It feels weird to even say it’s January 6th, but it is. Welcome in, January 6th, 2025. There have been some sarcastic columns written by people on the right. Comments like, ah, you know, are you celebrating the anniversary? Since you’ve been obsessed over January 6th, there is an irony. There’s kind of a delicious irony to people having to witness Donald Trump be certified as president by Kamala Harris on January 6th. So for people who have been completely obsessed over the date and how the country almost ended and the world was coming to a complete finale… And they were going to hang Mike Pence and they were going to do this and they were going to do that. And it’s all Trump’s fault, of course, despite urging people to peacefully and patriotically let their voices be heard. That was what he said on that date four years ago. I’m thinking a lot about the people who are still in prison. And I’ve asked Tracy, my producer, to find out. We’re trying to see if we can get Julie Kelly on the show because she does as good a job in covering this as anybody. Nobody really wants to cover it. It’s unpleasant. It’s not easy to cover. You know, I’ve never excused the actions of those who turned violent that day. I also know that people have been rounded up and arrested because they walked through an open door that, in some cases, the video showed Capitol Police were letting them in. They practically escorted them. And then they wound up getting arrested. And I’m painfully aware of a guy who got stabbed the other day in New York City by a man who apparently had been arrested 88 times in New York City for assaulting strangers, largely. Shot a guy, stabbed a guy, 88 times. And that guy never, ever experienced appreciable incarceration before. How’d you like to be stabbed by somebody who had been arrested in your city 88 times? And yet there are people still locked up over January 6th. And it just does not compute to me. Which leads to the question of, I want to ask you, On this Monday, as we, and I know a lot of the country is hunkered down, it’s kind of strange to hear about the wintry conditions all over the place. And here in Florida, it is a balmy 67 degrees. Sorry, I don’t mean to add, I don’t even want to rub it in. I enjoy escaping the cold wintry conditions. I’m going to go to South Carolina. I think I’m going to be in for a real shock to my system later this week because it’s supposed to be really – it’s obviously cold right now. It’s cold in Texas. It might snow in Texas later in the week. So here’s my question from Florida on a Monday. Simple question. Should Trump pardon the January 6th prisoners? And it’s a tough question. Because the president-elect has indicated he’ll look at that on a case-by-case basis. I hope he does. That seems fair to me. That seems reasonable. That seems professional. If some grandma walked into an open door that was held open by a Capitol Police officer and wound up spending, well now, literally years in prison, that’s a problem. That’s a problem. If people are still in prison without having received due process, I mean, how long does it take to prosecute somebody for activities or actions that they may or may not have taken four years ago on the Capitol on January 6th? I mean, seriously, no matter what you think of the people, the Trump supporters who acted, and many non-Trump supporters, let’s add, who acted the way they acted on January 6th, do you think it’s normal? to wait four years before you even prosecute them? I was reading an article this morning. One guy, they just started the process two months ago. So you mean to tell me it’s normal to wait three years and ten months before you begin the official proceedings against you because of your actions that day? Look, these are political prisoners. There’s no other way to describe them. They are political prisoners. And I think it’s absolutely time, once Trump gets into office, that he takes a good, long, hard look at pardoning a whole bunch of them or granting them clemency. But am I too far out on a limb? I want you to tell me that you think it’s normal that it takes over four years to get a trial, to get process, to get to get to to to face your your accuser in court. This is ridiculous. How long do you think these people ought to be behind bars? And how many are there? Tracy can’t find it. The media is not very open about how many people are in prison right now. In fact, since my producer can’t seem to find it, let me turn it over to you. And we can’t find it. Do you know? Call me if you know. How many people are still behind bars? Not the people that were convicted, people still awaiting trial. Because, you know, dirty little secret, there shouldn’t be one. Not one. Let’s remember that the patriotic Americans who went to Washington that day were there to protest a stolen election. Knoll makes a fantastic point about the way Democrats have used January 6th as a distraction. And that was their goal. And look at Liz Cheney. It was as if even useful idiots like Liz Cheney did the Democrats’ bidding. And she gets an award? What’d she get, the presidential, was it the Medal of Honor? Or was it Freedom? You’re honoring Liz Cheney? The great Molly Hemingway honored her a little bit differently over the weekend with Maria Bartiromo.

Well, this award to Liz Cheney really is inappropriate. This is a woman who was hand selected by Nancy Pelosi to run a committee that was extremely one sided. Liz Cheney, in the course of running this committee to supposedly investigate the January 6th incident at the Capitol, she obstructed. Justice, she witnessed tampered. We have lots of reason to believe she witnessed tampered with Cassidy Hutchinson getting involved in that woman’s actual legal representation. She hid evidence that exonerated Donald Trump. I mean, one of the big things that Liz Cheney had said was that Donald Trump had not, in fact, sought a. presence at the Capitol to protect people who are protesting. And she had evidence when she conducted her interviews that the deputy chief of staff said he personally heard Donald Trump say that he thought 10,000 National Guard troops would be good, that he heard the chief of staff talk to the D.C. mayor encouraging her to request those troops. But she hid that evidence, completely failed to release that evidence until and it only came out after Republicans took control of the House. This is not someone that you should be giving an award to, someone who’s witness tampering, obstructing justice and the like.

So do you think she broke the law? Because remember, in the last few weeks, there was some conversation about Biden issuing her a pardon. Is a pardon warranted?

Well, I think the pardon is being sought by people who know what she did because she is in legal jeopardy. At the very least, she should be investigated for this.

I understand you were one of the January 6th prisoners. Is that true?
SPEAKER 13 :
That’s correct. I was sent to prison. I was arrested by the FBI on the 20th of February of the following year, in 22. Towards the end of the year, September, I was sentenced to 90 days. And for that 90-day sentence, might I add, that they sent me to Leavenworth. I mean, the maximum security prison for a 90-day sentence. But I was also one of the defendants that was affected by the James Little case out of North Carolina, where they ruled… that they gave us the probation and the time. Usually it’s supposed to be one or the other, but they gave us both. and he had filed an appeal and won.
SPEAKER 14 :
Do me a favor, though. I’m fascinated by your story, but I want to go back to what were you convicted of? What did you do on January 6th?
SPEAKER 13 :
I’m glad you asked that. My crime was I was the least severity of all the January 6th defendants. I walked in about five steps, picked up a handful of glass, and walked out. That’s it. And I was charged with four different crimes, but I ended up pleading guilty to picketing, parading, and demonstrating in the Capitol. But one thing I want to add is I didn’t even do that. And the government themselves admit it. Nowhere in my indictment can you find them three words, picketed, paraded, or demonstrated. I picked up a handful of the last five. It was an exterior window. I just wanted some souvenirs. Okay.
SPEAKER 14 :
Yeah, I mean, and I think about people like you, and then when I saw the story the other day about a guy who stabbed somebody on the subway, and he’d been arrested 88 times. 88 times. Yeah, yeah. And walk in the streets, and there you are. How much time did you spend behind bars?
SPEAKER 13 :
Okay, I spent 90 days the first time, and then I spent 15 months of the probation on until then it was ruled it was illegal. I filed a motion to have it terminated, and they denied it and said my behavior while on it didn’t warrant early termination. And I’m like, well, it was illegal.
SPEAKER 14 :
Yeah, of course, because you were there unfairly. Kenneth, I’m sorry for everything you went through. And, of course, there is an absolute double standard in this country. There is such a bizarre standard. Two standards of justice. And look, I think January 20th is going to be about accountability. I think when you look at people like Liz Cheney getting medals from Biden on Friday, did you see that? How about Benny Thompson? It’s insane. And they think they’re going to get away with it. They think they’ll get away with it. This is unreal. I mean, and I was talking to my buddy Mark Davis this morning. Mark said, well, you know, I get it, Liz Cheney. No, there ought to be accountability. There needs to be accountability for what they did. Molly Hemingway had a great point over the weekend with Maria Bartiromo on Fox Business Network about some accountability that there should be accountability from the likes of people like Liz Cheney and Benny Thompson.

The guy’s face was kind of blurry in the video clip I saw earlier this morning. But when Kamala was having to swear in senators last week, somebody wouldn’t shake her hand. And she went, ooh, ooh. She made like a face and kind of laughed and was very awkward. It was kind of an awkward moment. Biden, meanwhile, is going out with quite a blast, giving medals to Liz Cheney and Benny Thompson and Soros. It’s almost like he wants to make sure he sticks his thumb in the eye of everybody who voted for Donald Trump. Do we have the clip of Biden? Cursing. Do we bleep GD? I don’t like GD. I never like to hear that phrase. But that’s the, you know, Mr. Decency, right? The pillar of virtue. Barked at a reporter. And this is the kind of decency that Joe Biden demonstrates. Again, you did bleep GD, right? Because I don’t want that over the airwaves. But here’s Biden angrily snapping back at a reporter.

You know, maybe it’s my years that I spent living in the South. And I got some values from the South that maybe I wouldn’t get anywhere else. Every time I hear GD, I just cringe. It’s so blasphemous and so wrong. And that’s the president, the outgoing president of the United States. But take heart, because he is the outgoing president. And Donald Trump is going to perhaps stroll down Pennsylvania Avenue in two weeks. I hope he doesn’t. Golly, I hope he doesn’t. Mark Davis and I had a disagreement about that this morning. Mark’s like, no, you can’t capitulate. You can’t give in. You can’t let the bad guys win. Look, this man needs to be protected at all costs. I saw that it was… Jimmy Carter, who established the tradition of the president and first lady strolling down Pennsylvania Avenue, waving to the crowd. I don’t know how you keep that crowd, how you keep him safe in the throngs of people who will be lining Pennsylvania Avenue. But Mark’s point is, it’s an important gesture to show Trump’s connection with the people. Look, he’s connected with the people. We re-elected him. I love the chart. I love the graph that shows all the presidents of the United States. And there’s Trump, 45. Biden, 46. Trump, 47. How much do you love that? I mean, really, we’ve got so much to be thankful for. Never lose sight of that. Good things are coming. And I notice that Trump has been a little quiet lately. He’s not going to be quiet January 20th. It looks like, according to Mary in Texas, incidentally, on the MyPillow text line, it was the husband of Senator Deborah Fisher who was being sworn in, who refused to shake Kamala Harris’ hand when his wife was being sworn in. And, you know, some would say, oh, it was tacky. No, good for you. There are a lot of people whose hands I wouldn’t want to shake either. I’m sure there are people who don’t want to shake my hand either. But I’ll shake anybody’s hand. I’m a hugger. I’ll hug you. Look out or I’ll give you a big hug. Let me just ask you this question quick. Let’s do kind of a round, a real lightning round set of calls. Teresa, don’t do your normal great screening. Just put people through quickly. Maybe. I don’t know. It’s a weird question. I don’t know. It’s a stupid question, but I don’t know. The people who were fired up are going to be fired up. I don’t think it mattered what the meteorological conditions would be. I’ve been thinking a lot on this January 6th, though, about one entity. I’ve been thinking about the people still in prison. You know, and I’m trying to track that down a little bit because I’m going to try to get Julie Kelly, who does as good a work on this as anybody in the country, but try to get her on the show today to find out what the status is right now. Where are a number of these January six prisoners with with regards to their process? You know, there was a there was a guy who got on the subway the other day in New York and stabbed somebody to death. That guy had been arrested, get this, 88 times for attacking strangers, shooting one guy, stabbing another person, assaulting, 88 times. And that guy keeps getting released into the public. Now, there are people right now rotting in jail because of their actions on January 6th, four years ago. You forget that. I mean, it feels like you said earlier, like it was a week ago, but it was four years ago. And a lot of these people have no, there’s been no adjudication. There’s been, they don’t have, aren’t we, isn’t everybody allowed due process in this country?
SPEAKER 03 :
Speedy trials.
SPEAKER 14 :
Prompt speedy trials. Unless you’re a Trump supporter who misbehaved on January the 6th. I guess that’s the exemption to the speedy trial.
SPEAKER 03 :
They dared to be on the wrong side politically. Listen, were there consequences that needed to happen from the rioting? Of course. Four years later, is it time to be pretty well done with this? Are there some people who still kind of need to be there? I don’t know. I really don’t know. But when you point out the multiple standards of things, horrific things people can do and be back on the streets in a day, these people are under the heavy anvil of prosecution because of their politics. They’re political prisoners.
SPEAKER 14 :
There’s no other way to describe them. They’re political prisoners. If a guy can stab and shoot and assault people over and over and over and over again and just keep getting released. Look, there was one person killed that day. It was Ashley Babbitt. And they continually lie about the events of January 6th. They’ve lied about the events of January 6th from January 7th on four years every day.

They never want to remind anybody that Trump said, I know you’ll go peacefully and patriotically protest and let your voice be heard. No, I didn’t even say protest. He said, let your voices be heard. So he has been completely smeared over January 6th. So, look, if there’s any irony today, yeah, it’s snowy in D.C., but I think they’re going to do the certification. And you know who has to do it, right? Come on. How great is that? How delicious is that to watch Kamala Harris have to—I mean, look, I enjoyed way too much watching her swear in a bunch of Republican senators the other day. You know, Ted Cruz. I mean, you know she has to hate that. She’s sitting there grimacing, you know, and putting on her brave face. McCormick in Pennsylvania. Look, she’s thinking about— Justice in West Virginia. She’s just thinking about running for governor of California. That’s what she’s got on her plate.
SPEAKER 03 :
How will she do? Because she is the worst candidate in recent history for anything. And yet, so one of two things is true. She’s so terrible and has been so terrible that even her California gubernatorial run will fail miserably. Or it’s California. Yeah. And she could probably win it.
SPEAKER 14 :
Which do you think is true? I tend to think she’s got a good chance. I do, too. California is the goofiest state in America. You know, U-Haul just released a list of all the people that are ordering U-Hauls to go in and out of states. Yep, yep. Top five, my state of Florida, your state of Texas. South Carolina, I think, was number one. Number 50, California. Well, there you are. So, you know, nobody’s clamoring to go to California, and it’s because of what the Democrats have done. Speaking of what the Democrats do, Friday, a Democrat judge named Juan Marchand denied Trump’s request to dismiss the lawfare brought against him by the leftist prosecutor, Alvin Bragg, and they’re going to sentence him. Ten days before he’s sworn in. That’s what, this Friday? Yeah, 6, 7, 8, 9, 10.
SPEAKER 03 :
Yeah, Friday. He did telegraph. He ain’t going to jail. There will be no sentence of prison.
SPEAKER 14 :
No, but you know what he wants to do? He wants to formalize just in time for the inauguration the term convicted felon. Yeah.
SPEAKER 03 :
The conviction is not really, the I’s aren’t dotted and the T’s aren’t crossed. The cherry’s not there on the top until the sentencing occurs.
SPEAKER 14 :
But now it will be. And that’s all they want. And they’re admitting it. They’re talking about it openly. They’re saying, oh, now they’re going to get to it. And it’s not going to matter.
SPEAKER 03 :
It just isn’t. It won’t matter at all. When you were talking about January 6th, because it has been for four years. infuriating to see what Democrats are going to Democrat, but to see the Liz Cheney’s with that stupid metal hanging around her neck last night, you know, all these these other jokers, these never Trumpers and just all all of these stooges and malcontents and the media culture. It has been absolutely infuriating. The January 6th weaponization, the lawfare that you’ve described. But but as as January 20th gets closer as the as the inauguration two weeks from today, Do you get the same sort of peace, the same sense of peace that because all of those things put together, Mike, none of them worked. It didn’t work. None of them were supposed to be unelectable. He was supposed to be so toxic kryptonite to anyone with a pulse. And he won and he won decisively. There’s something so cleansing and satisfying about that.
SPEAKER 14 :
I mean, arguably, not only did it not work, it backfired. I think a lot of people would say even the events of January 6th, four years ago, backfired because people saw the weaponization. And look at what Liz Cheney, the role she played. You’re right. It’s infuriating. This was Biden’s one of his final blank use. This is him giving a middle finger. And he, you know, this you heard you heard the answer the other day saying, G.D., I know more people than you see that quote.
SPEAKER 03 :
I’ve met with more foreign leaders than you have in your entire GD life.
SPEAKER 14 :
Yeah, I might be the oldest president. Class act on your way out. But speaking of class, there he is giving Benny Thompson an award. Now, that’s the guy that wanted to get Trump killed. And George Soros. Flipping George Soros. Got one of those citizenship medals. And Benny Thompson, may we never forget, I think of him the way I think of Pelosi ripping up Trump’s State of the Union. I’ll never forget this. Wanted to strip Trump of his Secret Service protection while running for president.
SPEAKER 03 :
Now, the phraseology was, because you’re, of course, 100% right, but he offered up, what was his, it was legislation that said you lose Secret Service protection if you’re, what, convicted of a felony?
SPEAKER 14 :
Convicted felon, right.
SPEAKER 03 :
I wonder who that was targeted at.
SPEAKER 14 :
Yeah, of course. And Liz Cheney, I watched Molly Hemingway. She was on with Maria Bartiromo the other day, and she said of Liz on her role in the January 6th committee, she obstructed justice. She witnessed hampering. Fabricated evidence. She hid evidence that exonerated Trump. And look, this is why they’re thinking about a preemptive pardon on the part of Joe Biden. I won’t be surprised if he offers that up. Why wouldn’t he? I mean, like you said, if he’s giving awards to George Soros. I also don’t think I’ll care.
SPEAKER 03 :
But it’s so funny because I’m Mr. Accountability. I like to see accountability and just consequences. I mean, please, we talk about this all the time. Maybe, and I don’t want to ever forget, never forget, never forget, never again, all those things. I am ready to forget that Joe Biden was ever born. I’m ready to forget that Liz Cheney hurts. I love her. I care from her Fox News. And I guess maybe I need you this where you’re going to be a value to me, as you always are. to refresh my righteous indignation because I’m not ready to close the door and forget what happened, but I’m just so eager for the future and ready to plow forward. But you know what? The days are full. It is possible to walk and chew gum at the same time. Let us embrace this magnificent, bright future, but also let’s not forget to have some accountability for the people who are so scurrilous.
SPEAKER 14 :
So, so, so scurrilous. They shouldn’t get away with it. They shouldn’t have gotten away with what they thought they got away with. And that’s what they’re afraid of. Benny Thompson has said, I’ll take a pardon. Of course he’ll take a pardon. Because, look, I do think that Trump’s – and this is fascinating. I think it was D.C. Drano put a post out on X over the weekend. Isn’t it a little – How eerie, how quiet, relatively quiet Trump has been. He’s gearing up. I mean, I watched a profile of his new chief of staff. First time a woman has ever been a chief of staff. You know, Mr. Misogynist, you know, the big misogynist Donald Trump. This Susie Wiles is a fascinating character. He calls her, his nickname for her is the Ice Princess. is the ice queen or whatever, because she’s cool as a cucumber. And her big thing is, we’re not having any drama in the Oval Office this time.
SPEAKER 03 :
Discipline, message discipline, behavioral discipline.
SPEAKER 14 :
And it’s the way the campaign was run, too. She was very active in that, and it was a well-run campaign. So she’s fascinating. They are hunkered down. And D.C. Drano’s speculation, a social media influencer, is that that’s because it’s going to be epic. It’s going to be, come January 20th, Gird your loins because it’s Trump who doesn’t have to worry about being reelected.
SPEAKER 03 :
That’s it. He bought the first one.
SPEAKER 14 :
And he’s got the House. He’s got the Senate and he’s got the Supreme Court. It’s like so rare over the century that Republicans are sitting in this position. And I have a hunch, and I’ve got a belief, actually, that you better watch to see Trump make hay out of this. Meanwhile, quick note out of New Orleans, if I can bounce this off of you. Did you see what happened over the weekend? Now, we’ve got this horrific terrorist attack. This guy mows down all of these people. And did you see the faces of those who were killed? Mark, they’re all young kids. So many young folks. They’re all 20-, 30-year-olds, fresh-faced, just there on Bourbon Street trying to have a good time. And this monster mows them down. If there’s any solace or comfort, it’s that the police did their job and sent him to hell when he came out fighting or shooting. A New Orleans prosecutor committed suicide. Assistant District Attorney Ian Kirstein was found Saturday night around 9 p.m. with an apparent self-inflicted gunshot wound inside the offices of the District Attorney Jason Williams’ staff offices. Isn’t that weird? Doesn’t that seem peculiar? Look, weird things come out of New Orleans.
SPEAKER 03 :
There’s no way in the world I was going to be there on New Year’s Eve. And now here comes Mardi Gras, which I guess is the beginning of March this year. And then that little thing called the Super Bowl. And everybody’s it’s weird because doesn’t your average terrorist want to have success because they’re not anticipated? So Mardi Gras and the Super Bowl are probably incredibly safe in New Orleans. The danger exists in some place that we’re not thinking about.
SPEAKER 14 :
Well, what I think is fascinating about speaking of danger, and you and I talked about this the other day, is whether or not Trump is going to walk down Pennsylvania Avenue on January 20th.
SPEAKER 03 :
And you don’t want him to, and I do. Nope. Nope.
SPEAKER 14 :
Stay in the car. Stay in the car.
SPEAKER 03 :
And what was your answer last week when I said if he stays in the car, the terrorists win?
SPEAKER 14 :
I don’t remember. I mean, I don’t remember what I had for breakfast this morning.
SPEAKER 03 :
But isn’t it true? Isn’t that Trump giving in to terrorism?
SPEAKER 14 :
It’s keeping the man safe.
SPEAKER 03 :
I know.
SPEAKER 14 :
Look, every day that he’s surrounded by bulletproof glass, I guess we could say the terrorism.
SPEAKER 03 :
Because because this is why it might be a talk show topic. I don’t know. Do you want Trump and Melania hand in hand walking Pennsylvania Avenue as as their big middle finger to terrorists? Or is this a time when we just have to be. particularly judiciously cautious.
SPEAKER 14 :
I think there are good arguments on, on, you know, who, you know, who was the first one to begin the tradition. Yeah. Jimmy Carter. I saw a profile on him. Of course, they’re fawning over him and they’re barely glossing over his role as president.
SPEAKER 03 :
It’s all like 60 seconds time and a place because I, because I think it, it, it, people go, well, you know, I’ve gotten this and maybe you have too. OK, we get it, Mark. You think he was a terrible president. Yes, I do. Like, I’m not supposed to say that. He was a magnificent person in a lot of ways. His policies were horrible. Two things can be true. And I would kind of be willing to sublimate my thoughts about him policy wise if there were not a media culture singing the praises of him as some noble peacemaker. He was on the wrong side of every global issue. when he was president. So excuse me.
SPEAKER 14 :
But I’ve got a funny little rule. When somebody dies, the debate ends. No, I just think it’s over. I don’t like trashing somebody who died. I mean, I don’t know if there’s a cooling off period, but what’s the point? You know, the man is the man.
SPEAKER 03 :
The point is, there are a bunch of people. There are a bunch of lunkheaded people who consume only one side of things. I think he was a Christlike peacemaker when he was a horrible force for for bad policies around the world.
SPEAKER 14 :
I get it.
SPEAKER 03 :
And so sorry.
SPEAKER 14 :
You know, well, in fact, in fact, Trump stepped in it a little bit. You know, President Trump is upset. Oh, flags at half-staff, exactly. He doesn’t like the flags at half-staff.
SPEAKER 03 :
I know.
SPEAKER 14 :
For Inauguration Day. Well, but that’s the tradition or whatever, apparently, the code. We’ve got to do that. After a president’s 30 days, right? 30 days, yes. That’s okay. Maybe that’s an area you want to stay out of, Mr. President. I don’t know.
