going to be bullied with this. They are straightforward. They’re going to go ahead and go forward with the initiative. The roads are bad, and they’re determined to see what they can do to at least get our state turned around. I think there’s a couple of something that to me that really jumped out are the people that are against initiative 175 it’s the bell policy institute of course colorado center for law and policy the sierra club and last the colorado education association unbelievable to me so this is we are legislators okay Kim, we’re in real trouble. And Colorado is becoming known nationwide for the kind of legislation that we’re passing and the way that our legislature is behaving.
SPEAKER 04 :
We are a laughingstock. And CUT has taken, Colorado Union of Taxpayers has taken a position on this 1430, which is a no on it. And at the Kim Monson newsroom, we also published a very good analysis of this as well. And the team really delved into it. And after you and I talked last evening about Rami, I went through everything as well. And I’ve got a lot of questions. We totally agree. We’ve got to get our roads taken care of. It’s like third world country kind of roads. I recently had a trip to Kansas and I could not find a pothole in Kansas. And it’s probably because they use the money for highways that they’re supposed to be using it for. So a couple of things. I’m not sure, Ramey, I’m comfortable with an amendment to the Constitution, which is what 175 is. I’m going to have to think about that. I like the intent, but I’m not sure about an amendment to the Constitution. Have you thought about that at all?
SPEAKER 18 :
You know, I have given it thought. And it is a little bit awkward. I agree with you, Kim. But by doing it that way, they are codifying the fact that the legislature cannot continue to take money from different pots that are designed for certain usage and start putting them in other places that they like for alternate transportation. Part of this is EV infrastructure. And they don’t even pay for the roads, and their cars are heavier than a regular gasoline car. Somehow that needs to be addressed. Maybe when you get the fees or something, that you pay a little extra to help with the highways. But the state legislature is kind of creating a situation where… People are going to be reacting and doing it this way. But I understand that it is a little bit awkward.
SPEAKER 04 :
Well, and I did read 1430 and deep within it, they do have a $50 registration fee for an electric vehicle. And so I think that that again, politically, I think that they are trying to address what you just mentioned is these EVs are heavier and they have not been paying for the roads. So I looked at that $50. I looked at it with 29 cents, but or 22 cents, because that’s only they’re only paying for 172 miles. with a $50 fee. So if you wanted to say, I don’t know, what do you think, what an average is that people drive? Probably, I don’t know, let’s say 5,000 miles times 29 cents. Their real fee should be $1,450. So, Rami, I appreciate you delving into this. And we’ve got a lot more to look at this, but… The fact that this was dropped, this House Bill 26-1430, late enough on Friday afternoon that people that were watching didn’t see it. We caught it because we were looking at legislation scheduled for hearing for the next week early on Saturday morning. But it was very sneaky. And whenever you’ve got legislators acting sneaky, we should really be watching them. Rami, your final thought.

My final thought is that I hope that your listeners are listening to all of this when they get to the ballot in November. All of the House is up for reelection. And we’ve got a situation, as you mentioned earlier, that we’ve got a trifecta. Both houses in the governorship are under one party rule. And it is leading really to a tyrannical type of government. where people down there are into power and control over others. They’re not there to serve us. They want us to serve them. And it’s the wrong motivation and we’re in real trouble.

And the appellate court, federal appellate court, said that this was… Well, I’m paraphrasing a harsh sentence. Send it back to the judge that gave that sentence and said, relook at this. And so we wanted to get an update. John Case, first of all, did I set this up correctly?

Pretty much, Kim. Yes. Good morning. And thanks for having me. And good morning to your listeners. So it was the Colorado Court of Appeals who found that. Was illegal and remanded it back to the trial court for. However, she will not be resentenced until all appeals are final. The Court of Appeals affirmed her convictions, and we intend to appeal those convictions further to the Colorado Supreme Court. So until that process is over, she can’t be resentenced. Now, in the meantime, we filed a motion in the trial court to have her released on bond. And as a companion with that, we filed a motion to disqualify Judge Barrett because of his personal animosity and bias toward Tina Peters. So the judge first found that he had no bias and that he was fair. And so he denied that motion. And then he denied Tina bond pending appeal because he found that she was a flight risk. Although she had appeared faithfully for every court appearance for 31 months until we put her in prison. And he found that her appeal was frivolous. Frivolous means it has no basis in law and no basis in fact. Um, and clearly her appeals are not frivolous and clearly she’s not a flight risk. So we intend to appeal that ruling to the Colorado court of appeals also.
SPEAKER 04 :
What’s the timing on all this, John Case?
SPEAKER 09 :
Filing for review of his denial of bond will take place next week. And then that process takes a couple of weeks. And then filing in the Colorado Supreme Court for review of her convictions, that will happen May 22nd or shortly before.
SPEAKER 04 :
Okay. I find this terrible. I’m just going to say this is terrible that this goes back. Why, why would they take the sentencing? If they, if the, and I got that incorrect, it was the Colorado appellate court, right? That if they found the sentencing was wrong, why would they send it back to the same judge that did that? Why would they think they would get a different result?
SPEAKER 09 :
Um, well, we asked the court of appeals to, um, order a new judge and they declined to do that and said, we first had to ask him to recuse himself. So we did that and he refused to recuse himself. So before we go back for resentencing, it’s possible to ask the Colorado Supreme court to, uh, order, uh, judge Barrett to recuse himself and It’s likely that we’re going to do that also, uh, because it’s, it’s obvious it would obviously be unfair for Tina to be resentenced by judge Barrett. So I think what’s helpful is to remind everyone why Tina is there in the first place. Uh, this is what judge Barrett said when he sentenced Tina to eight years and nine months in prison, almost nine years, not quite quote. And this is what makes Mrs. Peters such a danger to our community. It’s the position she has held that has provided her the pulpit from which she can preach these lies, the undermining of our democratic process, the undermining of the belief and confidence in our election systems. Every effort to undermine the integrity of our elections and public’s trust in our institutions has been made by you. You’ve done it from that lecture and proven is for those folks where we send people who are a danger to all of us, whether it be by the pen or the sword or the word of the mouth, close quote, those are judge Barrett’s words, sentencing Tina Peters to prison for almost nine years. So obviously the reason, according to him was because of her criticism of the voting system. And it has turned out. Recently, and there was lots of evidence even at the time, that Tina Peters was telling the truth about our voting system. It is unsafe, unreliable, and it should never have been certified. It is subject to manipulation by foreign actors. The software has 14 back doors by which foreign actors can get into the system and change votes without being detectives. And there’s evidence that this happened in the 2020 election in Mesa County. The records that Tina Peters preserved were analyzed by experts, and they determined that approximately 5,000 ballot images had been manipulated during the 2020 election. And it’s impossible to tell whether that affected the outcome. It was noted that in the vote count, Biden got approximately 5,000 more votes than he was expected to, according to the polling. And Trump got 5,000 left. So the numbers roughly add up there. And every expert who’s looked at the system has concluded that it shouldn’t be used to count votes. Tina has been a consistent advocate, and I agree with her, and I’ve been a consistent advocate. The Republican Party has consistently advocated, go back to what we did for 200 years. Count the votes by hand in the precincts where people vote. With election judges from both parties doing the counting in public under public observation, that’s the way votes are counted in most Western countries. including Israel, France, Germany, Canada, Norway, Sweden. That’s how they count votes, by hand. It’s not a complicated process and it’s easily done. The left loves computer voting systems because once the votes are counted, you have to accept the machine results because nobody knows what the machine did. It just says, here’s the answer. so-and-so won. And nobody knows if that’s correct. Under Colorado law now, no audits are permitted. So it’s impossible to find out if the machine’s counted accurately or not.
SPEAKER 04 :
That’s such a key point. It seems to me it would just be common sense that at the county level that there would be a comparison. You go through and you take a look at the ballots and you make sure that the ballots that were submitted were. I guess they create an image of that, which I find that kind of odd, but they create that image. So you’d want to make sure that those images match up with the actual ballots. And then it seems like then you would want to make sure that that actual count that is uploaded to the Colorado Secretary of State that you know what that number is so that you could then compare that with what goes to the Secretary of State. But my understanding is that comparison from the paper ballot to the image doesn’t occur, and then there is no idea of what that number of those images is, what’s uploaded to the Secretary of State. Is that correct, John?
SPEAKER 09 :
Yes, they do do a post-election comparison. what they call a risk limiting audit. They take a few ballots that are picked by the Secretary of State, and then they run those through the machine, and then they look at those manually. But those are just a very tiny sampling of the total count. And that process can also be manipulated. So there’s no verification that the ballots are actually were actually voted by registered voters. That audit never takes place. So we don’t know who voted each ballot. The ballots are anonymous. Once they’re out of the envelope, you can’t tell who voted. And the signature verification process is completely insecure. It’s done by a machine. And the tolerances on that machine are not set by law. So you can let every ballot envelope through or you can let none of them through. And it’s been proven that when there’s a lot of ballots to count, the courts set a lower tolerance. So more envelopes go through. So there’s less adjudication, less signature verification. uh done by the election judges and the election judges are not trained experts in signature analysis an expert in a in a in a forgery case for example would take several hours to verify one signature these people take between three and five seconds to compare an old signature to the signature on the ballot envelope and then they pass it so The whole process is fraught with mistakes, and the fact that the vote count can be manipulated without being detected is outrageous. We should not have this system. When I first voted in Colorado in 1972, I went to my local precinct, which is at the elementary school. I showed my driver’s license to the election judge, who was one of my neighbors. checked me in, made sure that I was registered, checked me in, gave me a ballot. I took the ballot into a booth. I marked the ballot with my vote. Then I took the ballot out and I put it in the slot in the locked box. And then I was marked as having voted. And then they gave me a I voted sticker to put on my shirt. And then I left. And that night the votes were counted in that same building. The votes were counted by the election judges and they phoned in the results to the Colorado secretary of state. And by 10 PM, everybody knew who had won the election. So, uh, we could do it then we can do it again now, but the computer industry and, uh, the last one. computer vote counting to continue because they can’t lose if the elections are rigged.

Well, Tina was the honoree last Friday night for the Sam Whittemore Award at the Truth and Liberty Awards. celebration in Woodland Park, Colorado at Terrace Bible College. And it was a great event. I was privileged to accept the award for Tina along with her best friend Marcy Hoshiko. And she presented a video with Tina speaking, Tina’s voice speaking from what appeared to be inside the penitentiary. And of course, she’s not allowed to do any recording there or do any broadcasting. But the way it was arranged was her producer, Apollo Pappas, took Tina’s voice from prior speeches and used AI to create a new speech that Tina wrote from inside the prison. And then he added video to it. And it was really wonderful. The audience loved it. And so this is the new thing you can see on TinaPeters.us. Tina’s going to be getting her message out even though she’s in prison with this new technology. So she’s not done by any means. She will continue speaking against using these corrupt machines to run our elections. And even though she’s in prison, they’ve not successfully silenced her. So it’s quite an honor to be a lawyer for somebody who’s this courageous. Her health is not what it once was, but it’s good enough to keep going. And her spirit only gets stronger the harder she is oppressed.
SPEAKER 04 :
Well, she is in my daily prayers, and I would ask all of you to continue to pray for her and for her strength and for her release. And John Case, instead of a judge saying that you can’t say this about the elections, it seems like that we would want to make sure that our elections are free, fair, honest, and transparent. So if what she’s saying is, has no credence, then what’s he worried about? It seems like to me. And so that seems to be the focus to see whether or not what she is saying is true instead of trying to shut down her voice, John.
SPEAKER 09 :
You’re absolutely right, Kim. And what’s happened recently shows that what Tina said is true. In Riverside County, California, 611,000 ballots were cast in a single issue election. The issue was redistricting. And so there was only one issue on every ballot. Each voter got to mark just one spot on the ballot and then cast their ballot. So there were 611,000 ballots, but there were 655,000 votes counted by the machines. So there were 44,000 more votes counted than there were ballots. How is that possible if the machines didn’t miscount the votes? So the sheriff there, who’s also a candidate for governor, seized the ballot and is having them analyzed. And of course, the attorney general of the state of California is trying to prevent him from doing that through court action. There’s plenty of proof that the machines are capable of reading elections, and we should not be using that system to vote because our elections simply are not trustworthy. And this is just naughty all the way around. And it’s put in place to thwart a potential question that’s going to be on the ballot. So it’s there to thwart the people’s voices. And there’s something that’s really wrong with that. No matter where you are on an issue, When you’ve got those that are supposed to be elected representatives, but actually they’re politicians, bureaucrats, and interested parties that are shutting down the people’s voice. They’re giving an illusion that they are representing us, but it’s an illusion. And so this House Bill 1430 was introduced late, late this last Friday. Now, the last day of the legislative session is this Wednesday. So it’s really sneaky to do that at the very last minute. And then I got this from Gammy. She is so good. She’s really a warrior as far as shedding light on and writing and testifying on so many different bills. But she said 1430 is being done 8 a.m. on the House floor with their final reading. So there’s no way to testify. And then they are just ramming this through online. Ultimately, the ultimate, no matter where we are on these issues, to thwart the people’s voices. And there is something really wrong with that. And my fellow Cupboard members, we took a position on this. We were able to catch it, which is great. But when you see these people, please say thank you to them. They’re my fellow Cupboard members. They’re all volunteers. And join us. Support us. It’s only $25 a year. But the board is Steve Dorman, Greg Golianski, Russ Haas, Bill Hamill, Rob Knuth, John Nelson, Wendy Warner, Marty Nielsen, Ramey Johnson, Mary Jansen, Dave Evans, Corey Onizorg, Paula Beard, and Ray Beard. These people have been giving up a big portion of their weekend, every weekend since the legislature convened in January. to take positions on this. So this is house bill 1430. This is cuts position says this bill reflects a direct response to petitioners who are currently securing signatures for a ballot initiative to be placed on the November, 2026 ballot that would fund transportation and fix our third world roads. It is circumventing what voters would likely vote. Yes. On basically broad siding, what voters want safe roads. This bill is for a constitutional amendment, uh, Annual budgetary items do not belong in the Constitution. The bill represents contempt for the residents of Colorado and egregious use of the safety clause. I think that spot, the ballot question is a constitutional amendment issue. And then 1430 is a statutory to try to do a run around the constitutional amendment. And so I may need to just correct that just a little bit on our statement there. But it’s so complicated that it’s difficult to understand what’s going on. So thank you to our fellow Cupboard members for their great work on this. Our word of the day is flamboyant. It’s spelled F-L-A-M-B-O-Y-A-N-T. It could be given to… or marked by elaborate, ostentatious, or audacious display or behavior. I’m going to say that this House Bill 1430 is a flamboyant assault upon the voice of the people. But flamboyant could also be richly or brightly colored resplendent. And number three, it could be of relating to or having wavy lines and flame-like forms of characteristic of 15th and 16th French Gothic architecture. So that’s our word of the day. Our quote of the day is from Mark Twain. He was born in 1835, died in 1910. He was an American writer, humorist, and essayist. He said this, to be great, truly great, you have to be the kind of person who makes the others around you great. And that is Mark Twain. So just think about that in daily life, whether or not it’s family, friends, work. That is our goal is to try to bring out the best in each and every person. And we do that by striving for excellence ourselves and trying to do our very best as well. And somebody that strives for excellence is my good friend, Karen Levine. Good morning, Kim. Lots is happening. One thing, though, the Colorado State Legislature is just about, this legislative session is just about over, which there’s been just a real flamboyancy against the voice of the people, I feel, Karen Levine. But what’s your thoughts about this legislature?
SPEAKER 21 :
I think I would agree. I would agree. I think what is pathetically sad is that the rhetoric is in my industry is about making housing affordable in our state and along the front range. And yet every bill proposed that is associated with housing adds a fee, a tax, a cost. to the consumer and or the homeowner and who is also a consumer. But with that said, I was excited to hear from one of my industry partners that a bill that was passed in 2023 has been redacted or taken away. It has been rolled back and that was going to cause the cost of hot water heaters or water heaters and furnaces and irrigation, all to increase exponentially in cost. And it is on Governor Polis’s desk in hopes of signing that out of law.
SPEAKER 04 :
Is that the clean energy plan? Because is that the one that was making water heaters and furnaces? This is new news to me. I was not aware of that.
SPEAKER 21 :
Yes. So I had shared with you one of my industry partners who had contacted me his state representative, and that state representative had indicated she did not vote for that bill in 2023, and yet she had. And he said, I’m looking at your voting record, and you did. And this consumer constituent sat down with his representative, and she brought together two or three others from the state legislature, and they had a conversation. And he went before the House and testified and went before the Senate. And it got passed in both and is on Polis’ desk to redact that bill, which is a win in consumerism and in housing. Because we were talking about water heaters needing a service call annually at the cost of $1,000 to $1,500. And then you added the cost of the water heater itself. which was somewhere between five grand and sixty five hundred. And that was just the water heater. And that’s just irresponsible.
SPEAKER 04 :
Well, that’s great news. Do you happen to know what that bill number is? I’m trying to look here.
SPEAKER 21 :
And yes, of course, I wrote it down and it is not sitting here in front of me. So it’s probably sitting on my desk. But I will send that over to you because I wrote the note so I could share it. with you, Kim. But since, you know, flamboyant was the word of the day. This was pretty flamboyant, wasn’t it? Pretty flamboyant. I think, too, as listeners and as constituents and as residents of the state of Colorado, we can affect policy and we just need to speak up. We need to let our voices be heard. And in this case, one individual was willing to go out of his comfort zone and make his voice heard for the benefit of us. And it worked out.
SPEAKER 04 :
Well, and he did his homework. When his representative somehow either died didn’t remember or is not telling the truth. It’s one or the other. I don’t know. But he had the receipts. And that’s one of the things about CUT, Colorado Union of Taxpayers, is we’ve got the receipts on these because we’ve been watching all of this legislation. And so that’s really that’s really wonderful. So I don’t see it. I’m trying to look for a late breaking bill. So get me that bill number and we’ll talk about that tomorrow as well. But that’s late breaking and that’s really exciting. Hey, Karen, what about what do you see in the real estate market opportunities? Well, what’s going on?
SPEAKER 21 :
Yes, yes, yes. So we typically see April as one of our strongest months of activity. And it was. But more steady, less of a spike up activity in the real estate market has been more steady, more consistent, more homes, more condominiums, more properties coming on the market, which gives more choice to the buyer. And if you’ve been sitting on the sidelines as a buyer, the opportunity for you is very good. And there is some negotiating power on your side as a buyer. But what’s interesting is the data that came out of the Denver Metro Association of Realtors indicates that pricing is staying very, very steady and that we’re not seeing a big dip in values. So that’s good for sellers, but choice is good for buyers.

Well, it’s good to be with you as well, Brad Miller. So this is quite the journey that you’ve been on, and you are involved with the documentary, and Pam Long is as well, who is a great contributor here at the Kim Monson Show. She’s a former captain in the Army, and she is the military director for Children’s Health Defense. She’s a West Point grad. So this movie that is coming out, it’s actually very powerful. And it’s titled Duty to Disobey, June 30th. Tickets are on sale now. So it’s important that people buy their tickets now. So what should we know about all this, Brad Miller?

Yeah, thank you. And you’re right. So many of your listeners will be familiar with Pam Long. And she has carried a heavy load when it comes to bringing this thing to life. to manifestation, actually getting this film out there. And as you called it, the title is Duty to Disobey. Pam is featured in it. I’ll be featured in it. And several dozen other individuals who lost their careers or were in some other way impacted by the military’s unlawful COVID shot mandate, which went into effect in August of 2021, like you said. So the idea for this film has been in the making for a while now. And some might ask, well, why now? The mandate was implemented several years ago. It was rescinded several years ago. So why is this story still important? Well, the documentary kind of answers that question. It explains why it was unlawful, why it was so negatively impactful. on the troops and then also how that degradation of military readiness affects the nation as a whole. So this is a story that is not just important to service members. It’s not just important to veterans or even families of service members or veterans. This is a story that every single American needs to be aware of. And oh, by the way, we may think that the effects of these shots and the mandates around these shots are over, but they’re not for several reasons. One, Because people are still suffering the effects of the shots, whether that be physical or medical effects, or whether that be the effects of having lost their careers or their jobs or their positions because of these mandates. But also because just once we as Americans lose our freedoms, we see that it is much harder to regain those. And that is something that we are still experiencing right now. So this story is still important. And I have a couple of things that are important for Americans. those of you out there in Colorado who might be interested in this. So the reason that we’re pushing this right now, the viewing for the Duty to Disobey documentary, which will be released on June 30th, and it will be released via a variety of in-person showings across the country at well over 100 locations. And four of those locations are going to be in Colorado. And what we need people to do, though, is 50% of the seats have to be reserved by May 15th, which is next Friday. Absolutely. You know, we really appreciate it. The price is quite modest. Again, it’s $20. Now, we do understand that for a June 30th showing, it’s tricky to have to buy a ticket by May 15th. A lot of people don’t necessarily know what their schedule is going to look like six weeks out. We understand that, but I agree with you wholeheartedly. This is It’s a great investment of your funds. It is something that has affected all Americans. It’s continuing to affect us. So we certainly would really appreciate it. But here’s the other thing. And this is such an important story because these military personnel that refused the jab, and Brad, you were very close to retirement. You gave up a lot to take the stand, yes?
SPEAKER 06 :
That is correct. So I served more than 19 years on active duty. And many of your listeners will know that at 20 years of active service, you qualify for your retirement pension. So I was less than a year away, actually more like eight and a half months away. But I just felt strongly that I was not going to go along with what I knew was unlawful. I was not going to live a lie, as it were. And I was not going to participate in what I saw as fraud, corruption, and the propagation of the deprivation of individuals’ rights. And that was something that I was not going to be a part of. And I’m not unique in that regard. There are so many service members out there whose names people are not familiar with, and they were just as courageous in their stand. And going and viewing this film as a way to understand their stories, but also support them, and perhaps most importantly, to ensure that this kind of activity, this kind of unlawful activity, the deprivation of people’s rights, massive infringement on our liberties, that this never happens again.

Brad, you were… A commander, weren’t you, regarding when this mandate came down that the military had to take the jab and you refused not only for yourself, but for your your personnel as well. Do I remember that correctly?
SPEAKER 06 :
Yes. So in the summer of 2021, I was a battalion commander in the 101st Airborne Division at Fort Campbell, Kentucky. And when the mandate went into effect in August of 2021, of course, I, along with everybody else in the military, was mandated to take the shots. But also as a commander, I would have been responsible for ensuring that my subordinates took the shots. And I was uncomfortable with both of those. I personally was not going to take it. I didn’t want anybody else to be mandated to take it. And so when I refused, the way that I saw it was I was not just refusing for myself personally, but also taking a stand against the mandate and the way that it would have impacted my 500 plus soldiers and all of the other troops across the military as well.
SPEAKER 04 :
So, you know what, I have to ask you a question. 101st Airborne, that is Army, right? And I ask that because when I went back to Normandy in 2016, Guy Whitten was with 101st Airborne, jumped in behind enemy lines on D-Day. And then the Army Air Corps then became the Air Force, but 101st Airborne is still Army, right? I know that’s a really, people are probably rolling their eyes as I’m asking that question, but this is a total civilian question.
SPEAKER 06 :
Yes, the 101st Airborne Division is a division within the Army. It has a long storied legacy. It’s an extremely historic division. It has a legacy which does date back to World War II, like you mentioned. Some of the most important battles of World War II, the 101st Airborne Division, was involved and heavily involved. So yes, you’re right. And in fact, if people are familiar with films such as Saving Private Ryan, or perhaps the series Band of Brothers. Yes, the 101st Airborne Division is featured prominently in those, particularly in Band of Brothers. And so that’s why for me, it was an honor to be able to serve as a battalion commander in the 101st Airborne Division. I was serving as a battalion commander in the exact battalion that I had hoped to be able to command. It was my first choice of all the battalions in the army that I wanted to command. And so it was an honor for me, but at the same time, that’s why it was also such a slap in the face when I had to basically permit myself to be relieved of command because of my refusal to go along with these unlawful orders, which is why this story is so important and why it’s important for all Americans and why we re and it’s important because we have to realize how our rights are infused with liberties and then also that relationship between truth and freedom. Freedom can’t exist without truth. And what we saw over the last couple of years, particularly with all of the madness around the COVID shots, just COVID in general, mandates, et cetera, is there were a lot of things that were being told and a lot of narratives that were not necessarily true. And so we as Americans, something we have to have deep within our hearts is this understanding of the relationship between truth and freedom. And that’s why I would encourage everybody out there, all of your listeners, to go to dutytodisobeyfilm.com, see if there is a location near to them where they can go and watch the in-person viewing on June 30th. Yeah, who’s part of which service, et cetera. So don’t worry about it. There are probably listeners out there that are glad you asked it.
SPEAKER 04 :
I know, but I should know this because I have interviewed a whole bunch of veterans and I should know the answer to that. So I’m trying to give myself a little bit of a disclaimer because it was a dumb question for me to ask, but probably did help some people. Okay, Brad Miller, we had seen, for example, Colorado Representative Jason Crow, who is a congressman. And he and some others, this was several months ago, had been telegraphing to the military that they did not need to follow unlawful orders. And this makes this murky, I think, because they were trying to undermine the president, right? Here, the duty to disobey is something constitutional. But the people that might just be watching this, how do you differentiate between what Jason Crow and the senator from Arizona and some of these others were doing there to duty to disobey? What do you say to that?
SPEAKER 06 :
Yeah, it’s a great question. And there’s a reason why the documentary is called Duty to Disobey. And it is meant to be kind of an eye-catching title. I wouldn’t necessarily say it’s exceptionally provocative, but it is meant to elicit the question, well, duty to disobey what? So the military, of course, as everyone understands, even civilians, the military is an institution that is founded on good order and discipline, which means It is an orders-based institution. Orders are given. Orders are followed. And yes, you must follow orders, even orders you do not like, even orders that may put you at risk, even orders that you think are unsound. Now, if you receive an order that you think is unsound or an order that you disagree with, assuming that conditions permit time and other conditions, yes, you may be able to approach the authority or the commander that issued that order and and explain why you disagree or why you think it’s unsound, right? Now, you may be told, hey, there are things you don’t understand here about why this order was given. Maybe there’s something that you misunderstood. Or you may just be told, hey, listen, I just need you to follow this order. And that’s what we call the saluting point, where you say, okay, I have made known my disagreements with this potential order, but because it is lawful, and it was given to me by someone who has the authority to issue that order, I’m just going to salute and carry out that order. Now, everything I just said is assuming the orders are lawful. There is a massive caveat to all of that when we are talking about unlawful orders. And that’s where the title of the documentary comes into play. So the military actually does a very good job of teaching even its most junior service members that they have a duty to disobey unlawful orders. So it’s not just that you don’t have to order them. It’s that you actually have a duty obligation to disobey that order. So what makes an order unlawful? Well, it could be that it violates some principle of the Constitution. Of course, the Constitution is the supreme law of the land. It could be that it violates some other law, but the military as an orders-based institution is also an institution grounded in law. in which individuals take an oath to support and defend the Constitution of the United States, but also even the legal code that governs the military, the Uniform Code of Military Justice, the UCMJ, well, that also is law. It’s statutory law. It’s found within the U.S. Code. So as much as we say that the military is an orders-based institution, it is also, in every sense of the word, a law-based institution and orders cannot contravene law. And in the event that they do, then an individual is duty bound to disobey an order that goes against the law. And this takes me back to my initial point that I made, which is the COVID shop mandate was unequivocally unlawful. It was totally unlawful. There’s no way around that. And in fact, the new Pentagon leadership, to include Secretary Hegseth and others, have admitted as such. There was a video that was put out by Secretary Hegseth last spring. It was in April. It was followed up by a memorandum. And in that video and in the later memorandum in writing, the Pentagon admitted that the COVID shot mandate as implemented in August 2021 was unlawful.
SPEAKER 04 :
What does that mean for all of you who did disobey?
SPEAKER 06 :
Now, that’s a great question. And and And the documentary does, part of the story about this mandate and its aftermath is, okay, well, are there any attempts that are ongoing at restitution? And the answer is, this is a little bit of Brad Miller’s opinion here. The answer is yes, there are some efforts towards restitution that are ongoing, but also I would say they are not nearly, they have not gone nearly far enough. So there has been an acknowledgement that the mandate was unlawful. The Pentagon has issued a reinstatement process for individuals who lost their careers to the COVID shot mandate to rejoin the service, put the uniform back on, try and recoup some of the time that they lost, and in some regards, recoup some of the money that they lost. So some of the pay that they would have lost for that break in service that was caused by being separated from service. So there are steps that are being taken. We have not seen any accountability for those who issue these unlawful orders. And I, again, Brad Miller’s opinion here would say that some of the reinstatement process is still lacking. But yes, there have been steps that have been taken that are still ongoing. And there have been service members who have chosen to put the uniform back on, accept reinstatement, and rejoin and resume their careers. I couldn’t tell you off the top of my head how many Troops have done that, but I will tell you that the number is incredibly low. Maybe a little over 100 or so.
SPEAKER 04 :
Okay. This question, so the Iran war is, from a political standpoint, there are those that are saying that it’s unlawful because of, the Congress needs to declare war. And I could see then like, you know, some of these different representatives saying this is an unlawful trying to encourage troops to disobey in that. What do you think about that? Is that an odd question or what do you think about that?
SPEAKER 06 :
No, I think it’s a great question and I’ll answer it. But again, I just want to make very clear that this is My opinion, I’m certainly not speaking for anybody within CHD or even specifically within the military chapter of CHD, but it is a really good question. So just speaking just for myself, there are there are three conditions in which the president can engage in military action. And this is spelled out very explicitly in the War Powers Act, which is also known as the War Powers Resolution. So one, and the easiest to recognize, is when there is a congressional declaration of war, which is where the Constitution places that power. The Constitution places the power within Congress to be able to declare war, whereas the president is the commander-in-chief, but the president cannot declare war. So the first condition outlined by the War Powers Resolution in which the president can engage in military action is when there is a congressional declaration of war. The second is when there is some sort of statutory standard, and that is typically what we call an AUMF, an Authorization of the Use of Military Force. Now, there was one of those that was signed, and this is also a congressional responsibility, but it was signed shortly after the 9-11 attacks. And then there was another one that was signed in 2002 that paved the way for the war in Iraq. Again, whatever people think of that, but there was an AUMF. And then the third condition under which the president could engage in military action, according to the War Powers Resolution, is that there is some sort of emergency, which is defined in the War Powers Resolution as some sort of attack on the United States, on its forces, et cetera. So those are the three conditions under which the president can engage in military action. So then what does that mean? So then what that means is sometimes you’re going to have these discussions as to whether or not those conditions have been met. But here’s what I would encourage all Americans to understand. All Americans need to at least understand that those are the three conditions that are outlined in the War Powers Resolution. And again, there may be debates about whether or not those conditions have been met, but those are the conditions that describe when a president can engage in military actions.

Then we have a number of pastors that are going to be there to do introductions, to do prayers for pastors, churches, family, marriage groups. education and youth and military and for our president and for legislators, for all the pillars in our society, media and art. He is going to be there and he’s going to do, at the end, he’s gonna do an invitation and they will be doing baptisms at the Capitol.
