And that’s why we are doing this show, so that we can reclaim this, our liberty, our responsible exercise of freedom, and reclaim our country and reclaim our state we focus on the issues and we’ll talk about the people pushing those issues but we stay out of the we work diligently to stay out of the personality stuff because the emotion the passion we just don’t make good decisions when we’re over in that area mentally and so that’s what we strive to do i wanted to say thank you to my fellow colorado union of taxpayers board members we had our board meeting last night and we on monday mornings well friday afternoons we take a look at all of the bills that are scheduled for hearing for the next week the team works on analysis of these bills throughout the weekend and then on sunday take a look at where we come down support or oppose or do not rate and then take a position on the opposed or in favor and then get an email out to our members as well as the members of the legislature and the governor with the positions on those particular bills that we have been reviewing. and it’s a great tool for legislators we look at these bills through this lens of how does it affect the taxpayer which happens to be all of us how does it affect tabor colorado’s taxpayers bill of rights and the word on the street is there’s going to be a referendum that will be referred by the legislature to the ballot, probably here in November, to really gut Tabor, which is Colorado’s Taxpayers Bill of Rights. Our word of the day is perverted, and it’s spelled P-E-R-V-E-R-T-E-D, and it could be deviating from what is considered right and correct, or to mark by misinterpretation or distortion. And we have so many things, so many of our foundational principles are being perverted and being used against us. Through this month of February, it is George Washington’s birthday month, as well as Ronald Reagan’s birthday, and Abraham Lincoln’s, but we’re focusing on George Washington for most every day. He was born in 1732, On February 22nd, he died in 1799. He was one of our founding fathers, our first president. He was commander of the Continental Army and led the Patriot Forces to victory in the American Revolutionary War against the British Empire. And he’s commonly known as the father of the nation for his role in bringing about American independence. And I’ve been thinking a lot about immigration and what is happening in these blue cities, where I think that the puppeteers are fomenting this unrest, hoping to get violence, hoping to get clashes, to get that photo op that then is pushed out on social media. And America certainly is a nation of immigrants. But I think this quote by George Washington is, He said, I’d always hoped that this land might become a safe and agreeable asylum to the virtuous and persecuted part of mankind, to whatever nation they might belong. And to bring them in, to assimilate them, to become American. But that virtuous component is, first of all, is to not come here illegally. uh but those that are persecuted um i had as i’ve mentioned to many of you i had been on the board of lutheran family services for many years well for six years i think it was at the beginning of 2000 and this was when we’re really starting to see ngos these non-governmental organizations be paid by through tax dollars to bring these people into our country now They brought people in legally under the refugee resettlement, asylee resettlement, as well as unaccompanied minors. At the time, I hadn’t really thought about it. How is it that we are having unaccompanied minors come into our country? So it took me a while. It’s taken a while for me to connect all these dots. But it was a process. And when I was looking at the budget and realized at that time, I think around $12 million out of a $14 million budget was coming from government grants for refugee resettlement. I started to realize what was happening. But the other dot to connect was, as these people were coming in, staff was being used to get these people onto public assistance. And that’s not the way it was ever supposed to be. And from George Washington’s quote, there’s nothing virtuous about coming into a country and then living off of the taxpayers of that country. and um and one of our our listeners has said as well on this immigration thing i think that we can agree uh yes these people have come in illegally but let’s focus First of all, if people have come to our country to America to hurt us, they’ve got to go. If people have come here and they were criminals in their country or they’re doing criminal acts in our country, they’ve got to go. If people have come into our country to live off of the American taxpayer… They gotta go. Once we’ve cleared that out, then certainly people have come here illegally. We need to address that as well. They need to be assimilated into our country. Doesn’t mean that they don’t appreciate the culture of their country of origin, but if they’re coming here, they need to come here to be American. And so with that, I was reading quite a bit last night regarding this Super Bowl halftime. performance, and I would say that it is a perversion of the American idea. And to have one of America’s premier sporting events, to have the halftime completely in Spanish, with no regard for the audience of the NFL, which is primarily Caucasians. Well, yes, I shouldn’t say that. But it’s primarily English-speaking people, probably, to not even… acknowledge America. This is a perversion. And it’s right in our face what is happening in our country. And we need to have a different halftime. I guess it’s Jay-Z and Beyonce who are… putting together these headliners for the Super Bowl. And one of the articles I read is that there’s not been a Caucasian person headlining the Super Bowl in seven years. And this is really a perversion of the American idea. So that’s why I chose the word perversion or perverted. And there’s some other headlines. This headline here is A Texas Democrat who said that nonwhite should take over the country is now facing widespread backlash, as he should. This is putting people into groups instead of assimilating into this great American idea that all men are created equal with these rights from God of life, liberty, pursuit of happiness. And as Martin Luther King Jr. said, that we would be judged on the content of our character, not on the color of our skin. and so we’ve got a real perversion of the american idea that is going on right now it’s being used against us to try to take down our country and we are in our third founding we’ve got to engage in this battle of ideas that is occurring at this particular point in time i did want to mention our bill of the day and it’s a it’s a good one and it is house bill 1073 limitations on bills introduced by general assembly members the sponsor on this is representative ron weinberg and it says the bill seeks to reduce the number of bills any legislator can intr this is our statement from cut uh to um i’ll start over the bill seeks to reduce the number of bills any legislator can introduce each each session from five bills per year down to three And this is wholly appropriate as our General Assembly has run amok with the last several years, which is a tsunami of legislative meddling. And welcome back to the Kim Monson Show. It is George Washington’s birthday month, February. We’re talking about different things that happened in his life. This is from American Heritage, The Miraculous Care of Providence. And the story here is 12 years after the second battle regarding Fort Duquesne. It was 12 years later. It took place on September 15, 1776. within sight of the hilltop where the New York Public Library now stands. And Washington was trying to hold Manhattan Island, and with it New York City, against a greatly superior British military and naval force. It hoped to seal off the rivers that surrounded Manhattan. However, the Battle of Brooklyn Heights, the first confrontation between the Continental Army and true British power, had been a humiliating defeat. Brooklyn and with it the power to operate on the East River fell into British hands. The now endangered Manhattan shore was flatly inviting and too extensive to be held in force. Washington’s strategy was to line the riverfront with troops and trenches just strong enough to delay an invasion until powerful reserves could be brought to bear. Saving New York City depended on preventing the British from establishing a beachhead. After a terrifying naval barrage, the British landed at Kipps Bay, which was an indentation between the present 32nd and 38th Streets that penetrated almost to 2nd Avenue. The raw militia who were stationed there were too frightened by the banging of the naval guns to make a stand. Arriving at a gallop, Washington, to his surprise and mortification, found himself surrounded with fleeing men. then to his relief he saw reserves coming up two brigades marching in good order but when a small british force appeared over the crest of the slope the reserves took one look jettisoned their guns and ran washington threw his hat on the ground and cried out are these the men with whom i am to defend america and good God have I got such troops as these. By now he was alone, he saw some 50 of the enemy only about 80 yards away and advancing at a run. He stared at them blankly. The enemy was preparing to fire when some of Washington’s aides appeared, grabbed his horse’s bridle, and pulled him back. According to General Nathaniel Green, Washington was so vexed at the infamous conduct of his troops that he sought death rather than life. But death was otherwise engaged. And so that is the story of Washington that we shared today. And I love going back to many of the stories of our founding because it wasn’t easy back then. And what you and your team are doing with Protect Kids Colorado is not easy, but it’s very exciting. So give us an update.

Yeah, well, you know, as you were reading that story about Washington’s not one of the finer moments with his army, it caused me to think of some of the moments we’ve had with Protect Kids Colorado in our effort to get things done. Not that anybody abandoned me. I don’t mean that at all. It just seemed like a daunting task when we launched into this. We have… just a few days left that we can actually collect signatures. And most of the work right now is actually collecting the actual petitions so that we can prepare them to present them to the secretary of state. And, um, uh, it’s, it’s a touch and go, um, you know, I mean, we’re, we’re right on the edge, but, uh, I’m very much encouraged by so many things that we’re seeing at this point. For example, we’re, we’re, We’re pulling it all together through a software system, and we called up the numbers yesterday, and we’ve got maybe two-thirds of everything entered at this point, and we have over 2,000 circulators listed in that first biggest batch of things. That’s a number a lot bigger than I expected. um and it you know we we need just a little under 125 000 uh valid signatures but that means you have to overshoot it because you’ll get some invalid ones and uh i’m i’m encouraged very encouraged but i’m still just working hard where we are pulling everything together as quickly as we can. So good news, but not assurances that it’s in the bag, just that we’re on track.

So I went out to Holyoke for the Phillips County Republican Lincoln Day dinner. It was actually a really great lunch. And they had a number of the gubernatorial candidates as well as other candidates and, of course, elected representatives. But I actually, Yvonne Paez, who is… coordinating all of the petitions, and Jill Glazer, who is a notary, and I didn’t realize this, Kevin, but I thought it was great. So Jill went with us, so we had a notary, but the two of them were working on their phones on the drive out and on the drive back. They were very successful out at Phillips County as well as gathering signatures. But I thought this was so interesting and creative, it hadn’t even crossed my mind that as Jill was, they were preparing all of this, she went and got her notary. There were a number of volunteers that went out and became notaries so that they could be available to notarize these petitions. And I said to both Yvonne and Jill, I said, that hadn’t even crossed my mind. That is so creative. So it is amazing what you and your team have been doing here.

Well, that was part of the strategy that we put together this year, as we do, that one of the choke points is getting things notarized. Colorado is rather difficult to work with the citizen initiatives. Most states don’t require that step, which is a huge project, especially for the people who work really hard at this, and maybe they’ve got a couple of dozen people petition forms that they need notarized all at once. Well, you just can’t march into your local bank and expect them to do that very quickly for you. And so we knew that that was a part of the deal is you’ve got to get people lined up to be notaries. And it’s, you know, it’s a benefit. Now they’ve got that skill and that certification under their belt and they can go do that for others. And they’ve, you know, they’re volunteering for PKC, but we’ve given them a tool that they can use in their, you know, in their professional world, too.

Well, and these particular bills, and people can go to protectkidscolorado.org to get more information. Now, and we’re going to have Megan Burke on here in a moment as well, but you’re still raising money as well, right? So if people can throw some bucks your way, that would be super helpful.

Well, yeah, we’re getting down to the edge on that one as well, of course. But yes, that was one of the issues several of the board members met last night via Zoom, you know, kind of check signals on it. And we were adding things up and saying, OK, well, it’s pretty much today that we can. We’ve been supplementing with some paid signatures. but very few because it’s very expensive. But we knew we needed that extra cushion. I’m quite confident we’re raising well over 125,000 signatures on our own. But we need more for that cushion. Because you can expect maybe, you know, actually even the best case scenario is you’re going to lose about 10 to 15 percent of the signatures submitted for one reason or another. They’ll say they’re not valid. Either they literally aren’t valid. registered voters in colorado or or they can’t read the the you know all the details to verify that um so yes we could use a few more dollars but they better hurry because really today is about the last day that we can initiate any any additional help there and buy a you know a few hundred more signatures that can help. But the biggest issue is if you’ve got a petition and you haven’t quite filled that thing up, head out and find some friends. Go knock on a few neighbors’ doors. Do what you can in the next day or two and then get it notarized and get it back to us. Because if it doesn’t get back into our hands by really the end of this week, there’s not a whole lot we can do with it. So because the following week is when we do have to have it all bundled up and delivered to the Secretary of State’s office. And so, yeah, I’m excited about that. You mentioned, you know, this is legislation. These are bills. In a sense, they’re called initiatives, and they’re put before the people for a final vote, yes or no, in November. But in the legislature right now, there are a lot of other bills, some going the exact opposite direction. However, Representative Scott Bottoms, he took three of his five bills that he’s allocated and said, And he essentially presented what are in these initiatives. And so it’ll be interesting to see how the legislature deals with that. We don’t expect them to really push them through, but we’re going to give them one last shot at doing the right thing before we put it before the people through these initiatives. So I mean, if they were to actually pass these bills and and the governor were to sign them into law, then we wouldn’t need these initiatives. But the raw, cold fact is that this legislature is doing the exact opposite. And this year’s session is proving that again in every respect. Across the board, bad stuff. And what they’re moving forward, what’s actually rushing through the system are kind of the worst bilts. So, you know, there’s a big reason we’re doing this. And that’s it’s not just to exercise our abilities as citizens, but it’s to protect our children from what has been happening down at the state capitol for now far too many years.

Well, absolutely. So we’re going to continue this discussion, this Protect Kids Colorado. It’s three different initiatives and we’ll continue the conversation regarding that and other things that are happening down at the statehouse as well. Well, good to have you, and you have been very involved in Protect Kids Colorado, and we’re getting down to the wire on this, and you said, Kim, there’s a few things that you’d really like to highlight, so I’m like, okay, let’s get you on with Kevin. So what is it that you want people to know, Megan Burke?

So I was a 15-time state champion here in Colorado in track and cross country. And girls sports, obviously protecting kids in all three ballot measures is so important. But I do want to talk to the people out there protecting girls sports because that was my thing and I can speak on that. It brought me so much confidence. Girls sports are so important. And if one girl is not allowed to be on the field because a boy is playing or if one girl’s medal is taken away, Or if one girl is injured on the field because a boy is playing in their sport and injures them. That is too many. I have two daughters. I am their coach in soccer. And this is happening at every level. My six-year-old daughter is having to deal with this here in Colorado. So this is not something that, oh, this is never going to happen. It happens every weekend. So we need to step up as adults in the room and protect our girls and protect our girls’ sports. if we don’t we will have a generation of girls with no confidence because we are telling them don’t speak up don’t say anything when really we should be saying no this is not okay and because of our legislation like kevin was saying we have to go out and do things like the ballot initiative to protect our kids and so i just wanted to urge people to get out there and sign these initiatives this weekend we have to like even one signature could matter get out there get to the spots go sign this because we have to protect our kids here we have to protect girls sports it brought me so much good I mean a full scholarship to the University of North Carolina where I met my husband what if there was a boy competing in those track races I might have just quit and then my whole life would have changed so I’m just a big proponent of girls getting out there and playing and by having boys in our sports it’s unsafe it’s and it’s unfair and

So, Kevin, the three initiatives, one of them is that keeping boys out of girls sports. And the initiative is basically we’ll let you I’ll let you explain it, Kevin, that particular initiative.

Well, it’s pretty simple. In the state of Colorado, if this initiative becomes law, men or boys will not be allowed to participate in specific women’s sports programs. And this means more than just on the playing field, but this ought to cure a lot of dilemmas that we have in the locker room as well. You know, men have no place in a woman’s locker room, but these men and boys that claim they are girls and women end up literally in the locker room. Riley Gaines is probably the most well-known athlete who really encountered this as a swimmer. And she’s been very supportive of what we do are doing here in Colorado with this. And, you know, she’s she’s an example of somebody who who had a a national title taken away from her, not because a boy beat her, but because the boy tied with her. down to the hundredth or thousandth of a second in the swimming competition that she was in. And this shows some of the tyranny. And I remember her saying this to us personally and directly. She said when they had that dilemma, that, you know, the way the athletic team Officials handle it. The guy turned to Riley, the official, and said, you know, I’ve got to give it to him, which is just absurd. You know, it’s upside down. It’s nonsense, but that’s the policy. Yesterday, I was on a Zoom call with some of the circulators, and one lady related an incident that she had run across just a day or two earlier. where a lady came up and signed it, and she said, I think it was her grandson or her son, one or the other, excuse me, not son, daughter, daughter was in a track meet and was actually beat by a boy who claimed to be a girl in that just a few days before that. Yes, it does happen, and it does happen here in Colorado. And some girls’ teams have actually forfeited the meet because of the fact that there were boys in the other side. And just, you know, there’s a danger factor there because – Biologically, men are much stronger than women in a lot of respects, and it’s just not fair. It’s just not right. It’s not correct, and we’re correcting this. Let me tell you one other interesting thing on this, because not only are we affecting things in Colorado, but because PKC, Protect Kids Colorado, was running this in Colorado, it inspired a group in Colorado Maine to take that on as well. And they’ve already qualified for their balance. So we’re having effects elsewhere and we’ve already seen some successes, but we need to make it happen here in Colorado. And we’ve got a few days left to finish this up.

Well, and so there are three initiatives, Megan Burke, and the one regarding no boys in girls sports says that girls and girls sports, boys and boys sports, and then co-ed works as well. But it’s very clear on that, right, Megan?

Yes, it’s very clear. The bill is very clear. And nowadays you have to, for some reason, you have to state out what a boy means and what a girl means. This should be obvious, right? But yes. And I want to make the fact that Kevin, what Kevin said about the locker room, even if you have your kid in a private school here, you’re going to be competing against other schools. And the way that the legislation is now is that boys can be In girls’ locker room. And I will say, I believe Paula Scanlon, who swam at the University of Pennsylvania with Will Thomas, was one of the best speakers I’ve ever heard on this. She had to change 18 times a week with a fully intact male who was 6’4″. And you’re putting on tight swimsuits every day on and off. That is not okay. And that’s what we’re allowing to happen here with our girls, not only on the playing field, which for me, I’m a very competitive person. Obviously, men jump 25% higher. They’re around 30% stronger. They punch like 162% harder, all those things. And we know it’s unfair. That’s obvious. That’s follow the science, right? It’s also unfair. completely insane to have men and boys in our girls locker room and we have to protect them from this because this is something that they will carry their whole lives there’s been girls who have been physically sick over it have quit the sport because it’s not right and that’s why we have to sign these in to like the onto the ballot because if we don’t the legislation here will continue to push things to make it okay just like they did they’re allowing east high school to have A boys bathroom on the second floor and an all-gender. No space for the girls.

And I remember generations, a generation ago, girls were told you can be anything, you can do anything that you want to do, which is, you know, I love the fact that we encourage our girls to be the best that they can be. And now this is just canceling girls, Megan Burke.

it’s completely canceling girls. And I would want to talk to the moms out there because I think a lot of them have this empathy, like, Oh, well, like where are, where is this boy who identify as a girl going to play? Well, they can play in their rightful category or they can play on a co-ed team. It’s not on the girls team. I think that they think, Oh, I’m being inclusive. No, you’re actually being exclusive because you’re taking a spot from a girl that’s not inclusive to girls within their own category. That’s, And so I think women out there need to open their minds a little bit and think, wow, this is really not fair for girls. This is really not fair for a girl where there’s, you know, eight spots on the track like me and eight girls are going to make it to state. And if there’s a boy out there, that means that one girl has to sit on the sidelines. And this has happened throughout the country. And I’m sure it’s happened here in Colorado as well. Because like I said, I get a text message every week from a parent that my JV soccer team, there’s a boy on the team and this U9 softball. I’ve seen it with my own eyes. I’ve had at least four games where my girls have had to compete against boys. And like Kevin said, girls are starting to say, oh, I’m going to stand down to stand up. But, you know, that’s not really fair either. The girl doesn’t get to compete. We need adults in the room to stand up and say no. This is not right. And that’s why we started Athletes for Action. So we can give these girls some support, knowledge. And we have a curriculum to teach them how to speak on it, to teach them what to say and how to stand up for themselves and give them a community. Because nowadays, when you come out on these things, just like the poor volunteers at Protect Kids have been bullied and people have been, you know, yelling at them why they’re just trying to sit there and protect kids. So you know that we’re the good side of the other side is, literally bullying us while we’re trying to get signatures to protect our Colorado kids.

So if a girls team, a girls volleyball team is traveling to another school, no boys will be able to go into their locker room while they’re changing and getting ready. Just like Title IX is supposed to be. So girls locker room are for girls. And in the bill it says born female. We have to write that. If you’re born a female, you can stay in the girl’s locker. Obvious things, but you have to be very careful with your words. And it really is important that all of us who are behind these measures and these bills continue to speak language in the truth. So a boy, a male, or a boy who is identifying as a girl, because some of the language can get a little confusing. And the bill is very clear.

Yes. Well, you know, it’s… Yeah, it sounds absurd, but it is true that the logic has been so much turned on its head that right has become wrong and black has become white. And we’re just saying, you know, let’s clear the deck and get back to some basic raw facts, one of which is that you have men and you have women. And And these are not interchangeable by somebody’s whim or even some surgeon’s knife. You don’t change these things. You know, you almost side yourself in trying to explain all of this. But people understand this very clearly. And this is one of the things that needs to be pointed out. The people of Colorado know better. And we are finding that out. Yeah, we get some bullying and other things when we’re out there in the general public. But that’s the vast minority. The majority of people are like, yeah, sign me up because this is important stuff that needs to be said. How in the world the legislature has been drug down the opposite direction is just mind-boggling. But this points out the truth. It’s simple, straightforward truth.

And Megan Burke, I was going through headlines early this morning and was very disappointed. This is from The Daily Caller that said Republican New Hampshire Governor Kelly, I out I owed, I think, vetoed a GOP backed bathroom bill Friday, rejecting legislation that would have let schools, prisons and businesses bar transgender people from restrooms, locker rooms and other sex segregated spaces. that don’t match their sex. And she framed the veto as saying that it would be difficult to enforce. I’m very disappointed about this headline, Megan Burke.

I, it’s kind of mind boggling like we’ve been talking about, but we’ve actually had a lot of protect girls sports or protect women go through legislation and not one Democrat ever votes on it. So unfortunately they’ve turned something that should not really be partisan into something super political and, For example, I wrote Michael Bennett before a vote that was going on and they were trying to do a protect sports campaign. And I asked him, please vote, please protect our Colorado girls. And the email back was like, oh, no, this is more important. This is more important. And they’re just dismissing our girls. And I think people really need to look into who they’re voting for locally and what they’re standing for, because it’s not for women and girls. It’s to virtue virtue signal. Say I’m on this side and just forget about our girls. And our kids, as Kevin was saying, and our kids for the other two bills. They care more about what the party is standing beside. And I don’t know why, because this is an 80-20 issue. And that’s the other thing I’m going to say is that, yes, people have lost their mind. But if you can speak to someone in a clear, calm, scientific-based, fact-based way… at a soccer game, at your school, at drop-off and pickup, you can change people’s minds. Just slowly giving them information to just open up, wow, I didn’t think about it that way. I didn’t think about my seven-year-old being in a bathroom with an eighth-grade boy at our school. I never really thought about it that way. So it’s really important that we continue to talk about it. And women, too. I know sometimes you might have someone be like, oh, I’m going to judge you for that. But at the end of the day, like you’re going to judge me for protecting kids. You’re going to judge me to make sure that a sex, someone who’s sex traffic doesn’t stay in jail longer. Come on. You’re going to judge me because I don’t want a boy in my daughter’s locker room. You’re going to judge me because I don’t want to mutilate a child. These are obvious, common sense things that we need to talk about and we need to have the hard conversations because we can slowly change people’s minds.

uh well correct to an extent i mean it’s not like we have a hundred fixed locations uh all at once because this is a grassroots effort i mentioned earlier that we have over 2 000 people that have been carrying petitions and if you’re one of those folks who still has a petition in your hands You’re the ones who are on the front line, and please do what you can to get more signatures and get it back to us in time. If you’re wanting to know, yes, we do have some locations around, and this is kind of that final big push. You know, like 26 states, I believe it is, have already put this law in place. But here in Colorado, it’s the exact opposite. The U.S. Supreme Court has already heard the case on two states. Can they do this? And if they come back and say, yes, you can, that doesn’t change the law in Colorado. That just says that these states can continue with their individual state laws. So here in Colorado, we’ve got to get this done. We’ve got to get it done here. The opportunity is right now. Stay tuned for, you know, in the near future, we’ll give you the final result of what we’ve found. But right now, Megan is absolutely correct, and I really appreciate her coming on and giving her perspective from a mom’s point of view that it needs to happen, and from an athlete herself. You know, she’s right in the middle of it, and she understands it. I’m just really excited and encouraged by people like Megan who are stepping up and making that difference here in this state.

And I chose that because so many of the things that are so good about America are being perverted. But certainly what we’re seeing regarding men and women’s sports, men and women’s spaces, is it’s a perversion. But the word perverted could be deviating from what is considered right and correct, or number two, marked by misinterpretation or distortion. And we are seeing that on a regular basis, that these things that are good about America are being in many ways perverted and used against us. And so your challenge is to use the word perverted, P-E-R-V-E-R-T-E-D, in a sentence today. And it is George Washington’s birthday month, so we’re focusing quite a bit on George Washington. And he said this regarding America. And George Washington was born in 1732, died in 1731. He said, I’d always hoped that this land might become a safe and agreeable asylum to the virtuous and persecuted part of mankind to whatever nation they might belong. And so that keyword is virtuous. That would mean that if you are coming to America to hurt us, you’re out. If you are a criminal in your country of origin or a criminal here, you’re out. If you’ve come here to live off of the American taxpayer through government programs, you’re out. And if you’ve come here through these refugee and asylee programs, But you are defrauding America. You’re out. That’s going to get rid of a whole bunch of the people that came in during the open borders of the Biden-Harris policies. And then we can deal with the balance that are here. But this will make a big dent. And that’s really what I encourage the Trump administration to focus on, which I think they are focusing on that. But that’s where I’d like them to stay on that. Our bill of the day is from Representative Ron Weidenberg. We congratulate him. House Bill 26-1073, Limitations on Bills Introduced by General Assembly Members. It says the bill seeks to reduce, this is our cut commentary, the bill seeks to reduce the number of bills any legislator can introduce each session from five bills per year down to three bills per year. This is wholly appropriate, as our General Assembly has run amok with the last several years and a tsunami of legislative meddling in our lives. Perhaps Representative Weinberg would consider amending his bill to exempt any proposed legislation which repeals a prior law. So we are in favor of that at Colorado Union of Taxpayers. I’d encourage you to go to coloradotaxpayer.org. and at the top click on cut engaged and each week we are putting bills on there that you can have your voices heard we selected five it’ll take you maybe about two minutes to make your voices heard but i really want to encourage you to make your voice heard on house bill 26 1001 which we placed at cut engaged last week and that is this housing developments on qualifying properties this bill would require that any community with 2,000 people or more be able to put affordable, and that’s actually subsidized housing, in neighborhoods where there’s five acres or less, and it would change the fabric of our neighborhoods forever. It also takes away our voices because local government will no longer have control, will no longer be able to We weigh in on that. It puts this process over an administrative process where these bureaucrats are not elected by us. They’re not accountable to us. And then they added on the safety clause so we can not do a referendum on this. So it shuts down our voices. lack of transparency changes the fabric of our communities forever make your voices heard and i am seeing it come in as you are weighing in on these bills i get a notification and a lot of you are weighing in on this house bill 26 1001 if we have a lot of people sending this cut email to it goes to the sponsors as well as you can add in your state senator or your state representative it will make a difference and and And as you know, we are an independent voice and we work with our sponsors who all strive for excellence. But I really think that if we could take a big dent in these people that are trying to, I’ll use our word of the day, pervert the American idea with this illegal immigration, with people that are coming here to hurt us, criminals that are coming here, people that are coming here to live off of the American citizen, the American middle class, and then people that, I have this in air quotes, legally came in with an NGO that have been defrauding America. That’s going to make a big dent, I think, John, in the people that have come here illegally.

Well, it’s important. But let’s talk about your business. What about insurance companies? What should people know?

I was talking with Joe about this a little bit earlier. Who are insurance companies? Well, they’re necessary. We want to have insurance in case something happens or we cause something to happen. It protects us. But I think it’s super important for folks to understand insurance companies are for-profit companies. And so their bottom line motivation is always with regard to any kind of a claim, whether it’s your own insurance carrier or the at-fault driver’s insurance carrier, they want to keep claims down. They want to keep payouts to a minimum. Well, how’s that translate into what I do and what I see all the time? Insurance companies are always looking for a way to to minimize and sometimes they go way over the line in my opinion claims arguing that liability is not clear when when it is clear arguing that someone’s injuries caused from an accident um that was someone else’s fault are not injuries from that accident that they’re pre-existing or they’re from something else that happened when there’s no basis no evidence no justification uh no bucket that can hold water for those propositions And folks don’t necessarily understand how the system is set up. And so when they talk with an insurance adjuster, and I’ll use a motor vehicle collision as an example, for the at-fault driver’s company, that adjuster is looking for any information, any angle that’s going to allow him or her to mitigate or minimize the claim that you represent as an injured victim. And so you got to be so careful because they’ll ask questions that are designed to make you say things that you didn’t want to say that aren’t necessarily, you know, they lead people down paths is what I’m trying to get at. And so it’s so important that folks, when they are involved in any kind of a situation where insurance is going to be a player in the game, that they talk to an experienced, competent, appropriately strategic attorney like the attorneys at Bowes & Law so they can get the information they need on the front end so that they’re properly taken care of by the insurance carrier. Well, and you had something big that just recently happened. You had your 40th citation at the Supreme Court. This is a big deal, Rob Nielsen.

Yes, with all lack of modesty, I have to say it is a big deal. Maybe I should explain this. The kind of the gold ring for constitutional scholars, besides maybe getting published in the Harvard Law Review, which is impossible for a conservative these days. But even more important than that is being relied upon. by a justice of the U.S. Supreme Court in a formal opinion by name. I mean, not just having your brief cited and not just having your arguments parroted, but actually having one of your writings relied upon with your name there in glowing print. And this never happened to me while I was in academia. But after I came back to Colorado in 2013 and started working with the Independence Institute, the Independence Institute took some steps to make it known to the Supreme Court the kind of work I was doing. And so beginning in 2013… beginning with a citation by Justice Thomas in 2013, justices started to actually cite my work. Justice Thomas initially, the Chief Justice, Scalia, Alito, Thomas again, and so forth. So that by 2023, I had been referenced in Supreme Court opinions over the previous decade, and More than, well, let’s say in the top 10 among the 10,000 or so legal scholars in the country. And I was the only one who was not affiliated with a prestige law school like University of Chicago or Harvard or Yale. And so I was up to 2000 and 2003, I was up to 39 of these citations. And I wasn’t really expecting any more because I hadn’t participated in the cases in any way. I didn’t have any articles that seemed relevant to stuff that was before the court. But suddenly, POP, the 40th one, shows up about two weeks ago. And another legal scholar notified of it by email. I had no idea it was coming up, but there it was. Justice Thomas relied on an article I wrote back in 2003 on retroactive laws.

Well, that is remarkable. So exactly what was the citation for this 40th citation?

Well, it was a case involving the issue of whether a particular law was an ex post facto law. Now, as you know, the Constitution bars both states and the federal government from passing ex post facto laws. So somebody had been convicted of a crime. And then the legislature passed Congress, in fact, passed a bill saying that anybody convicted of this kind of crime would have to make restitution to victims. And the defendant said, hey, wait a minute. When I committed this crime and was found guilty of it, this additional penalty didn’t exist. This thing is ex post facto. And so the court had to consider whether it was an ex post facto imposition of a penalty. And the court unanimously said, yes, it was. That at the time he committed the crime, there were certain penalties attached to it. He paid those penalties. You can’t go back and slap him with additional penalties later on. Justice Thomas wrote a concurring opinion in which he decided to kind of lay out the entire history of ex post facto laws. And so my article was relevant to that because it discussed ex post facto laws and discussed…

uh a retroactive laws generally and whether a larger context and so he cited it as kind of for background information okay and that is congratulations that is really thank you that’s really an amazing thing uh we’ve uh i wanted to change gears just a little bit and you had sent over that it might be good to talk about the colorado constitution a bit And Rob, I have not read the Colorado Constitution, and I need to do that. So first of all, how would I do that? Because my understanding is, the first time I asked about it when I was on city council, they said, oh, it’s just huge because of all the stuff that’s been added in. So tell us, how can we read the Colorado Constitution, and what is going on?

Well, the articles I’m doing are on the original Constitution as it was adopted in In 1876, and this is the document’s 150th birthday, and it was a relatively long constitution even at that time. It was remarkable for the number of protections it had for economic and personal liberty, which we can talk about. I am doing a posting right now. If you go to my website, which is natalsonrob.com, it’s got my name reversed, natalsonrob.com, you’ll see that the first section is a section on documents pertaining to the Montana Constitution, which is an area I also work in. But the Montana Constitution was based on the Colorado Constitution. So there is a link there. to the original Colorado Constitution that you can click on and read the original document. The current document, you could probably, it’s been a while since I’ve looked for it, but the Secretary of State would have it. The difficulty is that Postings by agencies like the Secretary of State’s office tend to tend to be had to tend to click on one thing for this article and another thing for the other article. I don’t really know where there’s a place where you can where you can read the entire Colorado Constitution as it is currently written. enforce in one place. I think you’d have to go to the Secretary of State’s website and then click on successive links. There have been over 170 amendments to the Colorado Constitution, and there have been various judicial amendments in which protections that were inserted there for economic rights in particular have been gutted by the courts. And so the current document is nothing like it was in 1876.

There’s something wrong with this picture where we the people cannot easily go to our Constitution and understand what laws are governing our lives, Rob. Is that too naive to say that?

No, I think that the attitude toward the Colorado Constitution today is exactly the attitude that you encountered when you said, you know, where can I get this thing? And somebody said, oh, it’s really long. I think a lot of people don’t take it seriously. And I think one reason for that is it has been amended so many times. Until very recently, it could be amended by a simple majority vote. And it’s been just… flooded with special interest garbage. I mean, all kinds of special accounts, you know, for the benefit of particular interests and revenue streams that are inserted there to make it exempt from the revenue stream, exempt from Tabor. It has just been loaded over with stuff that basically grows government. And Many of these amendments are enormously long. The marijuana amendment, for example, is extremely long because of all its provisions for where the money is going to go and how it’s exempt from Tabor and et cetera, et cetera. It really does need a good housecleaning. I’d like to see the Colorado Constitution return to something like what it was originally, which was one of the most freedom-loving constitutions ever adopted by any state in the union.

If you go to the General Assembly, that is the legislature’s Web site. They’ve got a link to the Colorado Constitution. But it’s not on that website. It’s hosted by the legal research company Lexis and Nexus. And it’s one of these deals where you’ve got to click on every particular section. You just can’t sit and read the whole thing. There’s a statement on the legislative website which says that it was adopted on August 1, 1876. And then it goes on to say it has been amended several times since. Yeah, like 170, 70 some odd times since that time. Okay.

The question is the sanctuary policies seem to be in direct conflict with the the Federal Supremacy Clause in the Constitution. Is that true?
SPEAKER 08 : 88:46
Yes and no. Good legal answer, right? It depends upon what the sanctuary jurisdiction is doing. If what the sanctuary jurisdiction is doing is simply refusing to enforce federal law, that’s probably okay. That is because there have been several decisions by the U.S. Supreme Court that say essentially that the federal government cannot force states, which are sovereignties of themselves, or cities, which are branches of the state, cannot force them to undertake federal mandates. On the other hand, if the sanctuary city is actively obstructing federal law in some way, they’re enabling people to hide or run away, like that judge who had an illegal alien in her courtroom, and when the Fed showed up, she ushered him out the back door. That’s obstruction of justice, and that is absolutely not permissible. Let me just say one other thing about the supremacy clause. Back when conservatives were the ones complaining about federal invasion of state laws, leftists would cite the supremacy clause to say that the conservative arguments were not justified. But here’s the difference. If the Constitution grants a power to the federal government, Within the terms of that grant, federal law is supreme. And that’s the case with immigration. Federal law is supreme because the federal government is given the power to regulate immigration. On the other hand, in areas like health care, education and so forth, where conservatives were complaining about federal meddling, there really is no or very little power to the federal government over those areas. And so the supremacy clause does not apply.

Yes, Kim. Hey, Rob. Hi, Ron. I’ve been watching things on the Supreme Court and how they’re passing laws on the Second Amendment. And then you have these governors and mayors and legislators and all this. They go in there and manipulate the wordage to bypass these laws. And I think there should be some kind of penalty or accountability because they’re basically telling the Supreme Court to F off.

Yeah, you know, this is a tough area because there is a long history. And it’s actually built into the Constitution of local governments and especially state governments pushing back against federal action. And I suppose that slow walking the implementation of a Supreme Court decision is a good example of resisting federal action. So there’s a long history of it. On the other hand, I find the action within an area of a constitutional right reprehensible. I mean, if you’re slow walking something like a federal mandate, you’re trying to avoid the federal government interfering with your local spending programs, that’s one thing. But when you’re interfering with the federal government’s enforcement or the Supreme Court’s enforcement of a basic constitutional right, that cuts pretty close to the edge. So while I’m not going to say that they’re always wrong, it’s always inappropriate for them to do so, if they’re interfering with a constitutional right like the Second Amendment, I think they’ve got a dubious case. I really do. Okay.

What about these administrative warrants that ICE is allegedly using to apprehend illegal immigrants? And so instead of a judicial warrant, it’s an administrative warrant. My understanding, it’s within a framework. But what’s your thoughts about these administrative warrants and their constitutionality? Well, to proceed against

To proceed against someone, the basic standard is whether you’ve got probable cause. I mean, not whether you have a warrant or not. There are numerous cases in which somebody can be arrested where there’s probable cause and there’s no warrant at all. There is no specific procedure for a judicial warrant in some of the cases in which ICE is acting. So they’ve been using administrative warrants, which are warrants issued by an executive branch official. Now, back in 1960, there was a U.S. Supreme Court case which said, pointed out. that aliens in the country, especially aliens who are here illegally, while they have some due process rights, don’t have the same kind of due process rights or extent of due process rights that American citizens have. And the court said it’s perfectly all right if you have to deport an illegal alien. It’s perfectly okay to use an administrative warrant rather than a judicial warrant. For years, the Justice Department told ICE, well, you can use an administrative warrant to go after an illegal alien, but you can’t actually go into a house to get him. The current Justice Department takes a different position and says, yeah, you can go into the house to get him. You can make an excellent argument based on the 1960 decision. that administrative warrants are all that’s necessary to go after any person illegally in this country. However, ICE is being more cautious and is only going after, under administrative warrants, is only going after people who have actually had due process, who have been ordered by a court to leave the country, who are essentially fugitives from justice. You know, you don’t have to get a judicial warrant or perhaps any warrant to go after somebody who is a fugitive from justice. And that’s what these people are.

Well, so as we are hearing this narrative and I’ve been concerned about the federal government just coming in and taking people from their homes. But this seems to clarify that these people that they are looking for have already had a deportation. Yes.

Is that a deportation order against them? They’ve already had full due process. They have the opportunity to present their own case and so forth. And it’s been determined that they don’t have the right to stay in the country and that they should leave by a certain date, but they don’t leave. They instead hide out in Minneapolis, Minnesota or wherever. And so as with any other fugitive from justice, you certainly can use an administrative warrant to go look for them and deport them. You know, I think this is one of these… I’m as concerned for civil liberties and individual liberties as anyone. I mean, it’s a major tenet of my philosophy. But this is a made-up issue. This is basically another effort by the left to create a distraction and to essentially smear law enforcement officials who are just trying to do their job.

And welcome back to the Kim Monson Show. It is George Washington’s birthday month, and we’ve been talking about a lot of things happening regarding our founding and George Washington. And we had talked about this in the first hour, and this was the fourth time that Divine Providence stepped in and basically protected George Washington. And it was regarding when the Colonists were trying to hold Manhattan Island and there was a terrifying naval barrage. And what had happened then is George Washington arrives and his men are running away. And so Washington throws his hat to the ground, cries out, are these the men with whom I am to defend America? He says, good God, have I got such troops as these? And he basically was standing there with about 50 of the enemy coming at him. They were about 80 yards away and he just was frozen. And his aides came to his house. rescue, they grabbed the bridle of his horse and they pulled him back. Thereby his life was spared. And according to General Nathaniel Green, Washington was so vexed at the infamous conduct of his troops that he sought death rather than life. But he was spared and of course went on to win the revolution. But there were dark times during the revolution. And just to think what Washington went through on a regular basis as the odds seem daunting. And sometimes when I look at the barrage coming at us against us and our Constitution, it seems daunting as well. What’s your thoughts on that, Rob Nadelson?

Well, my immediate thought was, you know, there’s a PS to that story, a postscript to that story. And that is that Washington was very frustrated by the poor quality of the troops and And so with the help of Baron von Steuben and others, he developed a training regimen whereby he got him into shape. And within a few years, he took a ragtag bunch of well-intentioned but not very competent freedom fighters and turned them into a first-class continental army. So he not only bravely survived the barrage, so to speak, he also took action based upon that particular lesson.

Well, Rob, as I am watching legislation here at the State House from CUT, as the president of CUT, our Colorado Union of Taxpayers, and all of our volunteers are doing so as well, and then I look at headlines throughout our country, I think that we’re in the third founding of our country. Whether or not this constitutional republic is going to continue on or not, is that too strong of a statement?

I don’t know if it’s too strong a statement. I do know that we have a very large contingent of people in this country who do not share what are traditionally American values. They have very authoritarian, collectivist mindset. They’re willing to engage in violence, many of them. And if one Rasmussen poll is accurate, a large number of them believe that cheating in elections is perfectly legitimate if it causes your side to win. This is a very concerning development. I think it’s largely the fault of the education system. We’ve had two other occasions in our history where in which a large minority of the population rejected fundamental American values. The first was the revolution itself, when we had people who were called Tories, who took the position that the king of England should be the king of America, and we should simply submit, and that we should give up the traditional rights that Englishmen had. Obviously, those people were defeated. They were forced into exile. And then during the Civil War, we had a very large contingent of Americans who rejected the fundamental maximum of American founding that all men are created equal. And once again, they had to be defeated and marginalized in effect. And now, a third time, we’ve got this large minority of people who reject the very foundation of the country. And, you know, ultimately, I’d like to think they will be converted. But in the interim, they’re going to have to be defeated. There’s no other way to do it. By the way, you mentioned your position as head of the Colorado Union of Taxpayers, or CUT. And you probably become quite frustrated when people in government complain about the Taxpayer Bill of Rights or TABOR and claim it’s bankrupting the state and preventing the state from meeting social needs, et cetera, et cetera. One of the joys in studying the original Colorado Constitution has been to learn that the limitations in the Constitution are on taxes and spending were far more severe than anything in Tabor. For example, if I could, there was only one tax, statewide tax, permitted in the Colorado Constitution. And that was the property tax. And it was capped at two mils per dollar of assessed valuation. That means if you have a $400,000 house, the most you could pay is $800 a year and you paid no other taxes whatsoever. There were similar severe restrictions on spending and on debt. And if a local government got into trouble fiscally, there was no bailout from the state. The local taxpayers had to deal with it. You had a whole wide range of protections for property rights and for the protection of governmental integrity and fiscal integrity. So the next time you hear somebody griping about Tabor, you might refer them to the 1876 Colorado Constitution so they can see what real tax limitation looks like.

Well, and taxes are way out of control. This has really become a wealth transfer from everyday hardworking middle class Coloradans.

That’s right. And multiple provisions of the Colorado Constitution were adopted to prevent that. There was a provision, there still is in fact, a provision which says that no appropriation can be used for the benefit of a private person or a private corporation. That’s still in the Constitution, but it was gutted by the courts. So that was one of several provisions that prevented special interest handouts to people. It really is a remarkable document. The Colorado Constitution of 1876 states, And the Montana Constitution of 1889, which largely copied the Colorado Constitution, were really the high-water marks of freedom-oriented Constitution writing in the United States.
